Previous research has shown that many forms of strain are positively related to delinquency. Evidence also suggests that religiosity buffers the effects of strain on offending, but this issue requires further research. Using data from a national sample of adolescents, this study examined whether or not religiosity conditioned the relationship between strain and delinquency. This study also looked at the ability of social support, self-esteem, and depression to moderate the influence of strain on delinquent behavior. The findings here lend support to general strain theory in that strain had a direct positive effect on delinquency, yet there was little evidence that the relationship was moderated by religiosity or other conditioning variables. The roles of moderating variables on strain across genders were also considered.  相似文献

Purpose. Children's inconsistencies when answering repeated questions about past events are a source of concern in forensic, educational, and other contexts. Theoretical accounts of these inconsistencies have predominantly assumed that children shift because they infer adult dissatisfaction with their initial answer. This study aimed to test this account via examination of the effects of question format on shifting, as well as via direct questioning of children. Method. Four‐, five‐, and seven‐year‐olds (N = 226) were asked 17 recall questions about a recent classroom activity, with eight target questions repeated in one of four formats: no‐correct (mildly misleading questions to which the correct answer was ‘no’), yes‐correct (mildly misleading questions to which the correct answer was ‘yes’), specific open wh‐ questions, and forced‐choice questions. They were then asked about the adult's reasons for repetition. Accuracy, shifting, and interpretations of question repetition were examined. Results. Shifting from accuracy decreased with age, and was affected by question format in 4‐year‐olds only, who shifted more to no‐correct than to forced‐choice questions. Shifting towards accuracy was more common in forced‐choice questions than either no‐correct or open questions, but there were no significant age differences. First‐answer‐unsatisfactory interpretations of question repetition were rare, especially in the two younger groups. The oldest group offered a wider range of interpretations and also showed some evidence of an association between first‐answer‐unsatisfactory interpretations and shifting. Conclusions. Overall, our findings present a challenge to first‐answer‐unsatisfactory explanations of young children's shifting in recall settings, at least where overt pressure to shift is low. Forensic implications are considered.  相似文献

This study examined children's accuracy in response to truth-lie competency questions asked in court. The participants included 164 child witnesses in criminal child sexual abuse cases tried in Los Angeles County over a 5-year period (1997-2001) and 154 child witnesses quoted in the U.S. state and federal appellate cases over a 35-year period (1974-2008). The results revealed that judges virtually never found children incompetent to testify, but children exhibited substantial variability in their performance based on question-type. Definition questions, about the meaning of the truth and lies, were the most difficult largely due to errors in response to "Do you know" questions. Questions about the consequences of lying were more difficult than questions evaluating the morality of lying. Children exhibited high rates of error in response to questions about whether they had ever told a lie. Attorneys rarely asked children hypothetical questions in a form that has been found to facilitate performance. Defense attorneys asked a higher proportion of the more difficult question types than prosecutors. The findings suggest that children's truth-lie competency is underestimated by courtroom questioning and support growing doubts about the utility of the competency requirements.  相似文献

Research suggests that jurors misunderstand the presumption of innocence. However, past studies have not asked participants to estimate the defendant’s probability of guilt, setting aside the fact of charge and indictment. We conduct two studies to explore the impact of this question wording on estimates of the probability of guilt/innocence by jury-eligible Mturk workers. In Experiment 1 (N?=?275), question wording (legal, factual and ambiguous) was varied within participants and revealed significantly higher estimates of innocence in response to the legal than the factual or ambiguously worded question. In Experiment 2 (N?=?303), question wording was manipulated between participants both before (prior) and after (posterior) the presentation of evidence. Prior estimates of guilt were significantly lower in the legal than factual or ambiguous conditions. Question wording also predicted posteriors, and these in turn predicted verdicts. These results suggest that imprecise wording may have contributed to concerns about jurors’ understanding of the presumption of innocence, highlighting the need for further research. There has been a substantial increase in the number of mass shooting incidents on college campuses in the United States in recent years. Although empirical research examined the impacts of secondary school shootings on student fear, there have been no comparable studies of the impacts of campus shootings. This study began to fill this void by examining responses to surveys administered to convenience samples of students enrolled at the University of South Carolina prior to and following the mass shooting incidents on the campuses of Virginia Tech and Northern Illinois University. Findings indicated that both shootings were associated with modest increases in various measures of fear. Other findings were that the impacts of the shootings depended on both the type of fear measured (e.g., general fear versus fear of being a victim of specific crimes) and student characteristics such as age, sex, and race.  相似文献

Children's memory reports are often sparse, which increases the need for efficient interview methods. The present study investigated whether odour reinstatement can aid children's memory and increase the amount of information recalled from an experienced event. Children (N = 106, mean age 10 years, 8 months) experienced a magic show where a vanilla odour was present and were interviewed about their memory of the event either one week, or six months, after the magic show. During the interview, half of the children re-experienced the same vanilla odour. In contrast to studies on adult participants, no odour-reinstatement effect was found with the child participants in the present study. On the other hand, odour reinstatement reduced the children's ratings of how strong their emotions were during the event. Thus, odour reinstatement may affect different forensically relevant factors, and this should be considered in future research.  相似文献

Opposition to abortion is based in part on the assumption that personhood is achieved at or shortly after fertilization of the egg. This interpretation of personhood arises from a contemporary application of the ancient doctrine of preformationism, a doctrine which holds that there is a preformed individual, in an ontological sense, within the developing entity. The assumption that the fertilized egg is unique in its capacity to develop into a human being is at least in part responsible for the opinions of those opposed to abortion. Yet, the uniqueness of the zygote in its capacity to develop into an adult organism is qualified by the discovery that development may be possible in a number of other ways. Consideration of the phenomena of cloning, parthenogenesis and chimerism can relieve moral ambiguity about abortion and may reduce opposition to that practice.  相似文献

Orphan drugs, essential for the treatment of persons with rare diseases, generally are unprofitable for manufacturers to develop and market. While congressional and administrative efforts to promote the development of orphan drugs have met with modest success, application of products liability doctrine to orphan drug sponsors could subvert those efforts. This Note describes the provisions of the Orphan Drug Act and analyzes products liability law with respect to orphan drug litigation. It argues that the goals of tort law support the imposition of liability for design defect, failure to warn and negligence in testing. Finally, the Note acknowledges that liability costs create disincentives for orphan drug development and suggests mechanisms for reducing manufacturers' liability concerns.  相似文献

Findings for recent data (circa 1970) are consistent with previous purported tests of the deterrence doctrine. For each of seven types of crime there is an inverse relation among the states of the U.S. between the rate and the certainty of imprisonment, but there is no significant relation between the rate and severity of imprisonment (length of sentence served). Although the findings justify reconsideration of the deterrence doctrine, the utility of further tests is questionable without first restating the doctrine as a systematic theory, one that incorporates (inter alia) perceptual variables pertaining to punishment (e.g. perceived certainty of punishment). However, several empirical question should be contemplated prior to stating a deterrence theory; and conventional data (e.g. published statistics on imprisonment) can be used to answer some of those questions.  相似文献

Purpose. In police interviews children may be asked the same question many times. We investigated how the number of repetitions and the interval between those repetitions affected the accuracy and consistency of children's responses. Methods. 156 children aged 4–9 years watched a staged event and were interviewed individually 1 week later. Children were asked eight open‐ended questions, which were each repeated a further four times (making a total of forty questions). Half these open‐ended questions could be answered from information in the event, and half were unanswerable (so children should have said ‘don't know’ in response to these questions). The questions were repeated in gist form. The interval between an initial question and its repetitions was varied by use of other questions and twenty non‐repeated filler questions. The intervals between repetitions were immediate repetition, repetition after a delay of three intervening questions, after a delay of six intervening questions, and after ten or more intervening questions. Results. Over a quarter of children's responses to repeated questions changed, usually resulting in a decline in accuracy, particularly after the first repetition. Subsequently, the number of repetitions and delay interval had little effect on responses to answerable questions although accuracy to unanswerable questions continued to decline. Conclusions. Question repetition had a negative affect on children's consistency and accuracy. For unanswerable questions in particular, the more often a question was repeated the more likely children were to invent a response.  相似文献

Every society has within it some individuals and groups who are successful and some who are less successful. Explanations for these differences range from the political to the economic and from the cultural to the religious. For American conservatives, the differences in individual levels of achievement can be explained primarily in cultural terms. The conservative mythology argues that there are clearly superior and clearly inferior cultural values and that good values produce successful individuals. This article deals with the fundamentally tautological nature of this argument: Why is so-and-so successful? Because he or she has better values. How do we know he or she has better values? Because he or she is successful. After elaborating this intellectual problem, an empirical test is made of the existence of different values among America's social groups. Using census data and national survey data, the personal goals and attitudes of various societal groups and their relative economic accomplishments are presented and compared. This analysis demonstrates that few of the culture-based differences which are asserted by conservatives can be validated empirically.  相似文献
