Fatal fall from a height initiated with a swinging motion on the sagittal plane of the victim's body is examined. Method of analytical mechanics is adopted to establish the functional relations between the swinging angle of the body and the force needed to sustain the body until release, and the amount of the horizontal displacement that would occur after release. The analysis is applied to support an expert opinion presented in a criminal court in which two accused were convicted of murder for dropping a female victim from a bridge. The results indicate that it is unlikely for the body to locate as recorded by the police investigation report in the case. This study demonstrates that a straightforward mechanical analysis can be utilized to examine uncommon falling scenarios. 相似文献
This study was an attempt to replicate the findings from an earlier experimental evaluation of a probation officer training program by Bonta et al. (Criminal Justice and Behavior, 38: 1127–1148, 2011). An experimental design was used with an improvement in the random assignment of clients and was tested with a sample of probation officers from a new jurisdiction.
Methods
Probation officers from the Canadian province of Alberta were randomly assigned to training or probation-as-usual. Officer behavior was measured by audio recordings of supervision sessions and recidivism was defined as a new conviction within 2 years of the initial recording. Attrition resulted in 27 probation officers submitting audio recordings of supervision sessions over a 6-month period (15 in the experimental group and 12 in the control). There were 160 recordings of 81 probationers submitted.
Results
The audio recordings showed inconsistent changes in officer behavior and no differences in recidivism between the clients of the experimental and control probation officers. However, the use of cognitive techniques by the probation officers was associated with a longer time to recidivism. In addition, by 10 months, more than half of the trained officers stopped their involvement in ongoing professional development activities.
Conclusion
Although the study failed to replicate the major findings reported by Bonta et al., it did highlight the importance of cognitive techniques in officer training. The results are interpreted with respect to the replication literature and the difficulties inherent in direct and conceptual replications especially in real-world settings.
ABSTRACTRecently, “problem-solving” courts have been developed as an alternative to imprisonment. They are often called “specialty” courts because they process and divert into treatment programs offenders who are seen as different from the general criminal population, such as those with mental health or drug problems, those who are homeless or veterans, and those who engage in domestic violence. Based on a 2017 national survey of 1,000 respondents, the current study examines overall public support for rehabilitation as a goal of corrections and then focuses specifically on support for different types of specialty courts. The analysis reveals that the American public endorses not only the rehabilitative ideal but also the use of problem-solving courts. Further, with only minimal variation, strong support for these courts appears to exist regardless of political orientation and sociodemographic characteristics. 相似文献
Qualitative interviews with one hundred defendants in Dutch criminal cases examine whether perceived procedural justice is a relevant concern for defendants, and, if so, which procedural justice components they refer to. The study provides a point of epistemological departure from the quantitative studies dominating the field, as it assessed which components of procedural justice (if any) respondents put forward themselves rather than asking about predetermined procedural justice components. The large majority of respondents mentioned procedural justice issues themselves, and six components were at the core of their procedural justice perceptions: (1) information on which decisions are based, (2) interpersonal treatment, (3) due consideration, (4) neutrality, (5) voice, and (6) accuracy. Although these procedural justice components largely correspond with the literature, respondents thus mentioned some components more often, and others less often, than the literature would suggest. This paper describes several dimensions of the cost of the U.S. response to the threat of terrorism. Following an evaluation of the nature and magnitude of the threat of terrorism against the United States, the paper describes the restrictions on our civil liberties, the fiscal and other costs of the major homeland security measures, the fiscal cost of programs that make no contribution to the defense against terrorism but are rationalized on that ground, and the effects on our language and the potential for civil discourse of an extended defense against terrorism. 相似文献
In the early 1970s, Grand Canyon National Park intended to designate its land to “Wilderness,” including the controversial Colorado River corridor. However, by the end of the 1970s the potential for Wilderness designation was off the table, and would never seriously return for genuine consideration. Using Schattschneider's model of conflict, we explain how the organization of this conflict privileges the “causal story” of Wilderness opponents, and therefore why the canyon is not designated. It is our contention that members of Congress will not stand forward to support Wilderness designations without simultaneously providing benefits for extractive land use because (1) congressional representatives are more penalized for supporting than opposing Wilderness designations, (2) Wilderness advocacy groups do not pressure congressional delegates as firmly as opposition groups, and (3) key local congressional members are not likely to see Wilderness as a salient issue worth the risk of negative exposure. If these findings hold, the implication is that we may have reached the end of significant Wilderness designations in highly visible areas, unless critical aspects in land use conflict change. 相似文献
This article examines the effects of negotiation practices, such as coercion and contract formality, on how suppliers and customers perceived the resulting business relationship. We conducted a purchasing negotiation simulation with students in a classroom setting in which participants competed for resources in a mock supply-chain context. The participants were surveyed at key stages of the ongoing negotiation in order to measure their behaviors as a customer–supplier relationship developed. The data were used to test several hypotheses developed from the marketing and purchasing literature. The hypotheses were analyzed using structural equation modeling. Results demonstrated that the use of coercive techniques by negotiators during negotiation had a negative effect on satisfaction. In addition, the findings showed that, as expected, negotiators entering a negotiation with a cooperative orientation would tend to avoid the use of coercive practices during negotiation. The cooperative orientation also exhibited an unexpected positive effect on the formalization of the design of the contract between the parties. This study contributes to the current knowledge base focusing on the creation of agreements between companies and will, we hope, encourage the integration of suppliers and customers in an operating context within a supply-chain setting. 相似文献
