Umweltschutz und EG-Wettbewerbsfreiheit vor dem Hintergrund nachhaltiger Entwicklung

Der Konflikt zwischen Umweltschutz und Wettbewerbsfreiheit ist ein altes Thema, das aber st?ndig in Bewegung ist. Neue Aspekte ergeben sich aus dem beide Elemente verbindenden Grundsatz der nachhaltigen Entwicklung und den aktuellen Leitlinien der Kommission.

Security, Capacity and Post-Market Reforms: Public Management Change in 2003

Public sector change in 2003 was a product of external demands and internal pressures for improvement. The specific areas addressed are responses to security threats in the international environment; strengthening internal capacity, particularly through whole-of-government approaches; and fine-tuning the public management model in part through readjustments to the centre-agency relationship and greater emphasis on horizontal structures and processes.
This is the ninth year an administrative essay has been published in the journal since 1996. Earlier chronicles include: J. Stewart 55(1) 1996; S. Prasser 56(1) 1997; J. Homeshaw 57(3) 1998; J. In this issue two chronicles are published — the first, by John Halligan and Jill Adams, focuses on external security and internal capacity building. The second assessment by Scott Prasser takes a different view of compliant management, poor decisions and reactive change.

Project USA: American competitiveness and what must be done to restore it

The United States today faces a loss of influence as a world power, a reduction in American independence as a policymaker, and a decline in the standard of living on which Americans have come to depend. History teaches that nations weaker and less productive than the United States can rise to become economic powerhouses and rapidly increase their standards of living. History also teaches that nations failing to recognize their fundamental problems will inevitably decline. American politicians must face what is abundantly clear: the United States is losing ground and must act quickly to reverse its course. This White Paper outlines what must be done. Information about the nation's current status must be analyzed and communicated. Incentives to improve the level of competence in government must be provided and maintained. The emphasis of government policy must be changed to reflect broad economic and technological interests as opposed to special interests. Savings must be encouraged and increased. Infrastructure must be improved Tax laws must be modified to help bring these changes about. Economic and technological issues must be elevated to the importance they require. American thinking must reflect the new realities: that the age of leadership through military power is over, that the requirements for success in the world of the 1990s and beyond require a sound and growing economy that is internationally competitive. The US can accomplish these goals only through foundation-shaking, comprehensive, fundamental changealong the lines we propose herein.This paper is the executive summary (with minor editing modifications) of a white paper that is available from Cornell University's Johnson Graduate School of Management.     

Bodenschutz außerhalb der Bodenschutzgesetze – der Beitrag des Naturschutzrechts

Den Gründer und langj?hrigen Hauptschriftleiter Claus Carlsen hat seit vielen Jahren das Naturschutzrecht in all seinen Facetten interessiert. Der Gegenstand des Naturschutzrechts, der nach der subjektiven Beobachtung des Verfassers dieser Zeilen als Hauptgegenstand des Naturschutzrechts betrachtet zu werden scheint, ist der Schutz, die Pflege, die Entwicklung und die Wiederherstellung der Tier- und Pflanzenwelt, § 1 Nr. 3 BNatSchG. Dieser Beitrag m?chte den Blick auf ein anderes Ziel des Naturschutzes und der Landschaftspflege lenken: auf den Naturhaushalt nach § 1 Nr. 1 BNatSchG und dessen Bestandteil: den Boden.
