Turkey’s humanitarian and development intervention in Somalia is unusually illuminating as a case study to investigate the relations between emerging and conventional interveners in conflict zones since, in this case, Turkey’s intervention carries adequate impetus to resist assimilation with conventional North/Western counterparts. Our starting point is the observation that Turkish and conventional humanitarian and development interveners have struggled to coordinate or cooperate in Somalia. This article investigates what this uncooperative and uncoordinated organisational behaviour means, and we root our investigation in 21 face-to-face interviews with officials working inside the Turkish and conventional intervention in Mogadishu and Nairobi to inquire about how they understand and theorise this discordant behaviour. We use a parsimonious analytical framework of trustworthiness that questions the ‘ability’ and ‘integrity’ of counterpart organisations to explore the intentions behind organisational behaviours. Our analysis of interview narratives evidences challenges to conventional methods of intervention by Turkish organisations and the protection of the same by North/Western organisations. Our concluding discussion interprets these findings in relation to consequences for the status quo hierarchy of global governance and its promotion of liberal intervention norms, and for the utilisation of securitised and remote-control intervention methodologies in conflict zones such as Somalia.  相似文献

The purpose of this study was to identify sociodemographic, contextual, situational, and individual variables, as well as certain behavioral warning signs, associated with filicide as a function of sex of the agressors and the presence or absence of self-destructive behaviours. The data cover all officially registered filicides committed in Quebec from January 1, 1986, to March 31, 1994, against youths under the age of 18 years. For the group of individuals who have self-destructive behaviours, results indicate that men compared to women are more likely to commit spousal homicide, to kill a higher number of victims, to be going through a conjugal separation, to have committed conjugal violence, to have threatened suicide, and to have threatened to kill their spouse. For the group of individuals who commit no self-destructive acts, women are more likely to present with a depressive disorder, whereas men are more likely to maltreated their children. Men who do not commit a self-destructive act are characterized by a significantly higher likelihood of maltreatment against their children and of tyrannical discipline, whereas men who commit a self-destructive act perpetrate filicide as a means of reprisal against their spouse. Results underscore the importance of considering the different groups of individuals who commit filicide as a function of sex as well as presence or absence of self-destructive behaviour.

How is the doctrine of ministerial responsibility applied in the decisions of German ministers (not) to resign? This question arises from an empirical puzzle as well as from a theoretical contradiction. Despite the prominent principle of ministerial responsibility, empirically, the ‘personal consequences' of ministerial scandals in their area of responsibility, display a large variance. Some ministers resign because of rather trifling affairs, others stay in office in spite of serious scandals. Taking into consideration the delegation relationship between the executive and the parliament, in view of the principal‐agent theory, a minister's resignation due to major political or personal misconduct is to be expected. On the other hand, the actual constitutional configuration of ministerial responsibility casts theoretical doubts on the ministerial loss of office. The quantitative analysis of 133 resignation issues in the years 1949 to 2009 reveals that ministerial responsibility bears no relevance to the decision whether to resign or not. Indeed, when the cause of the resignation issue is directly connected to ministerial responsibility, the probability of a resignation even decreases.  相似文献

Here we present the results of the 2009 Paternity Testing Workshop of the English Speaking Working Group of the International Society for Forensic Genetics. The exercise included paternity testing of blood samples from a mother, a child and two alleged fathers. The laboratories were encouraged to answer questions concerning their laboratory routines and a paper challenge was distributed in order to compare statistical calculations. A total of 62 laboratories participated. The laboratories used a total of 49 autosomal STRs and PCR-investigated VNTRs, 19 Y-chromosomal STRs, 8 X-chromosomal STRs, 7 VNTR systems investigated with RFLP, 49 autosomal SNPs and 11 mtDNA SNPs. Does Duncan Kennedy successfully cannibalize jurisprudence? He attempts to do it by demonstrating the inexistence of rightness in legal argumentation. If there is no right legal argument, then there is no right answer in adjudication, adjudication is not a rational enterprise and legal doctrine cannot be said to be a science. It can be shown that skepticism is self-defeating. Duncan Kennedy can avoid self defeat only because he actually believes in a lot of legal arguments. His thesis that judges decide questions of policy without any methodology that distinguishes them from legislators does not hold. Judicial reasoning is subject to constraints that do not affect legislators. It must be based on the sources of law and is limited by rules of procedure. Even when the judges have ‘interstitial’ legislative powers they are, unlike the legislator, bound to fit the system and their decisions are considered in procedure from the perspective of the right answer doctrine. The only work that can convincingly refute the skeptic argument against legal science is the reconstruction of jurisprudence as a scientific enterprise. Such work is beyond the scope of any single paper. The article aims to give some inspirations for such a task.  相似文献

This article concerns migrant domestic labour. It departs from existing analyses of such labour by examining the place of workers' mobility and workers' intimate life histories in the valorisation of migrant domestic labour. Drawing on insights from the literature on the autonomy of migration and on affective labour, this article argues that migrant domestic workers' status as mobile bodies infused with affective histories of maternal care is critical in the constitution of a market for their labour. This history endows migrant domestic workers' labour with unprecedented value, not least because the worker is expected to exude the affects of motherhood authentically in the home of her employer. The analysis forwarded here demands a new understanding of the operations of global care chains and transnational motherhood.  相似文献
