市检察院日前作出规定：保障律师在检察环节的执业权利

会见当事人难、阅卷难、调查取证难，一直是困扰律师执业的三大难题。为保障律师权利，维护司法公正，市检察院近日已转发高检院《关于人民检察院保障律师在刑事诉讼中依法执业的规定》，从而进一步强调和保障律师在检察环节的执业权利。     

刑事辩护律师面临哪些执业风险

律师在现代法治社会的构建中起着不可替代的作用,然而在我国现行的刑事辩护机制中,辩护律师面临着执业风险、压力增加等诸多难题,这严重影响了律师功能的发挥。要从根本上化解辩护律师的执业风险,必须完善对刑辩律师权利的保障措施,赋予律师一定的职业权利。     

建立我国律师刑事辩护豁免权制度的构想

自我国《刑法》、《刑事诉讼法》、《律师法》修改以来,律师因刑事辩护而遭无端刑事追诉的情形时有发生。面对我国因律师刑事辩护豁免权立法缺失致使律师执业屡遭不测的现状,笔者在考察国外相关立法例的基础上,对我国建立律师刑事辩护豁免权制度的必要性和可行性进行探讨,并提出建立有中国特色的律师刑事辩护豁免权制度的初步构想。     

司法改革视阈下检察机关保障律师执业权利研究

作为法律职业共同体的重要组成部分,检察机关和律师对维护社会公平正义担负着共同使命。深化律师执业权利保障是检察机关构建新型检律关系之需。客观分析律师执业权利的现状,清醒认识当前检察机关对律师执业权利保护存在的问题,并提出有效措施,才能使律师在从事法律事务工作中获取与其相匹配的权益。

1978年,五届全国人大通过的《中华人民共和国宪法》中刑事辩护制度的恢复,标志着“无法无天无律师”时代的结束,同时也吹响了重建中国律师制度的号角。在接下来的短暂而又漫长的30年间,中国律师制度伴随着中国社会主义法治进程成长和成熟着。13万中国律师也在“会见被告难、调查取证难,阅卷难”的执业“三难”问题的困扰下,在司法“潜规则”和执业冲突中奋力突围,并且作为一股新兴的民主化法治化力量而崛起。回顾中国律师制度恢复后30年走过的历程,我们完全可以这么说,中国律师不仅见证着中国的法治进程,而且完善着中国的法律制度,同时也聆听着中国法治进步的足音。     

论律师辩护责任与权利之角逐和转变

尽管《刑事诉讼法》于2012年作了较大的修改,但依旧存在大量语言不规范、逻辑不通顺的地方。刑诉法第35条规定了辩护律师的责任。"责任"一词因具有明显的道德审判色彩,同时也无法体现律师与当事人依据代理契约产生的权利义务关系,也更无法体现律师代表当事人与国家公权力一方博弈的理论基础。我们认为,应将刑诉法第35条中的"责任"改为"权利",以严谨法律之表达,保障律师在刑事诉讼中的执业权利,更好地维护犯罪嫌疑人、被告人的诉讼权利。
