This study examines the temporal relationship between the incidence of police shooting and the incidence of criminal homicide for New York City between 1971 and 1975. The research finds that there is no temporal relation between the incidence of police shooting and the incidence of criminal homicide and concludes that the very strong and widely supported cross-sectional correlation between police shooting and criminal homicide is spurious, not causal.  相似文献

The broad consensus generally found with regard to public perceptions of crime seriousness has been shown to reflect “consistency” in relative rankings rather than “absolute agreement” in ratings among sample groups. The present study compared the crime seriousness perceptions of native-born Israelis with those of two groups of new immigrants (one from the former Soviet Union and the other from Ethiopia). Questionnaires including 30 different criminal offenses for evaluation were distributed by means of face-to-face interviews to a representative sample of the Israeli adult population. As expected, the three groups provided very similar rankings of offenses but much less absolute agreement (ratings). It is suggested that the significant gaps in the perceptions of the groups stem from “culture conflict” (Culture Conflict and Crime, Social Science Research Council, New York, 1938), that is, differences in the social and cultural norms of the immigrants’ countries of origin and those prevailing in the absorbing society.  相似文献

This paper is a comparative study of law of assembly between the People's Republic of China (PRC) vs. the Republic of China (Taiwan) (ROC). The comparison is achieved by looking at how these two societies regulate and police assembly, procession, and demonstration (hereinafter “public assembly”). Particularly it looks at the constitutional mandate and legal limitations on police powers in managing such public gatherings, e.g. what are the role and functions, and powers and limitation of the police in dealing with public assembly application and conduct.This comparative project is conducted with a view to understand the relative development in police powers in the two Chinese societies, once linked by history and culture and now divided by geography and ideology. It is assumed that in order to achieve a political “unification” of the two societies under a “one country two systems” formula,or any other viable political settlement, some understanding of how the two legal systems work is important in breaching their differences.In a still larger context, this research rides the tide of comparative policing in exposing and explicating how police in these two closed societies, ROC (Confucianism) and PRC (Socialism), come to terms with social protests and political challenges; more broadly how they balance the forces of reform and control with the use of law.  相似文献

The Juvenile/Family Court has significant problems in dealing efficiently and effectively with its caseload. Due to the pressure of “serious” juvenile crime, a large volume of status offense and minor crime cases, although of significant social consequence, are dismissed by the court. The concept of “neighborhood justice” has provided one basis for dealing with such cases.This is a report of a process evaluation of New Jersey's Juvenile Conference Committee (JCC) program, which provides an extensive network of citizen tribunals as an arm of the court. The evaluation was designed to explore both structural and procedural aspects of the JCC with a focus on policy implications. Results show that the JCC is a major diversion mechanism. Questions are raised, however, as to the purpose of intervention in cases of minor delinquency and the adequacy of current JCC procedures in dealing with such cases. The conclusion is reached that the citizens' tribunal is an important mechanism for community development.  相似文献

A college education has been increasingly perceived as a necessary requirement for policing because of the recommendations of the National Advisory Commission on Criminal Justice Standards and Goals and other, equally prestigious commissions, and because of a desire of the police to be more “professional.” Research on the value of a college education for police officers has not been sufficiently critical or rigorous, nor has it taken into account the conflict between some of the perceived benefits of higher education and the traditional organizational structure of police departments. Before committing our resources irrevocably, careful research needs to be undertaken on the value of a college education in light of existing organizational structure and also in light of some alternate structures.  相似文献

Extreme value theory is used to provide, according to one reviewer, a quantitative measure of the probability of a police dispatch operation going “haywire” under pressure. Convensional queuing theory that concentrates on measures of average performance is not readily adaptable to this application. In a major police department, average values of delay response were found to be acceptable, and preliminary analysis showed that sufficient resources were available to avoid excessive queuing at peak loads. Nevertheless, reports of occasional excessively delayed responses indicated the existence of serious problems. Extreme value theory concentrates on the statistically rare long delays that, because of the many repetitions of requests for service, can occur more frequently in time than is acceptable to police management. In the example discussed, the predicted magnitudes and frequencies of these long delays provided the justification for an immediate improvement program. In general, the straightforward methodology described would appear to have broad applications and great practical value. The subsequent analysis to identify causal factors is not a part of the discussion.  相似文献

In the New Property Rights approach the degree of incompleteness of markets is taken independently of the cost of the public ordering and of their efficiency relatively to private orderings. In this approach “public markets,” similarly to a Swiss cheese, are either assumed to be nonexistent empty holes (because of infinite third party verification costs) or assumed to be smooth and efficient (because of zero third party verification costs). When we allow for positive but not infinite third party verification costs we are necessarily pushed back to the insights of Commons, Coase, Fuller and Williamson. The degree of (in)completeness of public markets becomes an endogenous economic problem and managers can be seen as agents that make “second order” specific investments to run specific relations that cannot be efficiently handled by public markets. Managers and the public authorities build respectively private and public “legal equilibria” that set the working rules within which transactions can take place. Private and public legal equilibria are not only substitutes but also complements. This complementarity is an important source of the path dependency that characterizes the development of different legal systems. The framework is applied to GM’s acquisition of Fisher Body. We suggest that, contrary to the claims of the New property Rights approach, the advantages of the acquisition were not due to the superior incentives of the new private owners but should be rather related to the replacement of public markets by the new private ordering set up by Alfred Sloan.  相似文献

Much of the knowledge about police behavior on the streets is based on observational research. Little research, however, had examined the impact of reactivity in police observational data. One theme in the field research literature was that observer behavior could act as a source of bias in observational data. This article uses data from a large-scale observational study of police to predict this form of reactivity during encounters with suspects. In other words, “Are observer effects triggered by situational factors (i.e., dangerous suspects or situations) or a function of observer characteristics?” Results from a two-level hierarchical logistic model indicated that observers with higher academic rank (e.g., advanced graduate students), lower grade point averages, and more conservative attitudes toward criminality were less likely to get involved in police work during encounters with suspects. The implications of these findings for recruiting and training police researchers are discussed.  相似文献

The disproportionate number of minority motorists stopped by the police gives rise to a host of salient questions which center on contemporary police practices. Research has shown that traffic stops are routinely used as a “pretext” to stop minority drivers. In this article, the authors argue that the current police practice of disproportionately stopping minority motorists was formally sanctioned by the Supreme Court in Whren v. United States (1996). The current thrust to examine police practices will do little to end racial profiling, and the underpinnings of this problem, in part, lie in judicial precedent. The authors present the notion that in order to minimize racial profiling, the court must carve out an objective test from the Whren decision that will guide police behavior in the pretextual stops of motorists. The article concludes with a template of what this objective test may look like.  相似文献

The toxicological findings from 6037 analyses of viscera obtained from victims of traumatic death are used to correlate the relative incidence of carbon monoxide, ethyl alcohol, narcotics, hypnotics, analgesics, and tranquilizers-antidepressants in deaths occurring under the following circumstances: fire related, asphyxia by hanging, by use of plastic bags, from physical obstruction of trachae, and by drowning; traumatic injury from impact of moving train, fall from height, and occupational accident; traumatic injury to pedestrian, driver, and passenger from vehicular accidents; and from violent death by shooting, stabbing, strangulation, and beating. The influence of alcohol, narcotic drugs, and tranquilizers on carbon monoxide can be seen in some of these traumatic deaths. Ethanol alone and in combination with other drugs was present in 42.3% and 19.5% of driver and pedestrian victims, respectively, of vehicular accidents in the year 1974. Comparative analysis is presented for the toxicological data obtained on victims of homicide (shooting, stabbing, strangulation, and beating) in New York City and similar data reported for victims of homicide in Detroit. In New York City 45.9% of such victims died while under the influence of alcohol or narcotic drugs, or both, with methadone predominating in the latter category. Tissue concentrations of drugs found in victims of traumatic death are presented. Diphenylhydantoin, diazepam, meperidine, and slow-acting barbiturates were found in normal therapeutic levels. Higher concentrations of amitriptyline, chlorpromazine, propoxyphene, short-acting barbiturates, and methadone were observed. The concentration of methadone in blood and brain (0.13 +/- 0.14 mg/100 ml) and in liver (0.53 +/- 0.42 mg/100 ml) in cases of traumatic death are not different from those observed in deaths classified as due to methadone overdose.  相似文献

One of the more widely publicized presentations about crime is “Scared Straight,” a documentary about a program in which juveniles visit inmates in a New Jersey penitentiary. It is the contention of this article that this film and the accompanying media coverage of it convey an ideology message concerning crime and criminals. Crime is presented as a matter of individual choice that has little relationship to any social variables. Criminals are portrayed in a one-dimensional manner as evil, vicious, and barely human. The documentary is a success because these images of crime and criminals conform to existing stereotypes. Based on these distorted images, the film and media coverage “market” a simplistic solution to crime that is compatible with their presentation of the crime problem.  相似文献

Four reality monitoring variables were used to discriminate suspect from foil identifications in 183 actual criminal cases. Four hundred sixty-one identification attempts based on five and six-person lineups were analyzed. These identification attempts resulted in 238 suspect identifications and 68 foil identifications. Confidence, automatic processing, eliminative processing and feature use comprised the set of reality monitoring variables. Thirty-five verbal confidence phrases taken from police reports were assigned numerical values on a 10-point confidence scale. Automatic processing identifications were those that occurred “immediately” or “without hesitation.” Eliminative processing identifications occurred when witnesses compared or eliminated persons in the lineups. Confidence, automatic processing and eliminative processing were significant predictors, but feature use was not. Confidence was the most effective discriminator. In cases that involved substantial evidence extrinsic to the identification 43% of the suspect identifications were made with high confidence, whereas only 10% of the foil identifications were made with high confidence. The results of a laboratory study using the same predictors generally paralleled the archival results. Forensic implications are discussed.  相似文献

Larson's review raises several points concerning the Kansas City Preventive Patrol Experiment. The authors of the evaluation of that experiment respond to each of Larson's criticisms. With reference to Larson's two major points, this response demonstrates that (1) neither Larson's models nor his data are adequate to make statements about “typical patrol intensities” in major American cities and (2) patrol visibility in the reactive areas was markedly decreased over the one-year period of the experiment.The authors agree with Larson and have consistently urged that great caution should be used in generalizing the results of the experiment. The Technical Report itself presents results cautiously and conservatively. Also, large amounts of data comparing Kansas City with other cities are presented in the Report to enable readers to place the kansas City experience in perspective.The authors also agree with Larson that the results of the experiment indicate that police administrators can be more flexible in the allocation of officers than they have been previously. That Larson reaches this conclusion indicates that, despite his minor criticisms of the study which are responded to herein, he basically accepts the results of the experiment.  相似文献

Nine people died of traumatic asphyxia due to an uncontrolled crowd at a community basketball game in New York City in 1991. We reviewed the circumstances, postmortem findings, and the causes of death. The majority of people had petechiae of the conjunctivae and face consistent with chest compression. There were minimal superficial blunt injuries and no fractures or acute intoxications. These deaths are often incorrectly attributed to blunt force injuries, while the cause typically is asphyxia due to chest compression.  相似文献

Relatively little research has examined the impact of victim, suspect and case characteristics on the probability of various case closures in regard to personal crimes requiring police investigation. The present article examines the effect of individual and case characteristics (i.e. victim–offender relationship, initially available evidence) on the police unfounding decision, and the probability of four other types of case closure (Arrest, Exceptional due to lack of victim cooperation, Exceptional due to lack of “prosecutorial merit”, and Open) among a sample of felony sexual assault cases. Using data from a large municipal police department's sexual assault investigative unit, results indicate that the race of the victim and suspect plays no role in determining any of the case outcomes in this sample, while prior relationship does appear to have a strong impact. Variable impacts for indicators of the strength of evidence, victim's cooperation, and the seriousness of the case are also discussed.  相似文献

This exploratory study examines relationships between the police and Hispanics in Texas. Specifically, data were collected on Hispanic evaluations of police performance, expectations of police performance, and overall satisfaction with the police. A sample of 500 Hispanics throughout the state of Texas were surveyed on their experienced and perceived relationships with three levels of police agencies: local (municipal) police, sheriff's officers, and the state's Department of Public Safety. Findings are reported based upon overall ratings of the police, victim-related data, and data from individuals who had any form of contact with the police. Significant findings show that any form of contact with the police appeared to lower the rating of police performance. This appears to be a product of the interaction between high public expectations and qualitatively poor police performance. Further findings indicate that an increase in the fear of crime among Hispanics lowered evaluations of local police. Similarly, victimization lowered the evaluation of local police, the county sheriff, and the Department of Public Safety. Hispanics also perceived that officers have a “bad attitude,” that the police need to patrol and investigate more, that response time should be improved, and that there should be less discrimination against Hispanics. These findings appear to be largely influenced by ineffective communication (both symbolic and linguistic) and cultural conflict.  相似文献

“Partnership” and “partnering” are two of the most frequently used terms in public sector procurement. They may be used by both customers and suppliers to justify their respective negotiating positions. A supplier may argue that, since the agreement is a “partnership agreement”, there should be no service credits or liquidated damages payable. The customer on the other hand, may argue, on similar grounds, that it wants to benchmark the supplier and have a broad right to audit every aspect of the supplier’s business.But despite being well used phrases, most guidance relating to these concepts does not define how “partnerships” or “partnering” is to work in practice. While most talk of the supplier and the customer working together “in partnership” with common aims, there is little information available as to how this will be incorporated into agreements, particularly in the context of large scale IT procurements.1 The purpose of this article is to review the available guidance and detail some of the ways in which this guidance can be incorporated into legal agreements.  相似文献

We reviewed the case records for all decedents recovered from the waterways of New York City over a three year period (1997-2000). The epidemiological profile, circumstances, toxicology findings, putrefactive changes, date of recovery, length of immersion, and injuries were examined. There were 123 deaths: 52 suicides, 50 undetermined, 16 accidents, and five homicides. The causes of death included: 97 drownings, 13 undetermined, and 13 other. Of all the floating decedents, 27% were without putrefactive change. All found after two or more weeks of immersion were recovered from November to May. The detection of ethanol and illicit drugs was 53% in the accident, 41% in the suicide, and 33% in the undetermined groups. Detection of ethanol and/or drugs of abuse is not a reliable criterion to distinguish suicide from accident. The identification of the deceased is pivotal for determining the manner of these deaths. Therefore, a great reliance is placed upon the medical investigator and the police (including the missing persons bureau) to determine the circumstances and identification of the decedent.  相似文献

Niederhoffer, following Durkheim, proposed a linear causal model to explain police anomia. Using data from an availability sample of New York City police, he breaks into the chain of variables at frustration and terminates the analysis with cynicism measured by a twenty-item scale. This study replicates Niederhoffer's research with a population of urban police, examines the nature and incidence of cynicism, and tests the relationships between various indices of frustration, cynicism, and anomia. Contrary to Niederhoffer's expectations, cynicism is not prevalent among police outside New York City; cynicism my be described adequately only with reference to three dimensions; most indices of frustration do not significantly correlate with two subscales of cynicism; and cynicism does not intervene in the relationships between a number of independent variables and anornh. An alternate model based on Merton's conceptualization of anomin as the result of a discrepancy in cultural values and institutionalized means for attaining such goals was tested. It was found that perceived means-goals discrepancy vis-à-vis legal norms and goals intervened in the relationships between rank and anomia and years on force and anomia.  相似文献
