Gender disparity in sentencing outcomes has been well established in literature. Recent research has increasingly paid attention to social contexts within which judicial decision-making occurs. This study combines these two lines of research by dissecting the nature of gender disparity through ecological lenses. Using 2008–2010 federal sentencing data, we examine the roles of religious and political conservatism in affecting gender-based sentencing disparity. We find that religious and political conservatism reduces gender disparity, with the female discount dissipating in court communities with higher levels of religious and political conservatism. We also find that the conditioning effects of both religious conservatism and political conservatism on gender disparity further interact with race, with black female defendants more likely to be influenced by religious and political conservatism than their white counterparts. Overall, this study contributes to sentencing literature by demonstrating that gender disparity is deeply entrenched in the ecological contexts of court communities.  相似文献

This article addresses movements in Germany towards greater uniformity in sentencing since the entry into force of the first federal criminal code in 1871, with a particular focus on developments since the second half of the twentieth century. The author reviews the empirical evidence for sentence disparity; addresses the limitations of the constitutional principle of equality as a means for overcoming sentencing disparity; identifies the causes of sentence disparity and tracks practical efforts made to overcome that disparity, specifically through the introduction of prosecutorial guidelines and judicial manuals for certain frequent types of offending. He also explains and critiques different theoretical models for increasing sentencing equality, and reviews the advantages and potential uses of sentencing information systems such as a judgment database created in Japan. The author then turns to the contribution made by the appellate courts to greater uniformity in sentencing and expresses the hope that recent trends towards intensified guidance for trial courts in appeals concerning tax offences will be extended to other types of offences as well.  相似文献

Federal sentencing guidelines were enacted to reduce unwarranted disparities in sentencing. In this paper we examine the degree to which disparity in sentencing on the basis of race and ethnicity occurred in federal sentencing after the guidelines were implemented. We consider how much of the disparity is explained by offense-related factors as specified in the guidelines. We find that African Americans, Hispanics, and Native Americans receive relatively harsher sentences than whites and that these differentials are only partly explained by offense-related characteristics. We interpret our findings in light of attribution, uncertainty avoidance, and conflict theories.  相似文献

One of the important goals of the federal sentencing guidelines was to reduce inter‐judge disparity in sentencing. In this paper, we test the assumption that structuring discretion produced uniformity in federal sentencing and consistency in the process by which judges arrive at the appropriate sentence. We also examine whether background characteristics of judges affect the sentences they impose on similarly situated offenders. We used hierarchical linear modeling, nesting the offenders in the judges that sentenced them in order to examine the sentencing decisions of federal judges in three U.S. District Courts. While we found that significant variation between judges in sentencing is largely accounted for by our level 1 characteristics, we also found that judges arrive at decisions regarding the appropriate sentence in different ways, by attaching differential weights to several of the legally relevant case characteristics and legally irrelevant offender characteristics.  相似文献

Legal reform sometimes has unanticipated, even ironic, results. A good example is federal legislation adopted in the 1980s that was supposed to enhance equity in sentencing. Congress, like many state legislatures in this period, reduced judicial control over sentencing by adopting presumptive sentencing guidelines for all serious criminal offenses and mandatory sentences for some specific crimes. Reformers did succeed in reducing judicial discretion in the sentencing process, but racial disparities have gotten much worse. Unprecedented numbers of minorities, particularly black men, are going to jail for long terms. The situation leaves trial judges in a difficult position. They are legally bound to implement a sentencing regime that many of them believe is racially discriminatory. Herbert Jacob's work on criminal trial courts provides a framework for investigating this problem. As Jacob's organizational approach predicts, judges were initially more troubled by the diminution of their powers than by the emerging pattern of increased minority incarceration. Nevertheless, some judges have criticized the racial implications of the sentencing law, protesting in various, resourceful ways. Judicial resistance to a law on moral grounds, though rare, is significant because it represents a break in the ranks of officialdom that enhances the moral credibility of critics of the current law.  相似文献

Recently there has been a call for research that explores decision‐making at stages prior to sentencing in the criminal justice process. Particularly research is needed under a determinate sentencing system where judicial dispositions are usually restricted by guidelines, which increases the importance of earlier decision‐making stages. As an answer to this call, and in an attempt to build on currents studies on the effects of departures as an intervening mechanism, and a source of unwarranted disparity, this study explores federal sentencing data on offenders convicted of crack‐cocaine and powder‐cocaine offenses. Although decision‐making of all criminal justice actors generally, and prosecutors specifically, has been the subject of much research, studies have yet to resolve the nature and outcome of their “autonomous” discretion. This autonomy becomes especially salient regarding prosecutorial decisions for substantial assistance departures. In deciding who receives a substantial assistance departure, the prosecutor has carte blanche power.  相似文献

This paper reports the results of an analysis of judicial disparity in the sentencing of persons represented by legal-aid lawyers. Because the socioeconomic characteristics of legal-aid clients are fairly uniform, the analysis of such cases made it possible to explore the influence of case facts, system factors, and the judicial disparity of the sentences given in relatively similar situations. The analysis finds that case facts and offender characteristics, particularly prior record, are good predictors of sentence type and excellent predictors of sentence length. While there was some indication of judicial inconsistency in sentence-type decisions, that is, unexplained variation from case to case, there was little indication of strong individual judicial bias across the cases used in the analysis.  相似文献

Although studies of sentencing routinely find that defendants who plead guilty receive relatively lenient sentences compared with similarly situated defendants convicted by trial, we have yet to fully understand the role of “mode of conviction” in the sentencing process. In particular, we know little about how the size of the disparity between guilty pleas and trial convictions may depend upon time in case processing, or the timing of pleas; that is, when during the process defendants plead guilty. This is a considerable issue, as “time” often is central to explanations given for plea-trial disparities. The current study examines this central, yet seldom empirically captured, dimension of the sentencing process. Using information gathered in an ancillary data collection effort operated under the supervision of the American Terrorism Study, we differentiate between the mode of conviction and time to conviction and explore the role of “time” in sentence severity, especially with regard to the plea-trial disparity. While consisting of defendants identified in connection with terrorism investigations, and sentenced in federal courts, our study takes advantages of a unique opportunity to isolate the effects of time from the mode of disposition and to explore time correlates of sentencing outcomes. In doing so, we raise important questions about the multiple ways in which time and mode of conviction may affect sentencing more generally and contribute to the larger theoretical discussions of how punishment decisions are made.  相似文献

The US Sentencing Guidelines are among the most ambitious attempts in history to control sentencing discretion. However, a major sea change occurred in January of 2005, when the US Supreme Court ruled in United States v. Booker and Fanfan, that in order to be constitutional, the federal guidelines must be advisory rather than presumptive. The impact of the Booker/Fanfan decisions on interjurisdictional variation and sentencing disparity is an opportunity to examine the issue of whether the increased opportunity to sentence according to substantively rational criteria entails increased extralegal disparity. We draw on a conceptualization of courts as communities and a focal concerns model of sentencing decisions to frame expectations about federal sentencing in the wake of Booker/Fanfan. We test these expectations using USSC data on federal sentencing outcomes from four time periods: prior to the 2003 PROTECT Act, the period governed by the PROTECT Act, post-Booker/Fanfan, and post-Gall v US. In general, we find that extralegal disparity and between-district variation in the effects of extralegal factors on sentencing have not increased post-Booker and Gall. We conclude that allowing judges greater freedom to exercise substantive rationality does not necessarily result in increased extralegal disparity.  相似文献

Using an interrupted time-series design, this research note analyzes the long-term effect of Minnesota's sentencing guidelines on reducing unwarranted disparity in sentencing outcomes that fall within their scope of authority. Unwarranted disparity is defined as residual variation not attributable to legally mandated sentencing factors. Findings suggest that although the sentencing guidelines initially reduced disparity for the no prison/prison sentencing decision, inequality began to revert to preguideline levels as time passed. Further analysis revealed that the guidelines had a permanent impact on reducing disparities in decisions on the length of prison sentence. Overall we observed an 18% decline in disparity for the no prison/prison outcome and a 60% reduction in inequality for the judicial decision as to length of prison sentence. Two explanations for the reversionary trend in the no prison/prison series are highlighted.  相似文献

Grid based sentencing guidelines, composed of offense seriousness and offender criminal history axis, have become a staple of US sentencing in recent decades. As such, extensive research explores whether they reduce extralegal sentence disparity. However, to date, no study has examined whether extralegal disparity is present in how either axis of guideline sentencing are constructed. Using federal sentencing commission data along with both single and multi-level analyses, this research explores the legal and extralegal factors that predict one of these key grid axes: the offense seriousness score. The results call into question not only some assumptions underlying guideline sentencing but also recent analytical strategies for assessing sentencing outcomes in guideline systems.  相似文献

The treatment of white-collar offenders by the criminal justice system has been a central concern since the concept of white-collar crime was first introduced In general, it has been assumed that those higher up the social hierarchy have an advantage in every part of the legal process, including the punishment they receive as white-collar criminals. In a controversial study of white-collar crime sentencing in the federal district courts, Wheeler, Weisburd, and Bode contradicted this assumption when they found that those of higher status were more likely to be imprisoned and, when sentenced to prison, were likely to receive longer prison terms than comparable offenders of lower status. While they argued that results were consistent with "what those who do the sentencing often say about it," their analyses failed to control for the role of social class in the sentencing process. In this article we reanalyze the Wheeler et al sentencing data, including both measures of socioeconomic status and class position. Our findings show that class position does have an independent influence on judicial sentencing behavior. But this effect does not demand revision in the major findings reported in the earlier study.  相似文献

The first part of this two-part special issue on structured sentencing in the U.S. focused on individual jurisdictions and the relationship of five types of sentencing reforms to judicial discretion and to the political and legal forces that originated, maintained, altered or sometimes ended the reform. This issue moves the focus to a comparative one, looking across a variety of different jurisdictions to report common threads of advantage and disadvantage to the various structured sentencing systems. Originating in political and legal arenas, structured sentencing affects not only the sentencing process, but can itself affect the political process and the distribution of sanctioning discretion among the different branches of government.  相似文献

Despite considerable attention, unwarranted disparity in sentencing remains a major and pervasive criminal justice problem. In this paper the argument is made that the most appropriate remedy lies not in an attempt to eliminate judicial sentencing discretion, but rather through the development and articulation of explicit sentencing standards or guidelines. Building upon the experience gained in a recent study with the United States Board of Parole, a model is put forth for the development and articulation of sentencing policy on a district or circuit basis that could be applied to structure and control discretion without removing individual case consideration.  相似文献

This study compares final sentencing decisions ordered by judges to federal and state sentencing guidelines for protective order violations. The authors reviewed violations that were pled before the largest district court in Utah and found that in the majority of cases, defendants were not sentenced in accordance with federal and state guidelines. Although state guidelines mandate defendants who violate a protective order to attend a batterer intervention program, less than one fourth of defendants were sentenced to attend such programs. Fewer than half of the defendants were arrested and incarcerated, as opposed to the 100% mandated by state sentencing guidelines. Federal guidelines mandate that all defendants be ordered to surrender firearms, but only six defendants were given that order. This study shows that the judicial system could be more aggressive in improving the safety of victims of intimate partner violence by using the full extent of the sentencing guidelines.  相似文献

Research on sentencing has made clear that factors beyond case and offenders' attributes influence court decisions. Environmental and procedural characteristics also significantly affect the sentences of criminal courts. Yet, while state-level studies regularly control for such factors, most research on modern federal determinate sentencing has neglected jurisdictional attributes and variation as sources of extralegal sentence disparity. Using the organizational context and social worlds theoretical perspectives with a multilevel analytical approach, this study assessed how district and circuit of adjudication affect case-level lengths of sentences for federal drug-trafficking offenses, finding that both significantly affect sentencing outcomes and their predictors.  相似文献

Although available empirical evidence suggests that Minnesota's Determinate Sentencing Law has had little effect on prison incarceration, it is still uncertain whether the sentencing guidelines affected jail use. A few recent studies imply that the guidelines have had a positive effect on jail incarceration rates. Accounts have pointed to preexisting trends, more severe sanctioning of repeat property offenders, and judicial concern with prison overcrowding as possible underlying causes of this observed increase. Using longitudinal data and an ARIMA study design, we investigate the validity of these competing explanations. Our findings show that the onset of the sentencing guidelines increased judicial use of the jail sanction beyond the effect of preexisting trends. In addition, the effect of mitigated dispositional departures from the no prison/prison outcome on jail use is salient only when prison population levels are high. This latter finding supports the thesis that judicial concern with prison overcrowding motivated judges to circumvent the guidelines in order to shift the burden of incarcerating offenders from the state to the local level. The policy implications of these results for determinate sentencing reform are discussed.  相似文献

罪刑均衡原则作为刑法的一个重要基本原则,是支撑刑法学发展的一个重要指标。在具体的司法实践中,错综复杂的案情以及层出不穷的社会问题,为实现刑法的公平正义以及追求最为均衡的刑罚裁量,带来了不小困难。现代文明社会要求严格恪守罪刑法定原则,罪刑均衡更成为一个司法层面的问题。然而,司法的过程是复杂的,在司法的过程中,司法界精英们发挥了重要的引导和规范功能。通过对刑罚裁量过程中各种辩证关系的分析和论证,努力寻求一种适合我国国情的罪刑均衡的司法模式。因此,在刑罚裁量的过程中,既要实现公平与效率的平衡,又要从法益侵害及行为人特质二元的衡量标准出发,实现应罚性与需罚性的平衡。最后,以刑罚的效果和民众的接受度作为刑罚适当的重要衡量标准,将刑罚裁量的量刑法理学模式与量刑社会学模式有机结合起来,并建议引入量刑听证制度,从司法的层面积极实现罪刑的均衡。  相似文献

当前对量刑平衡的相关探索和研究主要是从法律的细密化、具体化这一向度出发的。在司法实践中,量刑本身所要求的定量化与决定量刑诸因素的非定量性之间形成了尖锐矛盾。更具有可能性与可行性的路径应当是:从增强刑事司法的确定性出发,辅之以适应性,使刑罚裁量的统一性与个别化尽可能趋于协调。刑事判例机制的功能与改革和完善我国现有刑罚裁量模式具有内在契合性。  相似文献
