The Boren Amendment is frequently cited as an example where judicial involvement markedly shaped the implementation of federal legislation. Unlike other controversial health policies, Boren was eventually rescinded by Congress. Results indicate that the Amendment was repealed because changing socioeconomic, political, and programmatic conditions combined with policy‐oriented learning to facilitate a shift in policy venue away from the judiciary toward the President and Congress. This is because during the devolutionary climate of the mid‐to‐late 1990s, both the executive and legislature proved more conducive to the policy image promulgated by state officials that the Amendment unnecessarily restricted state discretion, than the policy image promulgated by providers that without the Amendment, low reimbursement levels would compromise access and quality. Data for this analysis derive from archival documents, secondary sources, and 101 interviews with state and federal experts.  相似文献

Punctuated equilibrium theory (PET) suggests that the policy process is characterized by long periods of incremental change and short periods of punctuated change. The impetus for the latter is usually a focusing event that breaks open policy monopolies, allowing for major changes in legislative decision making. While a burgeoning body of literature, a shortcoming in the PET literature is that it has yet to explain why focusing events and subsequent breakdowns in policy monopolies sometimes fail to result in punctuated policy. We integrate theories on cultural change with punctuated equilibrium to explain why focusing events do not always result in the dramatic policy changes that we might expect. Specifically, we use the context of national energy policy and the lexical database, Google Ngram Viewer, to trace punctuating energy‐related events and the occurrence or lack thereof subsequent policy change from 1952 to 2000.  相似文献

The actors, influences, and processes that combine forces to change policy subsystems are modeled in punctuated equilibrium theory wherein monopolistic policy subsystems are broken down through changes in policy images and venue shopping spurred by a critical mobilization of actors. Studying a case of policy change in Colorado water rights, this research examines multiple levels of policy change—local, state, and cross‐case. This research finds that at the state level, punctuated equilibrium theory accurately explains the process by which policies changed to allow for recreational in‐channel uses of water. At the local level, however, these processes are not clearly evident. Using media coverage as a proxy measure for agenda status also shows that policy image change and high public agenda status did not lead to these policy changes within Colorado communities. This article discusses whether we should therefore discount punctuated equilibrium as a model of policy change in this case.  相似文献

Supporters of open data believe that free and complete access to research data is beneficial for science, public policy, and society. In environmental science and policy, open data systems can enable relevant research and inform evidence‐based governmental decisions. This article examines the unlikely case of Brazil's National Institute for Space Research's transition toward an open data model. Considering Brazil's young democracy, incipient practice of government transparency and accountability, and lacking a tradition of science‐policy dialogue, this case is a striking example of how open data can support public debate by making information about forest cover widely available. The case shows the benefits and challenges of developing such open data systems, and highlights the various forms of accessibility involved in making data available to the public.  相似文献

In recent years the United Nations Environment Program, UN Conference on Environment and Development, and other international organizations have acknowledged the importance of civil society for engaging stakeholders in environmental change—especially at the local community level—and in promoting democracy. 1 In Russia, efforts by nongovernmental organizations (NGOs) to promote reform since 1991 have aimed at achieving both objectives and face numerous political, legal, and attitudinal hurdles. This article examines these hurdles and the factors that facilitate development of an environmentally conscious civil society in Russia through analysis of the views of 100 representatives of environmental NGOs, news media, scientific community, corporations, and public agencies. We also investigate three abbreviated but illustrative vignettes that illuminate civil society impediments. Our thesis is that successful efforts to ensure adequate protection of Russia's environment require a strengthening of civil society.  相似文献

Research initiatives to enhance knowledge‐based societies demand regionally coordinated policy approaches. By analyzing the case of the European Commission, Directorate‐General Research and Innovation, this study focuses on examining the cognitive mechanisms that form the foundation for institutional transformations and result in leadership positions in regional governance. Drawing on policy learning theories, the study emphasizes specific mechanisms of institutional change that are often less noticeable but can gradually lead to mobilizing diverse groups of stakeholders. Through historical and empirical data, this study shows the importance of policy learning through communication processes, Open Method of Coordination initiatives, and issue framing in creating a stronger foundation for policy coordination in European research policy since the 2000s.  相似文献

This article analyzes why and how the cabinet of Democratic Party of Japan (DPJ) decided in September 2012 to phase‐out nuclear power plants by 2039—the decision representing a large policy change from previous energy‐supply policy, in which the dependence on nuclear power would continuously grow. In doing so, this article examines the causal relationship between three factors identified on the basis of theoretical models explaining policy change; change in the governing coalition from the Liberal Democratic Party (LDP) to DPJ in 2009, the Fukushima accident, and the change in public opinion. Based on opinion poll and deliberative polling data, as well as discourse analyses of DPJ leaders’ statements, the article concludes that the change in public opinion on nuclear energy after the Fukushima accident was crucial in inducing the DPJ's decision to phase‐out nuclear power plants by affecting DPJ leaders' interests in vote‐ and office‐seeking. Finally, I discuss the applicability of the theoretical models developed on the basis of U.S. pluralistic cases to Japan and the issues to be explored for the further development of policy process models.  相似文献

In Central and Eastern Europe, we can observe and analyze an ongoing social experiment euphemized as the process of the transformation of totalitarian countries with centrally planned economies into democratic countries with market economies. This article offers an analysis of what has been happening in the Czech Republic in this regard. Attention is given to the impact of political philosophies (those represented by names of Václav Havel and Václav Klaus) upon legal and institutional changes. Key terms for better understanding of these processes are the free market, civil society, civic sector, and participation of citizens in public affairs. Research on climate change policy and politics has become increasingly focused on the actions and influence of subnational governments. In North America, this attention has been particularly focused on why subnational governments have taken action in the absence of national leadership, what effect action might have on future national climate policy, and whether the collective action of networks of municipal governments are reshaping and challenging the character of national and global climate governance. This paper examines Canadian municipal climate in light of the absence of a comprehensive and effective climate national strategy. The paper considers various reasons why local governments in Canada have not been central players in national plans, and why their actions have not been more influential nationally. The paper argues that the potential influence of Canadian municipalities on national climate policy is weak, given the loose nature of the network and the long-held structural view that municipalities are not significant units of political analysis in national political and policy debates. The paper concludes by considering the constraints and opportunities of subnational climate networks and municipal network analysis.  相似文献

There is a growing need to develop health‐related indicators for climate change to assist in policy, planning, and evaluation of preventive measures. To date, no environmental health indicators of climate change have been developed specifically for Australia. We conducted a review of the Australian literature relevant to climate change health impacts to find out which exposure–response relationships could be readily used as indicators. The bulk of the literature relates to direct health‐related outcomes of extreme heat, and indirect outcomes associated with air pollution and infectious disease agents. Based on this information, evidence‐based indicators were chosen using the modified Driving force‐Pressure‐State‐Exposure‐Effect‐Action framework. Three groups of health outcome indicators are proposed: direct heat related, air pollution related, and climate‐sensitive infectious diseases. Indicators of human vulnerability to these outcomes are also included. The potential usefulness of and barriers to their use are discussed in the context of relevance for policy makers.  相似文献

The policy learning literature indicates that governments can and do learn after a policy failure but not always. The purpose of this study is to examine the conditions under which policy failure leads to policy learning. It asks two questions. First, is policy failure associated with policy learning? Second, if policy is associated with policy learning, does the failure initiate different types of learning? Using the policy failure and learning literatures as an organizing framework, this paper analyzes three comparative cases of policy failure revealed by tornados in Greensburg, Kansas (2007); Joplin, Missouri (2011); and Moore, Oklahoma (2013). It finds that failure of the policy process in agenda setting is associated with instrumental policy learning. It also finds that there are two types of failure of decision making: failure to make a timely decision and failure to make any decision. The two types of decision‐making failure are associated with different types of policy learning. In addition, the contextual factors underpinning the link between policy failure and learning are prior experience with the policy problem and capacity to learn.  相似文献

Many of the leading theories of the policy process are aimed at providing insights into the factors that make policy change more (or less) likely. In general, policy change is seen as a result of shifting dynamics within policy subsystems. However, building on theories of policy feedback and interest mobilization, this article examines whether policy change, apart from being an effect of subsystem dynamics, can be a cause of shifting dynamics as latent actors are motivated to participate in the subsystem as a result of policy change. Two hypotheses regarding post‐policy change mobilization are developed and tested using data on participation in congressional hearings concerning the management of nuclear waste. The findings suggest that policy change can activate latent policy actors, specifically those actors that view themselves as “losing” as a result of the policy change. These results point to the need for scholars to examine the potential impacts of post‐policy change dynamics on policy development.  相似文献

This study examines the factors that explain public preferences for a set of climate change policy alternatives. While scholarly work indicates a relationship between attitudes and values on views toward specific issues, the literature often examines general support for issues rather than specific policy proposals. Consequently, it is unclear the extent to which these attitudes and values affect specific policy considerations. This project examines public support for five climate change policy options in two national surveys taken three years apart. The empirical analysis reveals that time is a factor and that those who are liberal, have strong ecological values, report greater concern for climate change, and trust experts are consistently more supportive of the climate policy options considered here. The results shed new light on the nuanced views of the American public toward climate change.  相似文献

The study of policy narratives is challenged by inconsistencies and a need for more precise definitions and measurements. The goals of this article are to build precision and clarity in the study of policy narratives by developing a network‐based approach—the ego‐alter dyad—for coding characters and their interactions around a policy issue and then to illustrate this approach in the analysis of air and climate issues in Delhi, India. The empirical results show that (1) the same actors are often heroes and villains, (2) heroes and villains are associated with different actions but with similar victims or beneficiaries, (3) narrators differ in their propensity to tell hero‐heavy or villain‐heavy policy narratives, and (4) the proportion of hero‐heavy or villain‐heavy policy narratives changes over time and differs across subtopics. The article concludes with a research agenda for further theoretical and methodological advancement in studying policy narratives.  相似文献

The American states are engaged in a variety of policy efforts to mitigate climate change and alter energy usage. While a number of studies have considered the reasons for adoption of renewable energy and climate change policies, they typically consider only one policy in isolation. This study examines policy adoption of 14 energy and climate change programs in a pooled event history analysis. Our primary research questions consider average effects of horizontal policy diffusion, while also identifying factors that vary across policy type. We offer a method of testing whether predictors vary across policies and use this test to incorporate interactions by policy in the statistical analysis. Our results indicate that many of the primary drivers of adoption are political in nature, including state ideology, environmental interest group membership, and diffusion via ideologically similar neighbors. In addition, we find that given policy heterogeneity, a number of determinants vary by policy type, though differences are in magnitude rather than direction.  相似文献

The September 11 attacks triggered federal policy changes designed to influence emergency management in the United States, even though these attacks did not suggest a need for a wholesale restructuring of federal policy in emergency management. Instead, for several reasons, federal policy's emphasis on terrorism and emergency management significantly degraded the nation's ability to address natural disasters. The federal government sought to create a top‐down, command and control model of emergency management that never fully accounted for, positively or normatively, the way local emergency management works in practice. The Obama administration will have to address the questions raised by the reorganization of federal emergency management responsibilities. While the context in which these changes have occurred is unique to the U.S. federal system, there are interesting implications for emergency management in nonfederal systems.  相似文献

Technological innovations are by no means Pareto‐improving. I build on the argument that incumbent innovators can use political means to block rival innovations by emphasizing that the competitiveness of political system and some political institutions may diminish their ability to do so. I specify an institutional mechanism of agenda power, which provides newcomers with an improved ability to enter the game. The number of agenda power holders varies significantly among political systems, electoral systems, and administrative structures. With a sample of about 100 countries and across 20 years I show that politically competitive regimes, majoritarian electoral rules, and federal structures supply more holders of agenda power in comparison to their counterparts and, other things being equal, produce more innovations.  相似文献

There is a curious disjunction between the Labour Government's international actions and its domestic policy. Although Tony Blair did much to promote the climate change agenda on the international stage, domestically, with carbon emissions rising again, the Government will fail to meet its target of reducing carbon dioxide emissions by 20% below 1990 levels by 2010. This article examines the weaknesses in the Labour Government's domestic record and assesses the significance of the recent transformation of climate change politics. Several obstacles to the design and delivery of more effective policies are identified, which can be categorised as either problems of ‘environmental politics’ or ‘environmental governance’. It is argued that the recent politicisation of climate change has overcome some of these obstacles ‐ albeit temporarily ‐ but whether the pressure for further policy measures can be sustained, with a long‐term impact on environmental governance, remains uncertain.  相似文献

With the growing importance of public engagement in science policy making and declining levels of public trust in food production, the European Food Safety Authority (EFSA) has attempted to embed “good governance” approaches to strengthen scientific independence and open up risk decision making, which include the use of public consultations. However, “opening up” of risk assessment policies reveals some tensions; namely, balancing the goals of scientific excellence and transparency, protecting science from interests, addressing value judgments, and limited opportunities to debate ethical and social issues. EFSA's development of risk assessment policy for genetically modified animals is used as a case study to analyze these tensions. This analysis suggests that in order to fulfill good governance commitments and maintain trust in risk governance, closer cooperation between EFSA and the European Commission is required to provide “space” for debating the broader risk management issues. This publically accessible space may be needed alongside rather than instead of EFSA's consultation.  相似文献
