This article uses gun seizure data from the gun lab of the St. Louis Police Department to examine a problem-solving approach to seizing illegal firearms. Further, it explores narrative data from the police reports to understand the context surrounding 113 firearms seizure. The most important findings are that most illegal firearms are seized by the police department in the course of routine patrol, and that many seemingly nonviolent technical law violations (e.g., the unlawful carrying, use, or concealment of a firearm) often occur under violent circumstances. Given the paucity of gun research, future studies should use multiple data sources to further explain the gun/crime relationship. These findings are discussed in the context of routine policing.  相似文献

We examined the association between unintentional nonhunting firearm deaths and changes in firearm legislation in Sweden. There were 43 fatalities during the study time frame 1983–2012, representing 46% of all unintentional firearm deaths during the same period. The victims were predominantly young males (mean age 25 years). Slightly more than half of the deaths were caused by another person and were inflicted at close range. The main cause of the incidents was human error. The majority of the involved firearms were legal; however, most victims killed with illegal firearms were under the influence of alcohol and/or drugs at the time. The death rate decreased significantly following the introduction of the hunter's examination in 1985. Education and training associated with the hunter's examination was at least partially responsible for the decline in fatalities after 1985. Future prevention should target the availability of illegal firearms.  相似文献

The purpose of this article is to explore various factors that may regulate or stabilize levels in market offenses. Instead of assuming that illegal markets are ‘out of control’, evidence is advanced to demonstrate, on the contrary, that there are indeed limits to growth in criminal markets. This is presented along three principal and interconnected arguments. First, social norms limit the ability of suppliers to shape demand for illicit goods and services. Using public opinion surveys, it is concluded that the more objectionable the moral status of an illegal market, the smaller the pool of potential consumers and sellers. Second, there are considerable obstacles that confront suppliers of illegal goods and services accumulating capital and upward mobility. The consequences of product illegality inhibit the organizational growth capacities as well as the geographic expansion of illicit firms. Third, while impunity via corruptible alliances do cancel some of the effects of product illegality, this impunity is not a constant that can always be depended upon. To the extent that corruption varies across jurisdictions and over time, illegal entrepreneurs may come to realize that impunity is intrinsically limited in scope and volatile in nature and over which they essentially have very limited control. Research on crime guns has traditionally focused on the time-to-crime measure. This study shifts the focus to guns that entered the illegal firearm market through thefts. This subset of guns allows us to examine the same process and objective underlying the time-to-crime measure—that being the recovery process. Two new measures are proposed. The first, time-to-find, assesses the time span between a gun’s theft and seizure by police. The second, distance-to-recovery, introduces a spatial dimension to the crime gun repertoire by measuring the distance a firearm travels between its points of theft and seizure. Using a mix of national (Canada) and provincial (Quebec) data on crime guns, this study’s findings show that these two new measures are tapping into a unique phenomenon: whereas time-to-crime accounts for a gun’s complete lifecycle, time-to-find and distance-to-recovery reflect a gun’s criminal lifecycle. At the multivariate level, the most influential factor explaining both time-to-find and distance-to-recovery is the registration status of the gun. Non-registered crime guns took longer to find and traveled lengthier distances between the moments and points of theft and seizure. Our explanation for this is that non-registered guns may be stolen from sources that are more problematic to begin with and, thus, result in the gun’s transition toward a segment of the illegal market that is also more problematic and in demand than the pool of firearms represented by registered guns. This would embed the firearm more deeply into the illegal market, making it more difficult to retrieve and more likely to be dispersed across a wider geographical plane than guns which are registered to begin with.  相似文献

During the 14-year period from 1984 to 1997 there were 85 firearm fatalities investigated by the Department of Forensic Medicine and the Department of Pathology in Edirne, Turkey. We determined the characteristics of these 85 firearm deaths which comprised 17.03% of all medicolegal autopsies. The overall incidence was 1.58 per 100 000 population. The median age was 35.5 years. Fifty-four percent of the victims were aged between 20 and 40 years. Males constituted 82% of the victims. The most frequent manner of death was homicide (68.3%). Handguns accounted for 62.4% of the weapons used. The most common sites for the firearm entrance wounds were both head–neck–nape (32.8%) and chest (32%). In conclusion, our study shows that, in spite of legal restrictions, illegal access to firearms is easy and deaths by firearms are still increasing.  相似文献

Drawing forensic conclusions from an image or a video is known as “photographic content analysis.” It involves the analysis of an image, as well as objects, actions, and events depicted in images or video. In recent years, photographic depictions of objects suspected as illegal firearms have substantially increased, appearing on CCTV surveillance footage, captured by mobile phones and shared on social media. However, the law in Israel states that a person can be charged with illegally possessing a firearm only if it can be proven that the object is capable of shooting with lethal bullet energy. This becomes more challenging in cases where the firearm was not physically seized, and the evidence exclusively consists of images and video. In this study, photographic content analysis was applied to images and video where objects suspected as commercial or improvised firearms had been depicted. An image and event sequence reconstruction video databases of both firearms and replicas were created in order to better define firearm-specific functional morphological features. We demonstrate that it is possible to classify an object as a firearm by analyzing the functional, and not only the esthetic, morphology in images and video. It is also shown that event sequence reconstruction in video may be used to infer that an object suspected as a firearm has the capacity to shoot by confirming the occurrence of a shooting act or shooting process. Thus, photographic content analysis may be used to forensically establish that an object depicted in an image or a video is a firearm by ruling out other known scenarios, and without physically seizing it.  相似文献

The question of whether the illegal firearms market serving criminals and juveniles can be disrupted has been vigorously debated. Recent research suggests that illegal gun markets consist of both “point sources” (ongoing diversions through scofflaw dealers and trafficking rings) and “diffuse sources” (acquisitions through theft and informal, voluntary sales). To the extent that systematic gun trafficking is an important source of weapons for criminals and youth, focused regulatory and investigative resources may be effective in disrupting the illegal flow. In this research, we use data on traced firearms to examine one aspect of the illegal gun market that holds the most immediate promise for focused supply-side enforcement efforts—close-to-retail diversions. We find that almost one-third of traceable crime guns were recently diverted from legitimate retail firearms commerce and that nearly one-third had two or more indicators of gun trafficking involving dealers, purchasers, and possessors. We discuss the implications of these findings for understanding illegal gun markets and for developing effective supply-side enforcement strategies.  相似文献

This study examined the relationship between state firearms homicides and background checks for firearms purchases. Controlling for economic and social conditions, the estimated number of firearms in circulation, offenders under community supervision, and violent crime it was found that states with less stringent background checks on firearms purchases were significantly associated with firearms homicides. The large number of firearms circulating within the United States makes it likely that a motivated—but ineligible—person could obtain a firearm over the long-term in the secondary firearms market. Effective state background checks, however, may temporarily frustrate an unauthorized person from obtaining a firearm that, in turn, may contribute to lower firearms homicide rates. Numerous researchers have documented the gendered impact of the United States’ domestic war against drugs. Women incarcerated for non-violent drug offenses are the fastest growing segment of America’s prison population because of the harsh penalties for using, selling and transporting illegal substances. The impact of U.S. drug policy on women in other countries, in contrast, has been overlooked. This paper argues that the greatly increased imprisonment of women in Ecuador for drug-related offenses is collateral damage of the U.S. war on drugs. The impact of the expansion of women’s imprisonment in Ecuador appears to be particularly damaging to the inmate’s children who frequently join their mother in prison. U.S. policy should not be exported to other countries before having a clear picture of the unintended negative consequences.  相似文献

Although physical punishment has been studied for decades, there are gaps in the literature regarding frequently used form, context, and cross cultural differences. A comparison was made using 227 college students in the United States and Japan, who were presented with four scenarios and surveyed regarding attitudes toward physical punishment, perceptions of appropriate discipline methods, and past experience with physical punishment. Japanese and U.S. respondents reported similar personal experience with physical punishment (Japanese 86%, U.S. 91%). However, U.S. respondents reported a higher likelihood of being hit with an object than did Japanese respondents. For U.S. respondents, the bottom and the hand were the top two sites on the body used for physical punishment, whereas the head and the face were the top two places for the Japanese sample. Unlike U.S. respondents, type of child misbehavior was found to have an impact on Japanese respondents’ views on the appropriate discipline method.  相似文献

This study focused on a series of hypotheses regarding residents’ attitudes toward the police: (1) residents’ attitudes toward the police are better represented by a two-dimensional model that differentiates global perceptions of the police from assessments of the police in the respondents’ neighborhood; (2) the structure of residents’ attitudes toward the police is different for Whites, African Americans, and Latinos; (3) direct experiences with the police in the respondents’ neighborhood will be more strongly associated with the respondents’ assessment of police in their neighborhood than global perceptions of the police; and (4) the influence of direct experiences with the police will be stronger for African Americans and Latinos than for Whites. Results based on structural equation modeling offer strong support for the need to differentiate between global and neighborhood perceptions of the police. The underlining measurement structure of attitudes toward the police was similar for Whites, African Americans, and Latinos. However, the relationship between global and neighborhood attitudes was stronger for African Americans and Latinos. Negative contact with the police was associated with both negative global and neighborhood assessments of the police. Non-negative contact was associated with positive neighborhood perceptions of the police; however, only when it occurred within the neighborhood. The influence of direct experiences with the police (both inside and outside the neighborhood) was similar for Whites, African Americans, and Latinos.  相似文献

Swedish legislation concerning firearms is highly restrictive. It is illegal to possess weapons (except airguns) without a license. From 1970 through 1982, there were 79 accidental firearm fatalities in Sweden. This number, corresponding to 0.074/100,000/year, is very low in comparison with similar statistics worldwide. Of these fatalities, 47 were associated with hunting and were studied carefully. Despite an increase in both the popularity of hunting and in licensing of weapons, on change in the number of accidents per year could be confirmed. Twenty-nine accidents occurred during small game hunting, of which 24 involved shotguns, and 18 occurred during moose hunting. The mean age overall was 46 years. All victims and shooters were men. Most accidents occurred before noon and during the autumn. During moose hunting, the victim most commonly was either mistaken for game or was standing beyond game. During small game hunting, the most common reason for death was improper handling of the weapon. Firing of defective weapons caused at least 10 fatal accidents. Alcohol inebriation was uncommon. It is unlikely that more restrictive firearm legislation would further decrease the number of fatal accidents. Instead, we believe that accidental firearm fatalities during hunting can be prevented by safer and more careful handling of weapons, including unloading weapons before transporting them; by replacing older weapons with more modern and safer ones; and by not allowing children to handle weapons. No shots should be fired until it is clarified that the target really is a game animal, and when hunting with rifles, the fields of fire should be clarified beforehand. Shooters at stand must be instructed not to leave their stands until explicitly told to do so.  相似文献

Surveys are commonly used in the field of criminology and criminal justice; however, the effects of survey design on study findings are rarely examined. Using a randomized experiment, this study examined the effects of question order in a victimization survey on respondents’ perceptions of safety. The interactions between respondents’ characteristics and question-order effects were also explored. The simple question-order effect was not found for the overall sample, but further examination revealed that respondent characteristics such as sex and victim status interact with the arrangement of questions. The implications of the findings for victimization survey research, and more generally for studies using surveys as a primary tool, are discussed.  相似文献

Obtaining quality DNA profiles from firearms can be instrumental in assisting criminal investigations. Typically, swabbings of firearms for handler's DNA are conducted on specific regions of the firearm prior to submission to the laboratory for analysis. This review examines and compares 32 cases whose gun swabbings were either analyzed individually according to the specific region which was swabbed, or analyzed collectively by combining the swabbings from all the individual areas. Those firearms whose swabs were analyzed separately exhibited lower DNA yields and consequently fewer loci exhibiting genotypes. Those cases whose swabs were analyzed collectively exhibited higher DNA yields and consequently greater numbers of loci exhibiting genotypes. These findings demonstrate that collective swabbings result in more complete profiles and lead to the recommendation that a firearm be swabbed in its entirety using no more than two swabs.  相似文献

A project by a metropolitan police agency in 2008–2009 had police use touch DNA kits to collect cell samples from seized firearms. To assess outcomes, results of touch DNA swabbing of firearms were compared to fingerprinting firearm evidence. The rationale was that fingerprinting, as the older technology, was the baseline against which to compare touch DNA. But little is known about ways to measure touch DNA productivity compared to fingerprinting. To examine differences between the two requires comparable measurements. Two measures were used: quantity of probative or investigative evidence produced and identification outcomes. When applied to firearms seized within an Indianapolis, IN police district, touch DNA produced a larger volume of evidence than fingerprinting, but identification outcomes for the two methods were equal. Because touch DNA was deployed by police patrol officers, there are implications for firearm forensics and the choice of forensic approaches used by police.  相似文献

Likelihood ratio (LR) plays an important role in estimating the weight of evidence in firearm evidence identifications. LR is computed from a statistical model including the distribution of the known-matching (KM or within) and known-nonmatching (KNM or between) comparison scores. Current LR procedures rely on KM/KNM scores from existing reference firearm toolmark data sets or alternatively from generating a set of test fires using multiple firearms. Both procedures may contain theoretical or practical issues which may hinder the LR procedures from reporting an unbiased LR estimation in casework. In this paper, a reference data set was established from a set of firearms, each test-fired two cartridge cases, resulting in a basic data set and a control data set. The congruent matching cells (CMC) method was used to generate CMC scores that are used to fit in the KM/KNM statistical distributions for LR estimation. In the initial test, 130 firearms from eight manufacturers were used for generating a reference data set consisting of 260 cartridge cases representing 130 KM and 8385 KNM pairwise breech face images. Test results showed that the KM and KNM distribution intersect at CMC = 2, which is equivalent to LR = 1 (equally to support both the prosecutor and the defense propositions). When the CMC threshold is increased to 6 or more, the LR values are higher than a million, which can provide extremely strong support to the conclusion of the same firearm (or the prosecutor's proposition) in the casework of firearm evidence identification.  相似文献

A national sample of adults in the United States reported on presence, frequency, emotional impact, and behavioral impact of psychologically abusive behaviors in their “worst” cohabiting relationship by their partner as well as by themselves. In addition, they completed instrumentation measuring potential outcomes from much psychological maltreatment. Results from the online survey indicated that psychological abuse of an egregious nature was highly reciprocal, although overall, respondents reported that they engaged in psychological abuse less frequently than their partners and believed that their partners experienced much less negative impact from the respondents’ actions. Specific categories of psychological abuse as well as specific behaviors were also highly likely to be reciprocated. Combinations of high and low psychological abuse exhibited by the respondent and his/her partner resulted in negative outcomes whenever the partner was high in psychological abuse whether or not the respondent used these egregious tactics.  相似文献

Canada has implemented legislation covering all firearms since 1977 and presents a model to examine incremental firearms control. The effect of legislation on homicide by firearm and the subcategory, spousal homicide, is controversial and has not been well studied to date. Legislative effects on homicide and spousal homicide were analyzed using data obtained from Statistics Canada from 1974 to 2008. Three statistical methods were applied to search for any associated effects of firearms legislation. Interrupted time series regression, ARIMA, and Joinpoint analysis were performed. Neither were any significant beneficial associations between firearms legislation and homicide or spousal homicide rates found after the passage of three Acts by the Canadian Parliament--Bill C-51 (1977), C-17 (1991), and C-68 (1995)--nor were effects found after the implementation of licensing in 2001 and the registration of rifles and shotguns in 2003. After the passage of C-68, a decrease in the rate of the decline of homicide by firearm was found by interrupted regression. Joinpoint analysis also found an increasing trend in homicide by firearm rate post the enactment of the licensing portion of C-68. Other factors found to be associated with homicide rates were median age, unemployment, immigration rates, percentage of population in low-income bracket, Gini index of income equality, population per police officer, and incarceration rate. This study failed to demonstrate a beneficial association between legislation and firearm homicide rates between 1974 and 2008.  相似文献

Deregulation and the combined threats of energy crises and global warming concern nations around the world, yet these issues continue to be addressed more directly by domestic regulatory systems than by international institutions. The present analyses of the integration of distributed sources of power generation (DG) into California’s electric utility system suggests that domestic environmental dilemmas with international repercussions provide an obvious entrée for global environmental policy specialists into the practice of environmental policy-making and law. Here I review current scholarship on policy networks that illuminates the contributions that technical and policy experts can make to such networks surrounding environmental issues. I then introduce the key members of California’s “clean DG” policy network that emphasizes the role of academic experts in this influential political system, and discuss how my own research has impacted the development of the state’s DG policy. I conclude that scholars are well positioned to observe and engage domestic and international environmental policy networks, and thereby also to influence environmental politics and law.  相似文献

Intimate partner violence continues to be prevalent, resulting in negative consequences for the individuals involved and for society as a whole. Perceptions of safety in relationships where intimate partner violence is present is an understudied topic in the literature. The Safety Assessment of Future Events Scale (SAFE) was developed to assess respondents’ perceptions of safety in their intimate relationship. The purpose of this study was to examine whether group differences existed on respondents’ SAFE scores. 428 participants from community and clinic samples completed the SAFE and other measures contained in a southwest university’s marriage and family therapy clinic intake packet. ANCOVA was used to control for gender and setting in determining if group differences existed on the SAFE based on measures assessing interpersonal violence, relational adjustment, intrapersonal symptoms, and PTSD symptoms. Results indicated group differences based on gender, interpersonal violence victimization, and relational adjustment.  相似文献
