Forensic Application of Analytical Mechanics in Fatal Fall From a Height

Fatal fall from a height initiated with a swinging motion on the sagittal plane of the victim's body is examined. Method of analytical mechanics is adopted to establish the functional relations between the swinging angle of the body and the force needed to sustain the body until release, and the amount of the horizontal displacement that would occur after release. The analysis is applied to support an expert opinion presented in a criminal court in which two accused were convicted of murder for dropping a female victim from a bridge. The results indicate that it is unlikely for the body to locate as recorded by the police investigation report in the case. This study demonstrates that a straightforward mechanical analysis can be utilized to examine uncommon falling scenarios.     

Assessing the Performance of the Price Cap Plan for Local Exchange Carriers in the United States

In 1991 the FCC implemented a price cap plan for local exchange carriers' interstate access service designed to deal with the regulatory boundaries problem arising from the breakup of AT&T in 1984. The experience with the price cap plan demonstrates the difficulty of predicting productivity growth accurately and makes clear that regulators cannot depend upon a pure price cap plan to keep prices within a reasonable range of costs. With periodic reviews to readjust plan parameters, however, a price cap plan can maintain the rate-of-return close to the target rate-of-return without diminishing the price cap plan's incentives for efficient production. A simple method of recalculating the X-factor based on the rate-of-return over the previous three years worked well in simulations. If this procedure had been used over the price cap period 1991 to 2000, prices would have been 20 percent lower and expenditures on LECs' telecommunications service subject to a price cap would have been $3.8 billion lower.     

Zur Berücksichtigung des Denkmalschutzes im Bundeswaldgesetz

Die von Deutschland nach Art. 59 Abs. 2 GG ratifizierten europ?ischen und internationalen übereinkommen zum Denkmal- und Kulturgüterschutz müssen in nationales Recht transformiert werden. W?hrend die L?nder im Rahmen ihrer Kompetenz (Art. 30, 70, 83 GG) Denkmalschutzgesetze erlassen haben, hat der Bund in einschl?gigen Gesetzen wie dem Bundeswaldgesetz den Denkmalschutz bisher nicht berücksichtigt. Dabei ist bei einem Waldanteil von 30% der Wald mit seinen historischen Kulturlandschaften und seinem Waldboden als Archiv der Natur- und Kulturgeschichte von besonderer Bedeutung. Da Deutschland 60 Jahre nach Kriegsende endlich auch ausdrücklich ein Kulturstaat werden soll, ist es an der Zeit, dass die Belange des Denkmalschutzes auch im Bundeswaldgesetz (z.B. §§ 1, 2, 9 oder 11 BWaldG) berücksichtigt werden. Einige Verpflichtungen zum Denkmal- und Kulturgüterschutz sind heute ohnehin bereits V?lkergewohnheitsrecht (Art. 25 GG).     

Cumulative career traumatic stress (CCTS): A pilot study of traumatic stress in law enforcement

The present study measured the existence of traumatic stress symptomatology as reported by certified law enforcement officers within the State of Delaware. A questionnaire was devised which documented age, sex, race, education, years of service, marital status, children, rank, position, and shift work. The questionnaire was divided into parts which assessed the exposure and the frequency of specific traumatic incidents experienced in the line of duty, and the frequency of experienced traumatic symptomatology criteria: re-experiencing, numbing, and arousal.     

The differential impact of state finance on the Romanian party system

This article explores the influence that state finance has had on the Romanian party system by examining the entry and exit of parties throughout the period of 1990 – 2004 and focusing on the number of parties that gained representation in the parliament as well as the party incumbency rate. I find that state finance has had a limited influence on the party system as a whole but has been influential for specific parties. I argue that the influence of state finance partly depends on when the system was introduced. In developing party systems, the influence of state finance on individual parties is more differential.     

Eingriff in naturschutzrechtliche Kompensationsflächen durch nachfolgende Vorhaben

Der folgende Beitrag befasst sich mit Rechtsfragen, die sich bei einer Inanspruchnahme von naturschutzrechtlichen Kompensationsfl?chen im Sinne von § 19 BNatSchG durch ein sp?teres Vorhaben ergeben k?nnen. Im Mittelpunkt der Betrachtung steht das Verh?ltnis der Kompensationsverpflichtungen der Vorhabenstr?ger. Der Autor spricht sich dafür aus, dass in bestimmten Konstellationen die Kompensationsverpflichtung des Ersteingriffverursachers endet und an ihre Stelle die Kompensationspflicht des Tr?gers des zeitlich nachfolgenden Vorhabens tritt.     

The Economics of the “Final Solution”*

The economics of the Holocaust is a many‐facetted subject that is an integral part of the Holocaust's history. This paper describes some of the results of the new research since 1990 and discusses the economic rationalities employed by the perpetrators in despoiling the Jews. Economic considerations accompanied the timing and pace of the expropriation of Jewish assets and their “Aryanization.” The new research also shows that there was widespread collaboration in the expropriation of the Jews by private interests both inside Germany and in German‐controlled Europe and that networks of bureaucrats and private interests joined to achieve Nazi goals. The combination of expropriation and mass murder was one of the aspects of the Holocaust that made it unique.     

RACIAL–ETHNIC INTOLERANCE AND SUPPORT FOR CAPITAL PUNISHMENT: A CROSS-NATIONAL COMPARISON*

This article tests cross-nationally the minority group threat thesis that public sentiments toward repressive crime-control policies reflect conflicted racial and ethnic relations. Using multiple data sets representing France, Belgium, the Netherlands, East and West Germany, Italy, Luxembourg, Denmark, Great Britain, Greece, Spain, Finland, Sweden, Austria, Canada, Ireland, and Portugal, we examine whether racial and ethnic intolerance—animus, resentments, or negative sentiments toward minorities—predicts greater support for the death penalty. Our results reveal that the respondents were significantly more likely to express support for capital punishment if they were racially or ethnically intolerant while controlling for other covariates of public opinion. These findings indicate that the link between support for capital punishment and racial and ethnic animus may occur universally in countries with conflicted racial and ethnic relations.
