Turkey, a candidate state that started negotiating membership in the EU in 2005, has witnessed serious political conflict since April 2007 when the military threatened to intervene once again in the political process. The Chief Prosecutor filed closure cases before the Constitutional Court first against the Democratic Society Party, the first pro-Kurdish party to enter parliament, and then against the ruling Justice and Development Party (AKP) which won a landslide election victory in the parliamentary elections of July 2007. The Court decided by the slimmest of margins against the closure of AKP, allowing the country to narrowly escape one of its worst political crises. The attempted “judicial coup” can only be explained by the state ideology of and the nature of democracy in Turkey. The political conflicts are related not to a fight over dismantling or protecting secularism, but to the power struggle between old and new elites in the country.  相似文献

The European Court of Human Rights (ECtHR) is widely regarded as the most important human rights court worldwide. This article investigates the extent to which the court addresses cases from countries with the worst human rights performance. Using a new data set on all ECtHR judgments from 1995–2012, the analysis suggests that the ECtHR does not deliver its judgments against members of the Council of Europe with the worst human rights records, but instead against more democratic and affluent states. The reason is that litigating in front of a supranational court requires capacities that vulnerable people are unlikely to possess, except when aided by transnational advocacy groups. However, more judgements are issued against countries that lack independent judiciaries, where cases are less likely to be resolved at the domestic level. While the ECtHR might not address the worst human rights crimes, it plays a subsidiary role in the European human rights protection system by compensating for weak domestic judiciaries. However, the court's inability to independently pursue litigation, together with the lack of capacity in some countries to bring cases forward, have hampered more effective protection of human rights for the most vulnerable in Europe.  相似文献

This study examines the performance of the South African Constitutional Court in four cases in which it was required to review the allocation of resources by the political branches. According to the conventional view, political resource allocation should be immune from judicial scrutiny because it involves decisions that courts are neither institutionally equipped nor mandated to make. In new democracies, the added reason for judicial self-restraint in this area is thought to be that courts should avoid potentially damaging confrontations with the political branches un1i1 they have established their legitimacy. And yet, in the cases examined here, the Constitutional Court has not only skillfully negotiated its review function, but actively sought out opportunities to subject political resource allocation to the standards set by the Constitution. In this way the Court has been able to build its legitimacy by endorsing the overall thrust of the political branches' transformation efforts. In turn, those efforts have been legitimated by their exposure to judicial scrutiny. This finding suggests that the conventional view may be wrong, and that constitutional courts in new democracies may need to involve themselves in controversial political questions if they are to play a meaningful role in the consolidation of democracy.  相似文献

This article analyses party patronage transformations in Italy since the early 1990s, a time when political parties and the party system entered a phase of continuing change. It examines how the interaction between the temporality of party system restructuring and historical legacies rooted in the nature of public bureaucracies reproduced patronage practices aimed at capturing state resources. The article employs a historical institutionalist approach as a research framework and concludes that this provides a cogent explanatory argument for the development of state exploitation taken by Italian political parties since the crisis of the early 1990s.  相似文献

This article compares the characteristics and development of the main political parties of Kenya, Zambia and the Democratic Republic of Congo, starting from their independence in the 1960s up to the late 1990s. It offers an exploratory analysis of the differences and similarities that might have led to the, more or less, successful establishment of political parties and democratic regimes in these countries. The parties are compared along four dimensions: colonial heritage, the saliency of ethnicity, political communication between the party elite and the periphery, and their link to civil society. The study shows that the development of national parties at the time of independence was severely hindered by the colonizers. The inherited political structures encouraged the exploitation of both ethnic and regional links and further strengthened patronage networks. But also in more recent years, political leaders have used ethnicity as a strategic tool to strengthen their position in power. The comparative analysis shows that in those countries in which ethnicity was most salient, political parties were less democratic and less favourable for democratization. The analysis also highlights that the country with the least active political communication had the most difficult path towards a multiparty system. Finally, the article suggests that a civil society that is truly independent from the government, and incorporates powerful players in urban areas, is most likely to contribute to the development of a competitive party system.  相似文献

Abstract

The South African democracy has survived three national and provincial elections and three local elections, since 1994. In comparison to other young democracies in Africa, South Africa has experienced a relatively stable transition to democracy. However, the ruling ANC has not been under pressure from opposition parties. Although this has helped pave the way, a dominant governing party does not necessarily encourage the growth of a mature, democratic political culture. The assumption of this article is that political parties in developing societies have a normative obligation to do more than canvas votes during election campaigns. Political parties should also be instrumental in fostering a democratic political culture by communicating democratic values, encouraging participation in the democracy and enabling voters to make an informed electoral choice. Although political posters contribute mainly to image building, the reinforcement of party support, and the visibility of the party, posters are the agenda setters or headlines of a party's campaign – it is therefore argued that political parties in developing societies also need to design political posters responsively, in order to sustain the democracy. In general it seems that the poster campaigns of parties have matured since 1999, in the sense that there was less emphasis on democratisation issues in the past, and the campaigns conformed more to the norm of Western political campaigning.  相似文献

This article reports on an analysis of South African journalists’ views on independence from political parties at a time when the journalist fraternity appeared to be split in two (with nuances in between): those who appeared to support the nationalistic, patriotic project of sunshine journalism to focus on the “positives” and enhance the image of the country as espoused by the ruling party, the African National Congress (ANC), and those who attempted to abide by codes of ethics according to the Press Council of South Africa (PCSA). The PCSA stipulates that belonging to a political party constitutes a conflict of interests, and recommends distance from political parties, with the liberal normative view of watchdog journalism and holding the powerful to account. The analysis combined and integrated a few methods to reach conclusions about the master signifier in the discourse of journalists. It used a survey conducted with journalists in 2015 for quantitative and qualitative analysis, and deployed Zizek’s use of the concepts of master and floating signifiers to offer some critical reflections about journalists’ relationships to political parties. It found that the majority of journalists felt that their credibility would be compromised if they belonged to a political party, but quite a large section felt that journalists had biases anyway, so what was the problem?  相似文献

Although paid television and radio political advertising is banned in the United Kingdom, parties fielding sufficient candidates are entitled to free air time during election campaigns for a fixed number of party election broadcasts (PEBs). Over the years, parties have experimented with a variety of different PEB formats. But the impact of PEBs on voters is underresearched. This article therefore analyzes the influence of PEB viewing in the 1997 British General Election. Though a majority do not view PEBs, those who do are influenced by them, especially in terms of their evaluations of parties and their leaders: Other things being equal, viewers of a party's PEBs become more favorably disposed to the party and its leader than those who do not see the broadcast. Labour and Conservative PEBs have no impact on vote intentions, however. But viewers of Liberal Democrat broadcasts become more likely to support that party. We speculate that this reflects different background levels of media exposure for the major parties as compared to the third party.  相似文献

This article examines the Schmittian-inspired charge that liberalism is intrinsically imperialistic and that it dehumanises alternative illiberal political projects in ways that lead to disproportionate and indiscriminate violence. It focuses specifically on the charge that the US war on terror is the latest manifestation of this kind of liberal imperialism. Such an argument only makes sense when liberalism is combined with exclusionary modes of nationalism and realism. This synthesis underpins the “hard Wilsonianism” of American neoconservatism. The article argues that the Schmittian-inspired charge of imperialism cannot be properly directed at the more inclusionary cosmopolitan forms of liberalism, which is illustrated with reference to the Rome Statute of the International Criminal Court.  相似文献

Democratization, economic transformation, and EU accession have shaped the Bulgarian and Romanian party systems in ways similar to that seen across the rest of eastern Europe. A quarter century after democratization, the party systems remain unstable. The article demonstrates that nationalism and ethnic identity provide stable voter salience in party systems that remain dominated by fragmentation, personalistic political parties, and a lack of issue differentiation. An analysis of the use of ethnonationalism by political elites in Bulgaria is contrasted with a briefer analysis of Romania.  相似文献

Ultra-nationalist political parties of the far right have been an endemic feature of European politics in recent years. This article investigates the rise of the Nationalist Action Party (the MHP) in Turkey, a party that has a number of characteristics in common with its European counterparts. The objective of the article is to illustrate a paradox. These types of parties tend to display a considerable degree of adaptability and exhibit a tendency to move in a more moderate direction. They shed some of their violent and extremist leanings in the process as they try to transform themselves from closed communities or networks to mass parties of national standing. This apparent moderation should not disguise, however, the key underlying weakness of such parties, namely their limited commitment to the core values of liberal democracy and political pluralism. Indeed, such parties can continue to play an important negative role in terms of their ability to block the process of democratic deepening in nascent democratic regimes.  相似文献

This article explores the problems facing opposition political parties in Russia. In order to conceptualize the conditions in which opposition parties operate and which determine the strategies they adopt, the concept of dominant party systems is used as an analytical framework. Ideological flexibility, access to administrative resources, and the ability to mobilize key socio-economic groups (key factors in the maintenance of one-party domination) are all features associated with Russia's ‘dominant’ party, United Russia. It is argued that, whilst Russia is not a dominant party system along the lines of those which existed in Mexico and Japan, there are sufficient commonalities with such systems, in terms of the problems facing opposition political parties as to make comparison a useful exercise. The optimum strategies for opposition parties in dominant party systems (activist recruitment, ideological positioning and coalition-building) are identified and it is argued that these are all areas which Russian opposition parties need to address if they are to successfully challenge the regime and the ‘party of power’, United Russia.  相似文献

Where do modern terrorist group come from? How do they begin? This article establishes that most often they emerge from political parties. An effort is made to identify the relevant types of parties and the internal party dynamics which may have led to terrorist activity. Party regulation in general and its systemic consequences in particular have not been a matter of concern for scholars until very recently. Despite recent efforts to study how political parties are regulated in post-authoritarian democracies and in conflict-prone societies, the question of how party legislation affects party formation and party system development in the Western Balkans still remains a mystery. Adopting a multi-disciplinary (that is, legal and political) approach, this article attempts to fill a gap in the literature by analysing how different party (finance) regulations shaped the party system in Macedonia, one of Europe's most recent (and under-researched) democracies, while controlling for changes in electoral regimes. There are two main findings. On the one hand, registration requirements had the strongest impact on the party system format, even when the electoral system pushed in the opposite direction. On the other, public funding, rather than “cartelizing” the system, mainly facilitated the survival of (both big and small) parties. Finally, the article also points to the need to explore the role of shadow financing and corruption when analysing the effects of party finance in new democracies.  相似文献

Which political parties grow more or less statically nationalized in the immediate aftermath of a democratic transition? What accounts for these changes? This is the first broadly cross-national analysis of this dimension of stabilization of the democratic regime. It uses a sample of 64 moderate and large political parties from 19 countries in South Europe and Latin America. In the first stage of the analysis, I use growth curve models on panels of district-level, lower house, election results to test each party for changes in static nationalization. Results show that 41% of the cases grow more nationalized, about 22% grow less nationalized, and the rest show no evidence of change. Then, I test explanations of increasing static nationalization derived from (a) the competitive context; (b) the institutional context; and (c) the social structural context. I find that parties become more nationalized when (a) they are jointly programmatic and in government, and the party system is less fragmented; (b) the political system is centralized and a presidential election is concurrent; and (c) society is less ethnically fragmented. Finally, I confirm that more statically nationalized parties are associated with a higher quality of democracy.  相似文献

Blogging is an increasingly important practice in election campaigns, showing interesting variations across contexts. Recent research has shown that the adoption and use of blogs is strongly shaped by national institutional settings, that is, the different roles given to parties within political systems. However, intra-national differences in the practice of political blogging are yet to be explained. This article investigates the variation in usage of blogs in electoral campaigns in Sweden, a country characterized by strong political parties and a party-centered form of representative democracy. The central argument is that different parties utilize blogging in different ways. Just as blogging is shaped by how institutions support persons or parties, we propose that political blogging is shaped by party affiliation and ideological positions on individualism and collectivism. The empirical analysis, based on a survey among over 600 blogging politicians, confirms that ideological positions towards individualism and collectivism have a great impact on the uptake and usage of political blogs, portraying political blogging as a strongly ideologically situated practice of political communication.  相似文献

ABSTRACT

Since the restoration of multi-party democracy in Kenya in 1991, elections have witnessed intra-party violence during the primaries for selecting parliamentary and civic seats candidates. This article addresses the question of why electoral violence occurs during party primaries in Kenya and argues that violence is an outcome of the organization of political parties, which has revolved around personalities identified with ethno-regional interests rather than institutionalism. The upshot has been the absence of party institutionalization to establish structures for recruitment of members and organization of primaries. Such organizational weaknesses have denied parties the capacity to match the intense competition for tickets of ethno-regional dominant parties that guarantees nominees to win seats in their strongholds. Intra-party violence has followed. The article submits that intra-party electoral violence in Kenya is a function of the politics of clientelism and ethnicity, both of which have severely hampered the institutionalization of political parties and their capacity to cope with the stiff competition for the tickets of ethno-regional dominant parties.  相似文献

This article analyzes the impact that two terrorism-related matters had on Spanish politics and electoral processes in the country. First, the article analyzes the terrorist attacks perpetrated by jihadists on March 11, 2004, three days before Spain's general election. The indiscriminate, lethal attacks caused a state of shock in the country, brought the election campaign to a sudden end, and led to the defeat of the party in power. Second, the article analyzes the negotiations entered into with the ETA terrorist organization by the new government during its first term, from 2004 to 2008. This controversial step, upheld by the Spanish government despite massive opposition by civil society and the main opposition party, failed to bring about the end of ETA. Both the Madrid attacks and the negotiations with ETA were responsible for the breakdown of the consensus in regard to terrorism that had existed among the main Spanish political parties. The article analyzes how both events generated an unprecedented level of polarization and tension among political parties and society from 2004 to 2008, and how each event had a different impact on the general elections held during that period. The period under examination provides an example of adversarial politics; terrorism was highly influenced by the management of both events by the main political players.  相似文献
