患者家属同意与医方紧急救治

患者家属代为行使知情权的主要目的是保护患者权益,但由于现行法律规定的不足,该制度的实施面临法律困境,尤其是在患者病情处于紧急救治状态,患者家属意见与医方意见不同时,患者家属的行为选择是否应该受到限制一直存在着理论争议。本文通过对我国目前患者家属知情同意与医方紧急救治存在的问题进行分析,就化解两者冲突提出相应建议。
