Transnational corruption has in recent years been elevated toan international offence but in practical terms it is not consideredserious enough in order for heads of state or cabinet membersto be prosecuted in foreign jurisdictions. There is evidenceto suggest that, in certain cases, corruption may take the formof a crime against humanity. This possibility extends significantlythe jurisdictional ambit of national courts and empowers theInternational Criminal Court to consider a case. Moreover, therestorative component of such criminal prosecutions should aimat restoring, through civil mechanisms, the funds illegallyappropriated to their rightful recipients, the defrauded localpopulations, under the principle of self-determination.  相似文献

This paper offers some reflections on how to develop more effective policies against crime, drawing on more than 10 years of research experience on the international drug problem. The paper begins by trying to illustrate the so-called justice gap in the world, and explain why an institution such as the United Nations has a comparative advantage in closing that gap. It then details four lessons that the author has learnt from his own personal experience as head of research in the United Nations International Drug Control Programme, now called the United Nations Office on Drugs and Crime: (i) measure, count, and keep counting; (ii) publish or perish, either in inter-governmental default, or in public hysteria; (iii) limit the dangers of committing the euphemistic fallacy; and (iv) divorce research and policy, because research is policy-dependent; make research policy-relevant, and re-marry it to policy. Finally, the paper tries to show how these lessons can be applied in related areas and used as good practice in research on crime.  相似文献

当前,国际恐怖活动遍及全球,国际恐怖主义犯罪急剧增加,严重威胁着国际和平与安全。危害国际航空安全犯罪是最为严重的国际恐怖主义犯罪。国际法上规定危害国际航空安全犯罪这一类犯罪的国际条约主要有四个,据此,对该罪进行分类并确定罪名:劫持航空器罪、危害航空器飞行安全罪和破坏国际航空机场安全罪。国际条约确立了对该罪的普遍管辖权并处以严厉刑罚,排除了“政治犯不引渡原则”的适用。我国在保护国际航空安全的刑法实践中,我国民用航空法详细规定了劫持航空器和危害国际航空运输安全的行为方式,并规定对这些行为追究刑事责任。我国1997年刑法具体规定了危害国际航空安全犯罪的罪名及其刑事责任。  相似文献

基于国际社会面对"国家犯罪"与国家刑事责任的争论,简要介绍政府犯罪观念产生的背景、初步概念、独立性及政府刑事责任双罚制;着重分析政府犯罪与国家犯罪的关系;得出尽管政府在国家不法行为和国际犯罪中扮演重要的角色,但政府犯罪不能完全等同于国家犯罪这一结论.在现有的国家责任体系中,建立政府刑事责任制度,具有法理和实践层面的可行性,符合国际社会现实状况.  相似文献

Many American based motorcycle clubs have evolved into biker gangs involved in organized crime nationally and internationally. Using the information contained on the national websites of seven biker gangs—Hells Angels, Outlaws, Bandidos, Mongols, Warlocks, Sons of Silence and the Vagos, this article provides a listing of the gangs by chapter in the United States and internationally. These gangs have exported organized crime to the world as they have formed criminal networks with new chapters established outside the Continental United States.  相似文献

俄罗斯联邦刑事政策指导刑事立法,反映国家的犯罪态势和预防犯罪的对策。随着经济全球化,刑事立法也被置于国际大背景中。侵害宪法制度基本原则和国家安全的犯罪较为典型地诠释了俄罗斯当前人道主义导向的刑事政策和刑法保护价值观的调整,突出了俄联邦刑事立法上法网严密、刑罚宽缓的特点,符合国际上预防犯罪和改造罪犯的目的。刑事政策是社会历史发展的产物,是社会政策的一部分,其新旧更迭变化和发展也必然符合历史规律和社会进步的需要。  相似文献

In this article the author estimates the relative influences of the four broad social institutions of education, politics, family, and economy, plus the process of modernization upon proportionate female crime by using international data for 1974 derived from Interpol statistics. Each of the institutions is operationalized into three empirical indices, as is modernization, using data from the Handbook of International Data on Women. Then these 15 independent variables are intercorrelated with 7 specific categories of female offenses plus total female crime, each rendered in proportionate form as a ratio of female crime to all crime detected by the police in each category. The correlational analysis is constructed so as to constitute a test of three competing theories of female crime: the violence-prone “new female criminal,” the theory of economic need, and economc opportunity theory. The data provide only weak support for the theory of the “new female criminal,” but considerably stronger support for both the economic need and economic opportunity theories. It is not possible to choose unambiguously between the need and opportunity theories with the evidence at hand.  相似文献

This article explains the development of international crime as a legal category. I argue that states’ pursuit of political rights claims empowers international lawyers to develop new legal categories to grant states new tools to pursue their interests. At the same time, lawyers have a stake in defending the autonomy of law from politics, thus pushing for the development of legal norms and institutions that go beyond the original state intent. States’ turn to law thus begets more law, expanding the legal and institutional tools to solve international problems while simultaneously enforcing a commitment to principles of legality. To demonstrate the plausibility of the theory, the article studies the construction of the concept of an international crime in the interwar period (1919–1939). In response to the Allies’ attempt to prosecute the German Emperor, international lawyers sought the codification of international criminal law and drafted enforcement mechanisms. The interwar legal debate not only introduced international crime into the legal and political vocabulary, it also legitimized a new set of institutional responses to violations of international law, namely, international criminal prosecution.  相似文献
