This paper investigates the impact on legal advice of the major shift to telephone-only services in social welfare legal aid, which took place in April 2013. An empirical study comparing telephone and face-to-face advice reveals that face-to-face contact has considerable advantages in the advice interview. Based on interviews and observations with housing law clients, their lawyers and advisers, the findings of this qualitative study demonstrate that clients and lawyers often find it easier to express themselves and understand each other face-to-face. The face-to-face interview benefits from features including the stronger emotional connection between lawyer and client, non-verbal communication, more expansive conversation and the greater ability to consult and confer over documents. Telephone-only advice may be suitable for some more capable clients and uncomplicated matters, but this qualitative research shows that vulnerable clients are more likely to be adversely affected by the potential disadvantages of telephone-only contact. Clients with more complex social needs or with more serious or urgent cases are better served by face-to-face advice. The findings of this research should inform the LASPO review and future priorities for legal aid funding.  相似文献

Although the meaning, significance, and definition of race have been debated for centuries, one thread of thought unifies almost all of the many diverging perspectives: a largely unquestioned belief that race is self-evident and visually obvious, defined largely by skin color, facial features, and other visual cues. This suggests that “seeing race” is an experience largely unmediated by broader social forces; we simply know it when we see it. It also suggests that those who cannot see are likely to have a diminished understanding of race. But is this empirically accurate?I examine these questions by interviewing people who have been totally blind since birth about race and compare their responses to sighted individuals. I not only find that blind people have as significant an understanding of race as anyone else and that they understand race visually, but that this visual understanding of race stems from interpersonal and institutional socializations that profoundly shape their racial perceptions. These findings highlight how race and racial thinking are encoded into individuals through iterative social practices that train people to think a certain way about the world around them. In short, these practices are so strong that even blind people, in a conceptual sense, “see” race. Rather than being self-evident, these interviews draw attention to how race becomes visually salient through constitutive social practices that give rise to visual understandings of racial difference for blind and sighted people alike. This article concludes with a discussion of these findings' significance for understanding the role of race in law and society.  相似文献

The shift in recent decades towards an explicitly punitive agenda for criminal justice in Western jurisdictions has been well-documented in the criminological literature. People accused of offences and convicted offenders progress through a punitive criminal justice system replete with crime control values. Furthermore, in criminal justice policy development, the notion of victims' rights and the quest to rebalance the system in favour of victims now override concerns about rights. In the light of this state of affairs, it seems necessary to assess the role of practitioners within the criminal justice system who, by virtue of their professional mandates, can be expected to act as much needed allies for defendants as they progress through the system. These practitioners are defence lawyers and probation officers. Insufficient attention has been paid to the role of both and they have not previously been considered as two parts of a greater whole despite their obviously complimentary nature. In an effort to address this gap in knowledge, this article draws on two different studies to offer an exploratory discussion of how both practitioners interact with their clients and whether or not the practitioners can be viewed as effective allies of those implicated with the criminal process.  相似文献

This paper draws on a multi-year Australian collaborative study of mental health review tribunals ('MHTs') in three jurisdictions (Victoria, New South Wales and the Australian Capital Territory) undertaken in conjunction with the NSW Law and Justice Foundation, using qualitative and quantitative methods to examine the role of MHTs in advancing goals such as fairness, legality and access to treatment. Study findings regarding stakeholder and client concerns - about access to quality treatment and associated support services, review of treatment adequacy and drug regimes, and their 'participation' or dignity of engagement in review processes - are presented as variants of the need for adequate hearing 'space': temporal, jurisdictional, cognate/relational, physical and symbolic, and 'connective'. Building on earlier arguments for MHTs to engage not only legal, but also clinical and social domains, and for adopting some processes more characteristic of case-conferencing, this paper examines the implications of tribunal 'flexibility' and a wider overall 'governance' jurisdiction in mental health.  相似文献

Developments in medical science have sparked public debate about the legal and ethical implications of new technologies. Within these debates a number of distinct discourses are evident, including discourses about the positive and negative implications of technological advances, the influence of globalisation on regulatory choice, and the challenges of articulating common values in a pluralistic society. This article argues that teaching and learning methodologies used in undergraduate law degrees are gradually shifting. The traditional model relied on a largely standardised, “one size fits all” approach which assumed that developing legal reasoning through attendance at lectures and participation in tutorials and seminars would produce a successful lawyer. However, today’s law schools are adapting to a large and diverse body of law students, many of whom will move on to careers outside the legal profession. This is being recognised by an increasingly pluralistic approach within undergraduate legal education, aided in no small measure by a greater focus on skills. This article will discuss the theory of multiple intelligences, which rejects the idea of a single measure of intelligence and instead identifies a number of different intelligences with both biological and cultural underpinnings. It is argued that acknowledging these multiple intelligences and using them as an organising concept to vary and diversify teaching and learning methodologies could help to further avoid the “one size fits all” approach and enhance the student experience.  相似文献

The deployment of pervasive information and communication technologies (ICTs) within smart city initiatives transforms cities into extraordinary apparatuses of data capture. ICTs such as smart cameras, sound sensors and lighting technology are trying to infer and affect persons’ interests, preferences, emotional states, and behaviour. It should be no surprise then that contemporary legal and policy debates on privacy in smart cities are dominated by a debate focused on data and, therefore, on data protection law. In other words, data protection law is the go-to legal framework to regulate data processing activities within smart cities and similar initiatives. While this may seem obvious, a number of important hurdles might prevent data protection law to be (successfully) applied to such initiatives. In this contribution, we examine one such hurdle: whether the data processed in the context of smart cities actually qualifies as personal data, thus falling within the scope of data protection law. This question is explored not only through a theoretical discussion but also by taking an illustrative example of a smart city-type initiative – the Stratumseind 2.0 project and its living lab in the Netherlands (the Stratumseind Living Lab; SLL). Our analysis shows that the requirement of ‘identifiability’ might be difficult to satisfy in the SLL and similar initiatives. This is so for two main reasons. First, a large amount of the data at stake do not qualify as personal data, at least at first blush. Most of it relates to the environment, such as, data about the weather, air quality, sound and crowding levels, rather than to identified or even likely identifiable individuals. This is connected to the second reason, according to which, the aim of many smart city initiatives (including the SLL) is not to identify and target specific individuals but to manage or nudge them as a multiplicity – a combination of the environment, persons and all of their interactions. This is done by trying to affect the ‘atmosphere’ on the street. We thus argue that a novel type of profiling operations is at stake; rather than relying on individual or group profiling, the SLL and similar initiatives rely upon what we have called ‘atmospheric profiling’. We conclude that it remains highly uncertain, whether smart city initiatives like the SLL actually process personal data. Yet, they still pose risks for a wide variety of rights and freedoms, which data protection law is meant to protect, and a need for regulation remains.  相似文献

The Legal Education and Training Review (LETR) which reported in June 2013 conceded that undergraduate law degrees are generally outside the remit of the review other than when there is a direct impact on the provision of legal services. On first glance therefore the review has few implications for those of us interested in delivering a liberal legal education and developing socio-legal approaches to law and legal study. However, on closer reading, the report contains a number of suggestions which, if taken up by the regulators, have significant potential to change law degrees, even if regulation remains “light touch”. This article explores those issues with a particular focus on the implications for liberal law degrees and socio-legal approaches to law teaching. In particular the article will explore issues around possible changes to foundation subjects; the creation of a framework of learning outcomes; the possible strengthening of legal writing and research in the curriculum and the opportunities offered for the introduction of more socio-legal material; and the trickle-down effect likely to be felt by providers of undergraduate law degrees of changes in regulation of legal services and as a result of student, employer and other stakeholder expectations.  相似文献

This article seeks to examine the links that are often drawn between ``globalisation' and crime, particularly youth crime. Critical attention is focused on claims that rapid economic and social change leads inevitably and inexorably to higher levels of offending among the young. Such deterministic accounts may have the unintended consequence of contributing to the further problematisation of young people, leading in turn to calls for more control and surveillance of this ``problem population'. The article urges greater caution in the articulation of futuristic scenarios that link young people to an escalating ``crime problem'.  相似文献
