对中国农村妇女人权保障的宪法思考

妇女权利是普遍人权不可剥夺、不可分割的有机组成部分,包括妇女的公民和政治权利、经济权利、社会和文化权利以及由妇女的生理特征所产生的权利等.尤其是在中国,农村妇女是妇女群体中的弱者,其合法权益亟需有效的法律保障.为保障农村妇女权利的实现,首先应当回归其作为人权主体的宪法地位.同时,宪法应当平等赋予和保障农村妇女的各项权利,并依据宪法精神来完善农村妇女人权保障的法律体系.     

中国妇女权益保障的法制建设

1995年后,随着联合国第四次世界妇女大会的召开和中国依法治国方略的提出,妇女人权受到中国政府重视和社会各界的普遍关注。文章在总结十年来中国妇女权益保障法制建设成就的基础上提出健全法制是妇女权益保障的有效机制。     

河北省农村妇女土地权益保护状况研究

本文结合河北省实际,从理论和实践两个层面,对农村妇女土地权益的保护问题进行了全面探讨.分析了当前河北省妇女土地权益的特征以及现行政策法律的不足,介绍了其他省的经验,并就村民自治如何做到民意性与合法性的统一、出嫁女的村集体经济组织成员资格界定等热点问题,提出了自己的看法.     

农村宅基地使用权流转法律问题研究

农村宅基地使用权流转在中国目前法律框架下是不受肯定的,但是出于对土地资源的充分利用和农民合法利益的保护,流转是十分必要的,且事实上存在的地下流转市场呈失控状态。因此,立法对宅基地流转予以确认,建立良好的流转管理体制,对维护农民的利益是十分必要的。土地权利和利益的合理配置,也是实现社会公正的一个重要方面。     

浅议当前农民权益保护立法

加快农民权益保护立法是切实保护农民权益的一个重要举措。当前,农民权益保护在立法上还存在着空白,还应进一步建立健全农民经济、政治权益保护、农民工合法权益保护以及农村社会保障等方面的立法,以尽早实现全面建设农村小康社会的奋斗目标。     

Protection of Women's Rights in the National Governance of Contemporary China

The development of women's rights is a specific field in modern national governance.The essence of women-related issues in modern times lies in the political and legal systems based on gender inequality and the unequal male-female relationship established by male chauvinism, which has further created domination over and prejudice against women.Since the founding of the New China, especially after the launch of reform and opening-up, the Communist party of China and the state have attached great importance to the protection of gender equality, bringing about the continued improvement of the protection of women's rights.However, due to various economic and social barriers, there is still a long way to go to achieve full gender equality.To understand the issue of women's rights from the perspective of national governance and apply the concept of modern national governance to the protection of women's rights, it is imperative to pay great attention to the substantive equality concept in the protection of women's right during the national governance process, take empowering women as an important approach, raise women's gender equality awareness, and recognize, grant, enhance and guarantee women's individual rights .     

我国农地产权分析及制度重构

我国农地产权制度由于产权界定不合理和农民土地产权的缺失,导致违法征地现象严重.土地交易成本昂贵,农民的合法权益得不到保护.文章引入产权理论,特别是从农地的使用权和处置权方面,论述了农地问题造成的原因,提出合理界定农地产权,建立允许农地承包经营权流转的机制,让农民分享产权增值的成果.     

The Centennial History and Significance of the Protection of the Rights and Interests of Persons with Disabilities by the Communist Party of China

The Communist Party of China has been concerned with the protection of the rights and interests of persons with disabilities since its founding.in the period of the new democratic Revolution and after the founding of the People's Republic of China, it adopted a series of protective measures in various forms in line with local conditions.Since the reform and opening-up, the cause of persons with disabilities has developed in an all-around way under the leadership of the CPC.especially since the 18th national Congress of the Communist Party of China, the protection of human rights for persons with disabilities has been innovatively developed, and persons with disabilities have been truly participating in social affairs and share the country's development gains as equal subjects of rights.The centennial history of the Party's protection of the rights and interests of persons with disabilities shows that the CPC's ideas of human rights protection consecutively comprise humanitarian assistance, humanitarian protection, and people-centered human rights protection.The main identity of persons with disabilities has changed from the object of protection during the revolution to the object of medical care and social welfare, and the subject of human rights.The content of protection of rights and interests has developed from survival assistance to comprehensive protection including education, rehabilitation, employment, etc.The dignity, autonomy, equality, and social participation of persons with disabilities as the subject of human rights have become increasingly prominent.     

论中国保障妇女权益法律理念的变迁——以《妇女权益保障法》及各地实施办法修改为例

本文基于《妇女权益保障法》及各地实施办法的修改,比较系统地论述了中国保障妇女权益法律理念的变迁。本文认为,《妇女权益保障法》及各地实施办法较好地吸收、借鉴了近年来保障妇女权益理论的主要研究成果,充分体现了坚持以人为本、维护社会公平正义、尊重和保障妇女人权等社会主义法治理念。     

农村集体土地征收与私权保护

本文就现行农村集体土地制度存在的土地所有权主体错位、土地所有权权能不全、土地所有权主体的权利得不到法律的有效保护、土地流失严重、土地承包关系不稳定等弊端进行了分析,并就如何建立科学、可行的农村集体土地所有权制度作了粗浅的探讨,以期更好地保护被征收人的合法权益。     

天津滨海新区失海失地农民权益保障问题探析

2009年天津滨海新区行政管理体制改革以来,随着新区整体规划的推进实施,越来越多的农村土地、海地被征收,失海失地农民人数增加,他们的权益保障问题日益突出,成为影响全区社会稳定和经济发展的重要因素。因此,只有通过分析滨海新区失海失地农民权益保障存在的问题,有的放矢地拿出整体解决方案,建立健全失海失地农民权益保障制度,即建立合理的征地补偿机制;健全对地方政府的征地约束机制;健全失海失地农民社会保障机制;完善失海失地农民就业扶持机制,才能切实解决他们的权益保障问题。     

规范流转机制确保农民权益--关于农村集体土地使用权流转问题的探索

农村微型金融发展体现了对农民生存权、金融权以及发展权的保护和支持。我国农村微型金融发展历经十几年,金融形式不断创新,体现了对农民权益的支持与保护。但是当前我国农村微型金融存在着目标偏离、体系不健全、缺乏法律支持等问题,需要重塑农村微型金融的发展目标和完善农村微型金融体系,促进我国农村微型金融发展。     

社区就业的性别特征与防止妇女地位边缘化的思考

本文定量研究了社区就业的性别特点,针对社区就业在劳动时间、劳动报酬、工作场地、保险福利、劳动关系、权益保护和社会保障等方面存在的非正规性及对女性在劳动力市场上边缘化的不利影响,作者提出,要重视从两个方面实现社区就业和妇女发展的共同促进,第一是促进对社区就业的规范化管理,完善对社区就业劳动者的就业权益保护;第二是通过妇女创业、妇女维权和妇女非政府组织建设等手段加强对社区就业妇女的权益保护和创业促进。     

New Development Concept Guides the New Development of Human Rights Theory in China

The new development concept of innovation, coordination, green, openness and sharing has posed new requirements for the development of human rights theory in China. Innovation is the impetus and vitality for the development of human rights theory and is required for the study of human rights in terms of its content, method, and form. Coordination is the social basis for the development of human rights theory in contemporary China and human rights theory can be scientific and persuasive through coordination of the interests of all parties concerned. Green is the natural basis for the development of human rights theory in contemporary China and human rights theory can have rich connotations and far-reaching impact through ecological protection and environmental control. Openness is the international vision for the development of human rights theory in contemporary China and the international influence of human rights theory in contemporary China can be increased constantly through international exchange and dialogue on human rights theory. Sharing is the value pursuit for the development of human rights theory in contemporary China and human rights should be jointly constructed and shared by the entire people in an all-round way.     

安徽新生代农民工维权保障与政治认同

在对安徽省新生代农民工访谈和调研的基础上,探讨新生代农民工维权保障在政治认同中的作用。由于城乡二元结构导致的分野,使新生代农民工在身份定位上、权益保障上、利益诉求表达渠道上遭遇众多尴尬、困惑和迷茫。为此,应高度重视对新生代农民工维权的保障,采取积极有效的政策和措施,从法律制度建设和政府行政效率提升入手,不断创新维权保障路径,增强安徽新生代农民工的政治认同。     

Rural Legal Aid in the Perspective of Human Rights: Status Quo and Reform

As one of the human rights protection systems for rural residents, legal aid is an important well-being project. It provides legal assistance to the rural population with regard to every aspect of the application of the law, and reflects the care and assistance given to rural residents. It is an important way to ensure the equal realization of legitimate rights and interests of rural residents, and it is also a powerful measure to promote the all-round development of the rural population. After more than 20 years of growth, China's rural legal aid work has achieved gratifying results. However, there are still outstanding problems such as unbalanced supply and demand, narrow scope, and tight funding. Therefore, we should build on the practice of rural legal aid to expand the number of aid teams, improve the quality of legal aid, broaden the scope of aid, and provide financial support so that rural legal aid can be truly visible, accessible, affordable and well performed.     

论在政协组织机构中设立妇女委员会的必要性和可行性

由于人民代表大会系统没有专门的妇女组织穴只在内务司法委员会中有一个妇女儿童小组雪,女代表在妇女权益保护方面的作用没有充分发挥出来,政协虽有妇女界别,但女委员在妇女权益保护方面的作用实际上很有限,而妇女联合会如缺乏人大、政协的支撑,工作力度很有限,因此有必要在政协组织机构中设立妇女委员会。因政协已有妇女界别,成立妇女组织并不会膨胀政协机构,而且我国高级领导层的“性别意识”有了很大的提高,所以在成立政协组织机构中设立妇女委员会具有可能性。妇女委员会的主要任务是积聚政协女委员的力量,共同关注妇女权益的保护。     

新农村建设中农民环境权益保护问题研究

切实保障农民环境权益,是社会主义新农村建设中的一项基础性课题。而受政府和企业短期化行为、环保资源投入不足、环境监管体制不顺、农村人口数量众多等因素的影响,目前我国农民环境权益经常得不到保障。本文提出,要切实加强农民环境权益的保障工作,必须打破二元结构、转变增长方式、加强政府干预、加强法治建设并完善农民参与渠道。     

浅析和谐社会中的妇女基本权利的刑法保护

我国法律对妇女合法权益的保护,与国际社会强调的对社会弱势群体权利保护的基本精神是一致的,而且在具体内容上更具体、更充分、更具有可行性。本文根据中国现行刑法典的有关规定,阐述当代中国构建和谐社会,对妇女的基本权利进行刑法保护的基本内容,注重运用刑罚的手段惩处和预防针对她们实施的犯罪行为,通过刑法保护妇女的基本人权。
