Seeing Human Rights from the Perspective of Development

The significance of including development in the spectrum of human rights lies in the fact that the notion of human rights is thus expanded to include the independence and economic and social development of the third world, instead of being limited to Western philosophical exploration and political experiments. Moreover, in practice, the right to development, as a newly added element of human rights, may correct the traditional idea in some states that the only version of human rights is political freedom, and those states failing to perform well in such freedoms should be criticized or even punished. When the human rights concept and system are examined from the perspective of development, more tolerance and cooperation may be expected in international politics, thus promoting the enrichment and improvement of the whole human rights system.

In a statement issued on the 2004 World Human Rights Day, Ms. Louse Arbour, United Nations High Commissioner for Human Rights, described human rights education as a strategy for attainment of "human rights for all," as a basic means for developing a universal culture of human rights, as an instrument for promoting equality and involvement of the people in decision-mak-ing under democratic mechanisms, and as an investment to prevent infringements upon human rights and to ward off conflicts of violence. It should be noted that so much importance attached by UN human rights organ to human rights education epitomizes the empowering characters of human rights education and the functions it performs in the global human rights system.

安全地权由相对权利强度、权利持有持续时间和权利保证性几方面所决定。农民地权常常是不安全的,与农村男性相比,妇女地权更不安全。妇女的土地产权不安全体现在家庭继承、村集体分配和市场交易等三种获得土地途径中。妇女土地产权的安全性一般意义上取决于,在土地产权交易不发达的情况下土地资源位置的固定性和妇女的婚姻流动性、集体土地产权拥挤性与妇女群体的弱势地位、以及影响村社土地制度安排的宏观因素及村社集体特征。     

人权保障视域中的侦查权控制问题探微

侦查权是与人权有着极大关联性的权力。以人权保障为价值取向,控制侦查权大体诉诸立法控制、分权制约、权利对抗和程序控制。本文梳理了西方法治国家在立法控制、分权制约和权利对抗方面控制侦查权的一些有益经验,并在比较的视野下从这三个方面对中国的相关制度安排进行了考量,指出其成就及存在的不足,最后就如何强化对侦查权的控制以保障人权提出了大致的思路。     

The Improvement of China's AIDS Notification System from the Perspective of Human Rights

China has established a two-level normative structure AIDS notification system with the AIDS Prevention and control Regulations as the core and local regulations as the supplement The problem is that the local legislations have different provisions with regard to the subject of notification and whether to adopt mandatory notification, which confronts the implementation of the AIDS notification system and the prevention of AIDS transmission with real difficulties The different attitudes of local legislations to the mandatory notification system for AIDS essentially reflects the dilemma of legislators in balancing the right to privacy of HIV-infected patients and the right to health of their sexual partners from the perspective of rights limitations, this paper aims to conducts interest balance analysis in the aspects of social urgency, public interest, substantive damage and the right to know of others and holds the view that when these two rights conflict with each other, priority should be given to the right to health of HIV-infected patients and their sexual partner as well as public health In terms of specific systems, the AIDS Prevention and control Regulations should establish a mandatory notification system and local legislation should take into consideration of local conditions to make specific provisions on issues of notification subject, notification procedures and confidentiality obligations after notification.

Rural Legal Aid in the Perspective of Human Rights: Status Quo and Reform

As one of the human rights protection systems for rural residents, legal aid is an important well-being project. It provides legal assistance to the rural population with regard to every aspect of the application of the law, and reflects the care and assistance given to rural residents. It is an important way to ensure the equal realization of legitimate rights and interests of rural residents, and it is also a powerful measure to promote the all-round development of the rural population. After more than 20 years of growth, China's rural legal aid work has achieved gratifying results. However, there are still outstanding problems such as unbalanced supply and demand, narrow scope, and tight funding. Therefore, we should build on the practice of rural legal aid to expand the number of aid teams, improve the quality of legal aid, broaden the scope of aid, and provide financial support so that rural legal aid can be truly visible, accessible, affordable and well performed.
