ABSTRACT

This paper examines whether campus police legitimacy relevance varies across different crime contexts. 519 respondents from 31 undergraduate sections at a public university rated campus police legitimacy as well as their willingness to report a campus crime to the public safety department. Students were assigned to different crime vignettes, involving experimental manipulation of crime type: petty theft, indecent exposure, aggravated assault, and gun possession on a college campus. Results indicate general support for the procedural justice model, specifically the invariance of the influence of legitimacy on reporting. This paper argues for increased specificity in measurement of cooperation beyond general willingness to assist, or a single crime context.  相似文献

Under what conditions do people support police use of force? In this paper we assess some of the empirical links between police legitimacy, political ideology (right-wing authoritarianism and social dominance orientation), and support for ‘reasonable’ use of force (e.g. an officer striking a citizen in self-defence) and ‘excessive’ use of force (e.g. an officer using violence to arrest an unarmed person who is not offering violent resistance). Analysing data from an online survey with US participants (n?=?186) we find that legitimacy is a positive predictor of reasonable but not excessive police use of force, and that political ideology predicts support for excessive but not reasonable use of force. We conclude with the idea that legitimacy places normative constraints around police power. On the one hand, legitimacy is associated with increased support for the use of force, but only when violence is bounded within certain acceptable limits. On the other hand, excessive use of force seems to require an extra-legal justification that is – at least in our analysis – partly ideological. Our findings open up a new direction of research in what is currently a rather sparse psychological literature on the ability of legitimacy to ‘tame’ coercive power.  相似文献

Whether individuals evaluate a distribution of outcomes to be unfair and how they respond to it depends upon the social context and their perceptions of why the objective injustice occurred. Here we examine a general feature of the situation that highlights what is often overlooked in distributive justice research: the impact of the group. We conceptualize such impact in terms of the group value model of procedural justice (Lind and Tyler, 1988) and in terms of collective sources of legitimacy (Walker and Zelditch, 1993). The former highlights how the extent to which one feels valued by the group may enhance perceptions of distributive justice (net of actual outcomes) and thus ameliorate the impetus to respond to objective injustice. The latter considers how the dynamics of group influence may reduce the propensity to respond behaviorally to perceived injustice. Our analysis shows how procedural justice and legitimacy (in the forms of authorization and endorsement) may affect attributions in a work setting, and, in turn, influence individuals' justice perceptions and reactions. By combining these elements, we chart for the first time the relative impact of two factors representing elements of the group on an individual's evaluation of and response to distributive injustice.  相似文献

The procedural justice model has been widely used as an explanation for understanding legitimacy and compliance with the law, particularly within the context of policing. Central to this model is the importance of procedural fairness—in which the treatment of citizens and offenders by criminal justice agents can play a key role in building legitimacy and influencing compliance with legal rules and values. This paper examines the relationship between procedural fairness and legitimacy within the context of corrections. Drawing on data from a longitudinal survey of more than 3,000 prisoners across England and Wales, we identify an important link between procedural fairness and prisoner perceptions of legitimacy. We further examine variations in legitimacy in terms of individual prisoner characteristics, conditions within prison, as well as differences between prisons.  相似文献

Exploring the relationship between procedural justice and citizen perceptions of police is a well‐trodden pathway. Studies show that when citizens perceive the police acting in a procedurally just manner—by treating people with dignity and respect, and by being fair and neutral in their actions—they view the police as legitimate and are more likely to comply with directives and cooperate with police. Our article examines both the direct and the indirect outcomes of procedural justice policing, tested under randomized field trial conditions. We assess whether police can enhance perceptions of legitimacy during a short, police‐initiated and procedurally just traffic encounter and how this single encounter shapes general views of police. Our results show significant differences between the control and experimental conditions: Procedurally just traffic encounters with police (experimental condition) shape citizen views about the actual encounter directly and general orientations toward the police relative to business‐as‐usual traffic stops in the control group. The theorized model is supported by our research, demonstrating that the police have much to gain from acting fairly during even short encounters with citizens.  相似文献

This study investigates the relative contributions of instrumental and normative models to the legitimacy of and cooperation with the police in Turkey. Based on a random sample of 1,800 Istanbulians, the potential contributions of perceived neighborhood characteristics also are considered. Results show that both instrumental and normative models of regulation are applicable to the highly centralized and state-serving Turkish policing context. While the instrumental model exerts relatively more influence on legitimacy than does the normative model, the two models are of equal importance in predicting legitimacy after perceived neighborhood characteristics are taken into consideration. Social cohesion and local government performance also emerged as significant predictors of police legitimacy. Public cooperation with police, on the other hand, is encouraged by increased police legitimacy, better local government performance, and higher household income. Implications for future research and policy are discussed.  相似文献

Procedural justice has dominated recent discussions of police interactions with the public. It has mostly been measured from the perspective of citizens (using surveys or interviews), but several important questions about predictors and outcomes of fair police treatment are best answered using direct observations of police-citizen interactions. Building on prior observational studies, we develop and validate an instrument for measuring procedural justice as it is exercised by the police in the natural setting of their encounters with the public. In doing so, we adopt a “formative” rather than the common “reflective” approach, based on the assumption that specific behaviors that make up procedural justice do not reflect a single underlying construct but rather form one. We justify this approach and validate our instrument accordingly. We also discuss the implications of our measurement for future research on procedural justice in police behavior.  相似文献

As communities face unrest and protest because of perceived racial bias and decreased trust and confidence in the criminal justice system, it is critical to explore mechanisms that foster institutional legitimacy. Voice is a central element in the procedural justice framework because it is anticipated to promote process control as well as a shared understanding between institutions and communities. As a concept, however, voice is undertheorized. Measures of voice used in legitimacy research may result in oversimplification of the concept, not fully capturing the struggles disadvantaged people face in trying to exercise influence in the court system. Through the use of rich data from qualitative interviews with youth and families involved in the juvenile justice system and in‐depth observations of juvenile court events, we explore what voice is, the mechanisms through which people try to assert voice, and how voice matters in the legal process. Respondents sought voice for many reasons, including to validate their experiences, to affirm their membership in a community, and to assert concerns about perceived police misconduct. Contrary to traditional conceptualizations of voice as a static event (e.g., having voice or not having voice), voice was a process of negotiating dialogue between court officials and court participants throughout the legal process.  相似文献

This empirical study examines procedural justice perceptions among 51 female serious offenders in Ecuador, with the aim of identifying differences between those women who were satisfied with law enforcement and those who were not. The results demonstrate that when women were treated with courtesy and respect, and their rights were acknowledged, they felt satisfied with the police, in a way that they did not give importance to the irregularities they observed while arrested and in custody. On the other hand, the majority of women participants were dissatisfied with the police. Their dissatisfaction with, and lack of trust in, the authorities affected their desire to cooperate with police activities. The study also demonstrates that, although the Ecuadorian police force has made considerable efforts in promoting citizens’ trust during the last 7 years, corruption and illegal police conduct when dealing with offenders are far from uncommon.  相似文献

This paper reports the results of a laboratory experiment on power (specifically, authority) on negotiation process and outcomes. The experiment found that when given a goal to appear fair, high authority negotiators take less of the resources than when not given a goal to appear fair. Furthermore, this paper predicted and found that the relationship between authority imbalance and concern for fairness on negotiation outcomes is a multiplicative relationship. The theoretical and practical implications of these findings are discussed within the context of negotiations in intraorganizational relationships.This paper is based on a dissertation by the author, entitled Authority, Dependency, and Fairness in Negotiations. The current research explores six hypotheses derived from the well-known procedural justice-based model of legitimacy in two different religious groups in Israel, and adds to the model the effect of religiosity on the perceived legitimacy of rules and institutions of social control. Our results, based on data from a representative sample of 1,216 Israeli Jews and Arabs, provide general support for the hypotheses. We found that the social order is perceived as less legitimate by the Arab minority compared with the Jewish majority, and by highly religious members of the Jewish majority compared with those who are less religious.  相似文献

This paper advances the argument that individual privacy is a procedural justice issue in organizations. A review of the organizational privacy literature supports this argument, and new directions for procedural justice research are suggested. Legitimacy-based approaches to crime prevention assume that individuals will comply with the law when they believe that the law and its agents are legitimate and act in ways that are “fair” and “just.” Currently, legitimacy-based programs are shown to lower aggregate levels of crime; yet, no study has investigated whether such programs influence individual offending. Using quasi-experimental design and survival analyses, this study evaluates the effectiveness of one such program—Chicago’s Project Safe Neighborhoods’ (PSN) Offender Notification Forums—at reducing individual recidivism among a population of returning prisoners. Results suggest that involvement in PSN significantly reduces the risk of subsequent incarceration and is associated with significantly longer intervals that offenders remain on the street and out of prison. As the first study to provide individual-level evidence promoting legitimacy-based interventions on patterns of individual offending, out study suggests these interventions can and do reduce rates of recidivism.  相似文献

This paper explores the under-researched topic of young people’s attitudes towards police in two studies using structural equation modelling. The first study examines the influence of police legitimacy on the willingness of young people to assist police. The second study examines the impact of informal contact with police during a community policing project on young people’s willingness to assist police. Findings show that young people who view police as legitimate are more willing to assist police. Participation in the community policing project had a significant and positive influence on young people’s willingness to assist police independent of young people’s attitudes about police legitimacy.

Abstract

Recently there has been increased emphasis on actionable intelligence in counterterrorism. Building from the process-based model of regulation, police chiefs and scholars generally agree that community policing has promise in this regard. Yet, it is not clear the extent to which police officers concur. Since officers are in a position to implement community policing practices, it is important to understand variants in officer-level support. Using data collected from 741 officers in three departments, this project explores officer-level views of community policing’s utility to address terrorism and more common crimes. Overall, officers view community policing as appropriate to address both common crimes and terrorism. Results suggest that department-level policy itself is not the key driver of support. Rather, an officer’s own experience with community policing and support for the practice in general determine views on community policing in counterterrorism. Results also highlight the importance of comparative research across departments.  相似文献

This article tests the contribution that social capital theory, performance theory, and the procedural justice-based model can make towards explaining the trust of majority and minority group members in the police. The central research questions are: (1) do the same factors determine their levels of trust? and (2) are the effects parallel? To answer these questions, we carried out regression analyses on data collected from majority and minority group members living in Belgium (960 face-to-face interviews). The results show that, although the three theories offer explanatory elements for members of both majority and minority groups, the explanation of their trust in the police is not identical. Procedural justice, in the form of voice and respectful treatment by supervisor, and ethical decision making are examined in this research. Ethical decision making is hypothesized to be a direct function of moral intent, as indicated by willingness to use moral criteria in decision making. Moral intent is, in turn, expected to be a function of the decision-making context, including perceptions of voice, respect and trust between supervisor and subordinate, and moral climate. Individual moral development is also expected to have a positive effect on moral intent. Results generally support the model, with two exceptions. First, perception of voice has a negative effect on moral intent, while caring climate and respectful supervisory relations have the expected positive effect on moral intent. These results suggest either a compensatory model of ethical decision making or a complacency effect. Second, individual characteristics had very little effect on either the decision made or the level of moral intent developed, save for one decision. These results suggest an important overlooked variable, the salience of issues for procedural justice concerns.  相似文献

Research Summary
To extend research on legitimacy to the correctional system, we study a sample of 202 adult inmates randomly assigned to serve their 6-month sentence at one of two institutions—a traditional prison or a military-style correctional boot camp. Findings show that perceptions of justice system legitimacy changed during the course of incarceration, that the prison (but not the boot camp) proved delegitimizing, and that certain regime characteristics explained why.
Policy Implications
Across academic disciplines, studies continue to link compliance with perceived legitimacy. Compliance with the law, for instance, is related closely to the legitimacy of the justice system and its actors. These findings suggest implementing legitimacy-building policies such as procedurally fair treatment and decision making by police officers and judges. This article, by finding legitimacy to be malleable even at the final stage of the justice process, proposes the efficacy of similar policies in the correctional system. As research from England and Wales has shown, legitimizing strategies in this context could increase compliance both during and after incarceration.  相似文献

This study broadens the framework within which the psychology of support for affirmative action policies is examined to include the institutional framework within which such policies are developed and implemented. This broader framework includes concern with electoral support for those who implement affirmative action policies, as well as considering the impact of implementing such policies on the overall legitimacy of government. It also includes evaluations of the fairness of the two key social institutions shaping such policies—government authorities and markets. The results of a survey of Americans suggest that this institutional framework had an important influence on reactions to affirmative action policies that was distinct from direct reactions to policies themselves. In particular, people were more supportive of policies intervening in markets when they believed that markets represented unfair social allocation procedures. Those politicians who supported such policies received greater electoral support when people viewed market procedures as being unfair and when they felt that government decision-making procedures were fair. Evidence suggests that outcomes did not directly shape electoral support or judgments about the legitimacy of government.  相似文献

Termination of parental rights (TPR) proceedings are among the most important family court activities. This study contributes to knowledge of the TPR process by illustrating practices employed in TPR proceedings and considering ways that certain practices can hinder perceptions of fairness. TPR court records from one state were analyzed using inductive coding procedures. The analysis identified nine categories of threats to perceptions of fairness in the TPR process. Findings have implications for procedural justice and the legitimacy of child welfare practice.  相似文献
