This is a review essay concerning the book Regulation by Litigation. Utilizing public choice theory as the basis of its analysis, the book presents three case studies designed to demonstrate that regulation by litigation does not serve the public interest. This review essay attempts to show that public choice theory does not explain the decision to use litigation in these cases, that the alleged failure of litigation in these cases might not be failures at all, and that regulation by litigation is not the unmitigated evil the authors of the book suggest.  相似文献

In this issue New Political Science begins a new tradition, printing an extended review essay of the book that received the Michael Harrington Book Award at the most recent American Political Science Association Meeting. The Michael Harrington Award is given for an outstanding book that demonstrates how scholarships can be used in the struggle for a better world. In 2011, the award went to Michelle Alexander for her book The New Jim Crow: Mass Incarceration in an Age of Color-Blindness. Martha Joynt Kumar is a professor of political science at Towson University. Her book, Managing the President’s Message: The White House Communications Operation (Johns Hopkins University Press, 2007), examines the media and communications operations of the administrations of Presidents Bill Clinton and George W. Bush. In March 2008, Professor Kumar was interviewed in the White House Press Briefing Room by Kevin R. Kosar on behalf of Public Administration Review.
