Researchers have theorized how judges’ decision‐making may result in the disproportionate presence of Blacks and Latinos in the criminal justice system. Yet, we have little evidence about how judges make sense of these disparities and what, if anything, they do to address them. By drawing on 59 interviews with state judges in a Northeastern state, we describe, and trace the implications of, judges’ understandings of racial disparities at arraignment, plea hearings, jury selection, and sentencing. Most judges in our sample attribute disparities, in part, to differential treatment by themselves and/or other criminal justice officials, whereas some judges attribute disparities only to the disparate impact of poverty and differences in offending rates. To address disparities, judges report employing two categories of strategies: noninterventionist and interventionist. Noninterventionist strategies concern only a judge's own differential treatment, whereas interventionist strategies concern other actors’ possible differential treatment, as well as the disparate impact of poverty and facially neutral laws. We reveal how the use of noninterventionist strategies by most judges unintentionally reproduces disparities. Through our examination of judges’ understandings of racial disparities throughout the court process, we enhance understandings of American racial inequality and theorize a situational approach to decision‐making in organizational contexts.  相似文献

The purpose of this article is to review the impact of social networking sites on law, the legal profession and dispute resolution. Within a very short period of time, social networking sites such as Facebook, Twitter, and MySpace, combined with social networking hardware platforms, such as iPad, iPhone, Blackberry, and Android, have infiltrated the profession of law and dispute resolution. Many legal professionals now have a social networking profile, use information on social networking sites as evidence, and interact with other lawyers and judges through such forums. This increased interaction in a publically accessible and viewable medium presents a challenge to the legal profession's traditional ideas of independence, confidentiality, and rules of evidence. Social networking mediums are here to stay. Therefore, this article looks at how this trend affects law and the legal profession, what issues it presents to lawyers and judges, whether new laws are necessary to take into account the impact of social networking sites and the benefits of such technology in fostering access to justice and helping parties achieve justice.  相似文献

Samples of 120 district court judges from six randomly selected circuit court jurisdictions were compared with 62 circuit and criminal court judges in Tennessee concerning their compliance with Rule 11 of the Federal Rules of Criminal Procedure (U.S.C.A., 1986) governing guilty plea hearings. Among other things, Rule 11 provides that judges will inquire of defendants in open court about the voluntariness of their guilty pleas, whether they understand that they are waiving several important constitutional rights, whether there is a factual basis for the guilty plea, whether they realize they have a right to an attorney, and whether they understand the nature and consequences of the charges against them. It was found that federal judges are substantially in compliance with these provisions of Rule 11, although full compliance was not observed for all issue areas. By comparison, Tennessee trial judges adhered to these provisions (duplicated in the Tennessee Rules of Criminal Procedure verbatim) much less frequently. Various reasons for these discrepancies are discussed, as are some implications for defendant’s access to due process and certain constitutional guarantees.  相似文献

A sample of almost 100 judges exhibited well-known patternsof biases in risk beliefs and reasonable implicit values oflife. These biases and personal preferences largely do not affectattitudes toward judicial risk decisions, though there are someexceptions, such as ambiguity aversion, misinterpretation ofnegligence rules, and retrospective risk assessments in accidentcases, which is a form of hindsight bias. Although judges avoidedmany pitfalls exhibited by jurors and the population at large,they nevertheless exhibited systematic errors, particularlyfor small probability-large loss events. These findings highlightedthe importance of judicial review and the input of expert riskanalysts to assist judicial decisions in complex risk cases.  相似文献

Abstract

We surveyed 170 Chinese judges about their knowledge and beliefs about eyewitness testimony, and compared their answers to a prior survey of 160 US judges. Although the Chinese judges were less knowledgeable than the US judges, both groups had limited knowledge of eyewitness testimony, including for such important issues as whether lay people can distinguish between accurate and inaccurate eyewitnesses. Unlike the US judges, greater knowledge of eyewitness factors for the Chinese judges was not related to beliefs that may be necessary to reduce eyewitness error. Compared to the US judges, the Chinese judges were much less likely to believe that they needed additional eyewitness training and that they knew more about eyewitness testimony than lay persons. We also discuss the impact of culture, legal systems, investigative procedures, and judges' function on the Chinese judges' responses, and the legal reforms that China may need to implement to reduce eyewitness error.  相似文献

In the 50 years since the U.S. President's Commission on Law Enforcement and Administration of Justice under President Johnson issued its report, feminist activism and both feminist and mainstream research have resulted in defining domestic violence (DV) as a social problem. This awareness of the seriousness and expansiveness of DV has spurred the development of unprecedented programs and policies. Although DV policing changes have been significant, so too have been the development of and changes in safehouses, no‐drop court policies, domestic violence courts, community‐coordinated responses, and batterer intervention programs. In this article, we review the nonpolice responses to DV cases and outcomes and provide recommendations. First, research and policies need to more regularly be aimed at addressing victims’ safety and their diverse needs and experiences. Second, assessments should include addressing the processing of these cases through the impact of responses by individual community and criminal legal system actors (e.g., victim advocates, police, prosecutors, and judges) to victims and offenders.  相似文献

With dramatic changes in family life over the last several decades, child custody law has shifted from a maternal preference to a more egalitarian standard, the best interests of the child. Despite this change in the law, scholars have debated whether gender continues to play a role in the resolution of custody disputes. Drawing on feminist legal scholarship and sociolegal research on judges, I assess the current debates over gender and custody by examining the accounts of judges who frequently adjudicate custody cases. I conduct in-depth, face-to-face interviews with twenty-five trial court judges in Indiana and investigate judges' accounts about whether they continue to use the tender years doctrine in custody disputes, even though the custody statute is explicitly gender-neutral. Then, I assess several competing explanations of the variation across judges' accounts, including the judges' gender role attitudes, gender, age, and political party affiliation. In exploratory analyses, I also examine the contested custody rulings of a subset of nine judges to assess whether judges' accounts are congruent with their actual custody decisions. I discuss the implications of these findings in light of feminist legal scholarship as well as empirical research on child custody adjudication.  相似文献

ABSTRACT

Women have made considerable progress in terms of their entrance into the legal profession, such that they are advancing towards parity with men on the High Court benches in Nigeria. This study is a product of qualitative empirical data gathered from interviews with judges and information gleaned from government records and personal files of judges in the Archives of the judiciaries in Mid-Western Nigeria. It identifies reasons for the increase in the number of women on the High Court Bench in the area. Women entering the legal professions in Nigeria from the 1930s opted for a career in government legal service and the Magistracy with less financial remuneration but regular work hours, than in private legal practice that provides higher remunerations and irregular work hours. Findings reveal that the number of women judges increased when it became fairly established to tunnel 90% of appointments to the High Court from these channels. The preliminary conclusion therefore, is that, although women lawyers have made considerable headway as High Court judges, the increase in their numbers on the High Court bench was not as a result of any organised policy to increase the number of women judges in Nigeria.  相似文献

Statutory interpretation is of central importance to the daily work of all judges. This paper explores the reasons why statutory interpretation is necessary and then considers how judges have explained the way in which they carry out this task. It examines how judges consider the text, the context and the purpose of statutory provisions. It also looks at how human rights instruments can be used as an interpretive tool. It then considers the issue of whether judges can ‘fill in gaps’ in a legislative scheme and whether there is a Rubicon which judges cannot cross in the interpretive process.  相似文献

The 1132 administrative law judges now serving in twenty-nine of the most important agencies of the national government are among the least understood and least studied authorities in the American political system, yet they are among the most powerful authorities in the modern policy process. ALJs have undergone a repid development from the creation of the office of "hearing examiner" in the Hepburn Act of 1906 to the rpesent djay, when they hear cases cfomparable in importance to those heard by federal district judges. ALHs are selected through a merit procedure almost wholly controlled by the agencies in which they are employed and are subject to constant cross-pressures from their judicial role and their administrative masters. Perceived problems of biased selection procedures, conflicts of interest, and lack of public accountability have led critics in Congress and elsewhere to propose a variety of marginal reforms. The policy proposal that probably gets to the heart of the problem, however, is the creation of an Administrative Court of the United States.  相似文献

There is controversy in Canada about the use of assessments by mental health professionals to assist in the resolution of postseparation disputes between parents about their children. Although the principles developed by the Supreme Court of Canada to govern the admission of expert evidence in criminal law cases provides guidance for judges in family law cases, in deciding whether to order an assessment or admit expert evidence, family law judges must also take account of the child-related context. Mental health professionals can provide valuable information that would otherwise be unavailable when making prospective decisions about children. Court-appointed assessors also have a significant institutional role in the family law cases that has no equivalent in the criminal law context. Assessors are important not only for the relatively rare cases that go to trial, but they also play a central role in helping to resolve the much larger number of cases that are settled.  相似文献

Even in a democratic society, the need for transparency must be balanced with an important countervailing interest: the occasional, legitimate need for government secrecy. This article, based on an examination of opinions in federal cases dealing with national security and transparency, explores how judges identified the main legal issues presented by a case and the legal factors or mode of legal interpretation used to reach or justify their conclusions. The article concludes that many of these opinions are as much about judges’ attempts to balance the judicial branch's power with the powers of the executive and legislative branches as they are about national security and transparency. Furthermore, the article contends these opinions have created an “architecture of power” that determines how national security information is controlled. The final section also suggests that judges should be mindful of the original architecture of power established by the Constitution and the First Amendment when writing their opinions.  相似文献

In virtually all situations involving forensic psychiatric assessments, the patient is represented by counsel. But does this fact entitle the lawyer to be present at the clinical evaluation? In a series of New York cases spanning a generation, judges have allowed presence of counsel at the psychiatric examination. The most common reason given for such a conclusion is to assure better cross-examination of the expert witness. Psychiatric evaluations mandated by law necessitate several guidelines different from those of the usual doctor/patient relationship. While we may have to accept the presence of attorneys in our consulting rooms, they should be observers only. To allow active intervention would distort the clinical process.  相似文献

This article seeks to provide an introduction as to how judges determine facts. It draws on material across a range of jurisdictions as to how judges themselves have described what they do and what they ought to do. It explores what factors judges take into account when deciding whether the evidence of a witness is credible. It examines the difference between recollection and reconstruction of events by witnesses and considers how judges draw inferences from primary facts. One of the central controversies in the judicial behavior literature is the extent to which judges' ability to act according to their ideological preferences is affected by their location in the judicial hierarchy. Judges on intermediate appellate courts have different decisionmaking environments than high court judges. As a result, the goals of lower appellate court judges may differ from those of their superiors: the quest for legal accuracy may compete with the desire to pursue policy preferences. Analysis of the reversal rate of the U.S. circuit courts of appeals offers insight into the extent to which these judges balance the pressures of their own policy preferences with the desire to achieve the legally accurate result in cases they decide.  相似文献

The current work seeks to ascertain whether rulings on dismissal cases issued by incumbent judges in Spanish labour courts are influenced by whether they are acting alone in their own court or sharing duties with other judges such as replacement judges, support judges or incumbent judges from other courts. We consider that a court is treated when more than one judge rules in it. Then, an analysis is conducted so as to determine the effect of such a treatment on the percentage of cases ruled in favour of the dismissed worker. The data used in the research are taken from the information recorded at court level provided by the statistics kept by the General Council of the Spanish Judiciary. A total of 2888 observations were available, corresponding to the period spanning 2004 to 2012. As regards the findings, it may be concluded that there is a significant positive impact on the number of dismissal cases ruled in favour of workers when incumbent judges are not acting alone in their court, particularly when the incumbent judge solves cases together with another professional judge.  相似文献

In rendering a decision in a particular case, judges are not limited to finding simply for the appellant or for the respondent. Rather, in many cases, they have the option to find for the former on one or more issues and for the latter on one or more other issues. By thus “splitting the difference,” judges can render a judgment that favors both litigants to some degree. What accounts for such mixed outcomes? Several theoretical perspectives provide potential explanations for this phenomenon. First, Galanter (1974) suggests that litigants with greater resources will achieve more favorable outcomes in the courts. Where two high‐resource, repeat‐player litigants meet in the appeals courts, these more sophisticated and successful parties may be able to persuade the court to render decisions with mixed outcomes that at least partially favor each party. Second, split outcomes may result from strategic interactions among the appeals court judges on the decisionmaking panel. Where majority opinion writers seek to accommodate other judges on the panel, split outcomes have the potential to serve as an inducement for more ideologically extreme judges to join the majority opinion. Finally, Shapiro and Stone Sweet ( Stone Sweet 2000; Shapiro & Stone Sweet 2002 ) propose that courts will sometimes split the difference in order to enhance their legitimacy (and ultimately enhance compliance by losing parties). For example, in highly salient cases, where noncompliance would more clearly threaten court legitimacy, judges may be more likely to split the difference in order to mollify even the losing party. We develop an empirical model of mixed outcomes to test these propositions using data available from the U. S. Courts of Appeals Database and find evidence supportive of all three theoretical perspectives.  相似文献

A survey of 355 judges examined the differences in judicial satisfaction between those assigned to problem-solving courts—such as drug treatment and unified family—and judges in other more traditional assignments such as family law and criminal courts. The unified family court systems, like drug treatment courts, have generally adopted the principles of therapeutic jurisprudence. Significant differences were found on each of the three survey scales: (1) helpfulness, (2) attitude toward litigants, and (3) positive effects of assignment. The judges who were in the problem-solving courts (drug treatment and unified family court) scored higher on all three scales than those who were not (traditional family and criminal court). The group of problem-solving court judges consistently scored higher than the other group of judges, with the drug treatment court judges scoring the highest. The group of traditional criminal court and family court judges scored less positively, with the criminal court judges having the lowest scores. The problem-solving court judges were more likely to report believing that the role of the court should include helping litigants address the problems that brought them there and were more likely to observe positive changes in the litigants. They were also more likely to believe that litigants are motivated to change and are able to do so. They felt more respected by the litigants and were more likely to think that the litigants were grateful for help they received. The problem-solving court judges were also more likely to report being happy in their assignments and to believe that these assignments have a positive emotional effect on them.  相似文献

In the early decades of the nineteenth century the small European societies in Madras (now Chennai) and Bombay (now Mumbai) were divided by disputes of such intensity that the authorities in London feared for the future of British power in India. The divisions were legal and social. In law, the Governors and the Supreme Courts of both cities contested the scope of their respective roles with the arguments focusing on the rights of Indians. Again and again, government took alarm at the ‘pro-Indian’ views of reforming judges. The debates were reflected in European social divisions, thereby making them all the more intransigent; legal allegiance became linked to social allegiance. It was this mixture of the legal and the social which gave the wives and other female relatives of the judges a role in the process of reform. Normally confined to multiple pregnancies and restrained social functions, the divisions in European life gave these women an opportunity to influence legal change. Without making official public statements they took part in the development of ideas about Indian rights.  相似文献
