实际恶意下网络言论之刑法界限——基于“网课爆破”事件的分析

分散主体的语言攻击在开放性的互联网场域中聚合,异化为足以侵害法益的语言暴力。由于网络言论自由之刑法界限模糊,损害结果的责任主体难以定位,传统罪名在诸如“网课爆破”事件上存在虚置风险,其根基是主观入罪条件的瑕疵以及法益的过度抽象化。对此,应当以“实际恶意”补强主观入罪条件,视个体法益为刑法所保护的对象,弥合社会危害性与需罚性之间的间隙。同时,应厘清组织者、参与者及中间服务商(ISP)的地位,合理分配三方刑事责任,于各个环节全面遏止网络语言暴力犯罪。     

如何提高上网效率(一)

1．更新电话线路。电话线路关系到Modem的数据传输是否畅通，一条陈旧、破损、氧化的电话线路会给数据传输的准确快速带来极大的阻碍。虽然室外电话线路无法自行更换，但可以考虑室内段的线路更新。当你拿起电话听筒，听到有沙沙声或者声音沉闷不清，就说明电话线路受损严重，可以拨打112（邮电局电话报障台）让邮电局解决。2．选择优秀的ISP服务商。由于各家ISP连接因特网专线的带宽不同，所以接入服务的质量也大有差异。另外，各个ISP主机处理速度的快慢也导致了这一问题，一般ISP采用UNIX系统最为理想，也有使用网络服务器和PC机…

我国ISP版权侵权责任的立法现状与立法建议

在所有关于网络版权侵权的法律问题中,网络服务商的版权侵权责任问题是国内外争论最激烈,立法进程最快的一个方面。笔者提出了应当对中国现行著作权法进行修改与完善以增加网络服务商版权侵权责任的建议。同时,也具体地提出了在著作权法中应当明确规定网络内容提供者与在线服务商适用不同的归责原则、著作权法中应当明确规定在线服务商享受责任限制待遇的资格、条件、规定OSP负有协助版权人查找直接侵权行为人的义务等几点的具体的立法建议。     

网络“涉众型”经济犯罪司法难题对策研究

孟传香在《重庆邮电大学学报》（社会科学版）2012年第4期撰文认为，“网络涉众型”经济犯罪包括对象型和工具型两种类型。破解“网络涉众型”经济犯罪的司法难题，要严格依法取证固证，实现网络证据与现实证据以及传统取证方法与非传统方法两结合，利用高科技破解传统取证技术锁定犯罪证据及嫌疑人，利用金融系统的反洗钱网络，构筑“网络涉众型”经济犯罪预警机制，以“侵害关联性”原则对属地管辖原则中的犯罪地加以限制，从实质上对素未谋面的犯罪分子是否构成犯罪集团进行认定，运用间接证据印证多笔小额诈骗数额，区别不同情况追究网络服务商的不作为刑事责任。     

网络服务商在博客侵权中的责任认定——兼谈网络服务商的免责事由

博客侵权是近几年随着博客这种新兴的传播形式的发展而出现的一种新的侵权现象。在博客侵权案件中,网络服务商扮演中介者的角色,因此,在责任的认定上,网络服务商应承担过错责任。另外,网络服务商还应有消极审查义务适当履行的免责、受害者无法举证网络服务商"明知"侵权信息没有采取措施的免责、受害者权利受到侵害而没向网络服务商提出救济的免责等免责事由。
