法律对屠杀问题的回应,始终在两种模式之间徘徊:一种是以国家刑法为给养来源的刑法上的敌人模式,另一种是源于国际刑法的刑法上的不人道模式。后者更适合屠杀的定性标准,它暗示了在大量死难者面前,对人性的否定。建立刑法上的不人道模式需要回应三个方面的问题:第一,罪的含义;第二,归责;第三,惩罚的实质。首先,根据《国际刑事法院规约》第7条,我们至少可以认为反人道模式中被保护的人性包含着两个相辅相成的要素:每个人的特殊性,以及每个人都平等地归属于人类共同体。其次,在归责问题上,我们不能满足于只制裁处于权力链条最顶端的人,还必须考虑等级体系的所有级别。最后在惩罚实质上,我们不仅要在刑罚制裁上考虑惩罚的本质,而且还需要从修复以及协商的角度看待这一问题。文章最后指出,刑法上的不人道模式成为一个可以实现的、普世的理想,尚需国际法与国内法的合作以及各个学科之间的协力。 相似文献

Measuring the Relationship Between Youth Criminal Participation and Household Economic Resources 总被引:2,自引:0,他引:2

Using data from the NLSY97, this paper re-examines the empirical relationship between household economic resources and youth
criminal participation. Previous estimates of this relationship have often suggested this relationship to be quite weak or
even non-existent. However, this analysis suggests that much of the strength of the relationship between household economic
resources and youth criminal participation may be obscured due to non-linearities in this relationship, the fact that this
relationship is isolated to crimes of a serious nature only, and especially because of measurement error with respect to measuring
household economic resources. I show that adjusting for these issues substantially increases the estimated strength of this
relationship. Indeed, the results in this paper show that the differences in serious criminal participation between youth
from households in the upper parts of the income distribution and youth from households in the lower parts of the income distribution
appear to be greater than the difference in serious criminal participation between genders.

Youth violence is a major public concern in all modern societies. To prevent this violence, we need to understand how innocent
young children grow into violent adolescents. Longitudinal studies of large samples of children from infancy to adulthood
indicate that the peak age for physical aggression is between the end of the second and the end of the fourth year after birth.
Fortunately, because of their size, physical aggression from two-year-olds does not constitute a major threat to the public
in general. It is also providential that most children learn to control these physically dangerous and socially disruptive
behaviours before they reach their maximum size. This natural course of development suggests that the preschool years are
the best window of opportunity to prevent the development of cases of chronic physical aggression. Safe streets probably start
with quality early education.

In a series of decisions issued between 2005‐2016, the United States Supreme Court relied on emerging scientific research detailing the developmental differences between children and adults to revamp its juvenile sentencing jurisprudence under the Eighth Amendment. The research established that youth’s developmental immaturity reduces their culpability for their criminal conduct, while also demonstrating their heightened capacity for change and rehabilitation. The Court focused on the most extreme sentences for youth, banning the imposition of the death penalty on youth under the age of eighteen in Roper v. Simmons (2005), and severely limiting the availability of life without parole sentences even for youth convicted of murder, in Graham v Florida (2010) and Miller v Alabama (2012). This article traces the Court’s evolution in reviewing sentences for youth in our justice system, and considers how the Court’s reasoning in these cases may influence further reforms in the justice system’s treatment of youth looking ahead. 相似文献

与大陆法系、英美法系均将刑法中的正当化行为置于犯罪构成体系之中的做法所不同的是 ,刑法中的正当化行为是游离于我国传统的耦合式犯罪构成体系之外的一个“活泼元素”。这样的关系 ,与现代刑事法治的精神不相契合 ,实有认真检讨和改进的必要。英美法系双层次犯罪构成模式为刑法中的正当化行为的纳入 ,尤其是超法规的正当化行为的充分展开 ,不仅提供了极其广阔的空间 ,而且因赋予其程序要件的色彩 ,从而突出强调了程序正义的价值 ,推动了宪法在刑事领域的司法化。因之 ,借鉴英美法系双层次犯罪构成的结构模式 ,吸纳我国传统犯罪构成体系中的合理成份 ,实现经验与理性的沟通 ,应当成为改造我国传统的耦合式犯罪构成体系的努力方向。 相似文献

Constructing Women Who Experience Male Violence: Criminal Legal Discourse and Individual Experiences

This article examines the relationship between how women who experience violence from a male partner construct themselves,
and how criminal legal discourse constructs female victims of violence. It is argued that in both arenas, women are constructed
according to norms which emanate from a discourse of conventional femininity which operates together with a practice of shame.
Utilising empirical data gained from qualitative interviews with women who experienced male violence, the article contends
that the construction of the female victim of violence in criminal legal discourses as imbued with stereotypical ‘feminine’
characteristics such as passivity and weakness, may influence these women’s own construction and understanding of themselves.
The existence of a practice of shame further consolidates the self-regulation of the women themselves to these norms of femininity.
This construction is posited to be problematic as the experiences of women of male violence rarely ‘fit’ within these explanations.
The article contends that in order to better understand women’s experiences of male violence; both criminal legal and individual
women’s discourses need to be read in terms of the power, knowledge and effects which they exert upon individual women. It
is argued that this alternative reading of these discourses has the potential for transformation as they are invested in the
subject.

Although the devastation was immediately apparent, the effects of Hurricane Katrina on the behavior of youth are just now
being revealed. Much post-disaster research targets adjustment of adults, but ample evidence indicates that youth experience
a variety of psychological symptoms following a disaster, including depressive symptoms, aggression, and symptoms of posttraumatic
stress. The aim of the current study was to determine whether hurricane exposure serves as a risk factor for developing conduct
problems among violence-exposed youth. Results indicate that hurricane exposure had differential effects on the relations
between conduct problems and community violence versus corporal punishment in the home. Though not statistically significant,
there was an unexpected trend for youth with high hurricane exposure to show decreased conduct problems and those with low
hurricane exposure to show increased conduct problems as violence exposure increased. Hurricane exposure played the predicted
role in the relation between corporal punishment and conduct problems, such that high levels of hurricane exposure predicted
increased conduct problems among youth experiencing high levels of corporal punishment, but not among those experiencing low
levels of corporal punishment. Implications for future research and practice are discussed. 相似文献

我国检察机关目前对于民营企业犯罪探索建立的刑事合规制度具有积极的社会引导意义,但在发端背景、合规互动结构、案件适用范围、法源及合规强度等方面存在不足,可能影响刑事合规的适用效果。通过改造我国刑法中关于单位犯罪归责原理的路径来达到刑事合规扩大适用是不经济的。我国民营企业的刑事合规建设需要避免合规概念的泛化,通过区分犯罪类型、细分企业规模及控制合规成本等方面的细致设计来激发企业建立合规体系的内驱力。外部监管方面应通过更新监管理念来获得行政监管机构对企业合规建设的协同,可以试点先行延长合规考察期限。 相似文献

Environmental offences often have rather obscure victims. At the same time, we know that those crimes commonly regarded as the most serious have clearly visible victims. It is difficult for people to relate to environmental offences in the same way as many traditional crimes, and this makes it easier to commit breaches of the environmental regulations. One element in a control strategy ought therefore to be continuous attempts to discover really serious environmental crimes that are easily communicated to the public. Regulations are followed if we believe that others also do so. If we have a sense that cheating is widespread then group solidarity is weakened, and with it the inclination to abide by the rules. How then do individuals and businessmen develop the perception that control measures are working? This happens primarily by means of a perception that observance of the regulations is being monitored. Broadly based control measures and contacts are therefore of considerable importance. By means of risk assessment procedures, interventions can then be concentrated where they are judged to be most necessary. A broad arsenal of measures is needed to persuade companies to observe the regulations; an arsenal from big stick to little stick, from self-regulation and service to administrative sanction charges and criminal offences. 相似文献

刑法拟制的本质是对法律效果的拟制,是对A类型的事实适用A罪的构成要件进行评价,但适用B罪的罪名和法定刑定罪量刑——既不是对事实要素的假定而将A类型的事实认定为B类型的事实,也不是为B罪创设一种新的犯罪构成。除了窝藏赃物型抢劫罪等少数条款具有拟制的正当性之外,其他拟制条款均不具有正当性,应当尽快废除。根据条文规定的明确程度以及可解释为注意规定的余地大小,可以将刑法学界通常所认为的刑法拟制划分为明文规定的拟制、比较明显的拟制、形似的拟制、解释的拟制四种类型,由于大多数“拟制”条款都存在违背罪刑法定、实质正义和责任主义等问题,因而应当将形似的拟制和解释的拟制解释为注意规定,以尽量缩小刑法拟制的条款范围。 相似文献

我国理论通说和司法实践在认定单位犯罪时习惯以自然人的行为和意志为关联和前提,这种个体主义的思路存在诸多缺陷。单位既不能被还原为单个的自然人,也不是自然人的简单集合,组织结构、管理制度、经营方式等客观因素是单位的重要组成部分。单位具有独立的意志和刑事责任。需以整体主义的视角判断组织体罪责,单位犯意仍需区分故意与过失。单位故意是个体在单位内的决策机制或默认规则之作用下最终形成的意志,既有自然人意志的主观色彩,也深受单位客观因素的影响。从整体上把握单位的决策机制、管理制度的政策倾向、管理运营的惯常模式可以帮助认定单位故意。 相似文献

Orders of protection help combat dating violence by ensuring a period of separation between the victim and the abuser. The prevalence of dating violence is similar to that of spousal abuse and the effects on the nonmarried victims are just as severe. Some jurisdictions in the United States do not offer victims in dating relationships protective orders and two states restrict orders for same‐sex couples only. Other state statutes are inadequate. A uniform statute that permits participants in dating relationships access to protective orders should be implemented across the country.

Past research has identified many potential advantages of civil protection orders as a means of addressing domestic violence
without invoking an official response of the criminal justice system. Using data from a Midwestern county, this exploratory
study provides a comparison of civil protection orders with orders of protection that are filed in conjunction with a criminal
battering arrest. We examine the demographic characteristics of the respondents/defendants and petitioners/victims, the nature
of the abuse leading up to the filing of the protection order, the reasons for filing, the terms of the order, location of
the offense, and violations of orders. Our findings reveal many similarities between types of orders, in terms of order stipulations,
past abuse histories of petitioners/victims, and respondents/defendants’ likelihood of reoffending. The findings also reveal
an important difference in the petitioners’ and victims’ reasons for filing; whereas petitioners in civil cases were more
likely to identify emotional abuse as the factor leading up to issuance of the order, victims in criminal cases were more
likely to document physical abuse. We discuss these findings in the context of victim preference. 相似文献
