司法行为及其选择的文化注释——以转型司法中的中国法官为例

转型司法中的中国法官,其司法行为不仅会受当下中国特定的社会--文化情境的影响,而且还更多地要受到一种"清官文化"的因素制约;也即在公共的法律生活中,其任何司法行为的做出,除了回应特定的社会--文化情境系统的要求之外,也更反映出了法官对自身名誉的特别爱惜以及对社会评价的特别注意,同时也是为了尽可能好地完成司法任务并尽可能少的给自己惹麻烦.正是在"清官文化"这一文化容器中,不仅社会--文化的情境性因素作用到了法官的身上,而且,也正是在这一文化的信仰网络里,达致了纠纷中的民众以及其他社会力量对于法官角色期待的均衡.     

Cultural relativism and comparative criminology

The recent spate of comparative studies of crime is long overdue as a potential palliative to the traditional ethnocentrism of American criminology. But their comparative method is uncritically taken from two incompatible propositions derived from Durkheimian empiricism. As such, the generalizations about criminal behavior that these studies advance should be treated more with caution than optimism. This essay discusses the alleged advances over Durkheimian empiricism made by two distinct forms of cultural relativism. If what every man believes as a result of perception is indeed to be true for him; if, just as no one is to be a better judge of what another experiences, so no one is better entitled to consider what another thinks is true or false... then, my friend, where is the wisdom of Protagoras, to justify his setting up to teach others and to be handsomely paid for it? Cultural explanation and organizational crime

Both the number and influence of organizations increased dramatically during the 20^th century, which helps explain why the problem of organizational crime has received attention from investigators. Growing interest in organizational and corporate crime has been matched by interest in organizational culture. Variation in organizational culture is employed to explain many aspects of organizational performance, from effectivenessin goal attainment to criminal conduct. There are reasons, however, to be critical of theoretical constructions and empirical investigations of organizational culture. There is both considerable ambiguity about its meaning and an implicit assumption of intra-organizational cultural uniformity. Cultural explanations were developed principally in case studies, empirical analyses are flawed, and supportive post hoc interpretations ofinteresting or enigmatic findings are commonplace. The influence of hierarchy and agency as constraints on organizational culture has received insufficient attention. We interpret the appeal of organizational culture despite the absence of demonstrated predictive value, and we call for additional research on sources of variation in organizational crime.     

Neighborhood Cultural Heterogeneity and Adolescent Violence

A small number of scholars have attempted to reorient current thinking about the way cultural effects operate in poor neighborhoods. Scholars argue that socioeconomic disadvantage fosters heterogeneity in cultural models. Moreover, cultural heterogeneity theoretically plays an important role in shaping adolescent decision-making in poor neighborhoods, including decisions related to violent behavior. We test these assumptions using multilevel data comprised of a sample of African-American adolescents. Our findings lend support to these arguments. In particular, the results suggested that neighborhood structural disadvantage increases the degree of disagreement or heterogeneity regarding the inappropriateness of violence. Further, exposure to cultural heterogeneity increased adolescents?? involvement in violent behavior and had a moderating influence on the link between individual frames and adolescent violent behavior.
