Law and order as a development issue: Land conflicts and the creation of social order in Southern Malawi

Registration of individual title to land in order to create legal security has been the central concern in the rich literature on land and law in Africa. The problem of legal insecurity is approached here from a different angle which has received relatively less attention: dispute settlement. The article results from the observation of land disputes in local political arenas. It portrays a local legal cultural universe in which legal insecurity arises especially from legal situations stressing group consensus. It appears that people who are accused of witchcraft and groups which are said not to belong are particularly vulnerable in such a legal culture. The conclusion argues that this case material reveals connections between law, land and the creation of social order which may throw light on many other situations. It pleads for more attention to be paid to the development of jurisprudence in attempts to create legal security.     

Who governs? Religion and order in postcolonial Africa

Abstract

This article explores how mutually productive intersections between religion and governance constitute international political order in sub-Saharan settings. Asking ‘who governs’, I propose religion–governance entanglement as a means of analysing these intersections and rethinking governance, order and religion in Africa. Existing literatures typically characterise the public reliance on religious actors and institutions as being part of a uniquely ‘post-secular’ moment in contemporary world politics or a wider ‘post-Westphalian’ shift in modern governance. Enduring dynamics between postcolonial states and the Global North problematise these framings. In sub-Saharan Africa, religion has a protracted history in postcolonial hybrid governance, overlapping the regional presence of international non-govermental organisations following decolonisation. Using the example of South Sudan, I build on recent analyses of religious-political activities that leave their collective implications under-theorised.

Abstract

This article attempts to summarize the efforts that have been made during the 1970s in the search for an appropriate definition of international terrorism, its causes, and the measures to combat it. It evaluates these efforts in the context of the simultaneous interests in human rights. It advances some propositions as to how international terrorism could be seen from the perspectives of both social‐psychological theories of violence and Western legal practices. In conclusion, the relationship between the individual and the state is evaluated in the context of the present world order and its operative political and legal principles. Although this approach may not solve the problem of international terrorism by advancing any neat scheme of control which can be readily applied by anxious governmental law enforcement agencies, nor succeed in articulating a strategy for the respect of human rights by governments and individuals, it will hopefully generate some ideas about how justice can be rediscovered while searching for viable solutions for both international terrorism and human rights.

20世纪初曾有一位学者说过:"大学什么都研究,就是不研究自己。"长期以来,高校的学生管理工作常常游离于法治视野之外,高校也成为现代社会法治阳光难以照射到的地方之一。然而,随着社会的发展,法治成为人类社会走向文明的历史选择,高校"无讼"的年代也已过去。从这层意义上讲,高校学生管理工作的法治化构建,既是培养高素质人才的需要,同时也是高校学生工作走向现代化的一个标志。
