The focus of this paper is on the class of robots for personal or domestic use, which are connected to a networked repository on the internet that allows such machines to share the information required for object recognition, navigation and task completion in the real world. The aim is to shed light on how these robots will challenge current rules on data protection and privacy. On one hand, a new generation of network-centric applications could in fact collect data incessantly and in ways that are “out of control,” because such machines are increasingly “autonomous.” On the other hand, it is likely that individual interaction with personal machines, domestic robots, and so forth, will also affect what U.S. common lawyers sum up with the Katz's test as a reasonable “expectation of privacy.” Whilst lawyers continue to liken people's responsibility for the behaviour of robots to the traditional liability for harm provoked by animals, children, or employees, attention should be drawn to the different ways in which humans will treat, train, or manage their robots-in-the-cloud, and how the human–robot interaction may affect the multiple types of information that are appropriate to reveal, share, or transfer, in a given context.  相似文献

Administrative justice systems are under a variety of pressures, in particular austerity-inspired civil justice reform. I argue that such pressures do not necessitate the decline of administrative justice, and that a developing Welsh model has cross-jurisdictional appeal, especially to legal orders currently lacking a relevant organisational centre and joined-up approach. I examine the efficacy of existing conceptions of administrative justice and delineate a developing Welsh approach grounded in egalitarian principles. The nascent Welsh model emphasises reforming administrative justice hierarchies so that they work harmoniously with regulatory and value-promoting parts of the system, focusing on user perspectives and tackling the risks of less transparent forms of bureaucratic decision-making.  相似文献

Absinthe, an alcoholic drink used in certain artistic circles and considered the inspiring muse of many famous artists because it was reputed to stimulate creativity and possess exciting, aphrodisiacal and healing properties, in the past enjoyed enormous popularity so much so that it led to a real collective abuse so causing its prohibition in many countries, is again enjoying a new period of popularity. Also in Italy there is increasing information about the use and abuse of this drink. We received a request to analyse and determine the nature of two samples of alcoholic drinks, obtained by macerating Artemisia absinthium leaves in ethanol. Analyses of extracts by gas chromatography/mass spectrometry (GC/MS) identified beta-thujone, which is responsible for the activity and toxic effects on the CNS of absinthe, in both alcohol samples.  相似文献

Since 1993 many seizures of 1-phenylethylamine have been made in several European countries. It was originally thought that 1-phenylethylamine had been made in error, but later information suggested that it had been prepared deliberately. The related compounds, 1-amino-1-(4-methylphenyl)ethane and 1-methylamino-1-phenylethane and the 1-propanamine isomer of 3,4-methylenedioxyamphetamine, have also occurred in isolated cases. Analytical data are presented on these amines as well as a number of Leuckart impurities in 1-phenylethylamine. The pharmacological effects of these substances are largely unknown.  相似文献

Post-September 11, the government has been rapidly funding public health initiatives to bolster the Nation's ability to respond to bioterrorist attacks. While the infusion of money into the public health system is laudable, the pressure to enact legislation quickly has resulted in laws and policies that ignore privacy and civil liberties and that favor anti-bioterror initiatives over more common public health concerns. A public health agenda that ignores privacy and civil liberties will undermine public trust, leading people to not fully participate in critical public health activities. Our Nation is far more likely to succeed in preventing and responding to a potential act of bioterrorism if we embrace the principle that advancing public health and preserving individual liberties are symbiotic and inextricable.  相似文献

Issues pertaining to crime and criminal justice have long been part of presidential campaigns. Voters want to know how candidates plan to solve the problem of crime and keep them safe. In turn, candidates respond to voters’ concerns and describe their crime control ideas in hopes of increasing voter support. In doing so, they often rely on symbolic statements that provide little detail but make people “feel good”. This study analyzes the criminal justice rhetoric used by the three major presidential candidates in the 2016 election cycle to determine what issues they discussed and how often. The analysis also examines if candidates relied on symbolic statements, and how the issues were debated between the candidates. The findings show that the issues discussed were somewhat different than in previous years, and that the candidates relied on symbolic statements about crime – a change from the previous election cycle. Additionally, the candidates used crime control as a way to reach out to voters in their own political party, suggesting an interesting shift in how issues of criminal justice are being approached within elections.  相似文献

This Article examines university opposition to a proposed statutory exemption to infringement liability for basic genetic research and patient care. Gene patenting has allowed patentees to bar basic genetic research, slowing the progress of developing and administering diagnostics and gene-targeting therapeutics. Debates over the merits of gene patents have been heated, most recently leading to an unprecedented invalidation of several broad patents covering all variations and use of two genes linked to breast and ovarian cancers. More important, however (as this ruling was reversed in part), are proposed statutory exemptions to infringement liability. The Department of Health and Human Services' Secretary's Advisory Committee on Genetics, Health, and Society (SACGHS) has promulgated an exemption from liability for infringement that occurs in the course of research. This exemption would promote basic research by granting academic scientists unfettered access to genetic material. The proposal does not alter the patentability of gene sequences; it merely restricts patentees from using infringement threats to stop research. Surprisingly, the Association of University Technology Managers (AUTM), an organization responsible for promoting development of university research, opposes such an exemption. The AUTM alleges that the exemption would slow research by reducing the incentive for private firms to invest in upstream discoveries made in university laboratories. Yet the exemption would do the opposite: by opening the doors to research relating to any gene segment, a research exemption would accelerate basic research. Moreover, it would not affect collaboration with private industry: where there is potential to commercialize basic research, biomedical companies would continue to license the rights to university discoveries. Thus, the AUTM's motivations in opposing the proposed research exemption are suspect. They appear to reflect either a misunderstanding of the purpose behind granting property rights to publicly funded university research, or an improper alignment with industry goals.  相似文献
