In October 2014, the Chinese Communist Party committed to the establishment of a “socialist rule of law with Chinese characteristics.” Since then a group of Chinese political elites that we refer to as new legalists has been calling for ethnic conflict to be managed in accordance with the rule of law. This article finds that the deeply embedded and highly politicized problem of ethnic conflict in China lends credence to the legalist position that new law-based approaches are needed, although a number of practical problems arise when attempting to strengthen the rule of law. There are for instance powerful factions in the country supporting the continuation of repressive policies or selective ethnic preferentialism, and there are relatively low levels of legal awareness in ethnic-minority communities and general inadequacies in the Chinese legal system. We argue that an elite group of new legalists in China is attempting to reshape ethnic-minority policy in order to break free from the everyday protean politics of ethnic relations that is based largely on a negative cycle of violent confrontation and financial compensation.  相似文献

The juvenile justice system can process youth in myriad ways. Youth who are formally processed, relative to being informally processed, may experience more public and harsh sanctions that label youth more negatively as “deviant.” Drawing on labeling theory, the current study evaluates the relative effect of formal justice system processing on the interpersonal dynamics of youth peer networks. Using data from the Crossroads Study, a multisite longitudinal sample of first-time adolescent offenders, the current study applies augmented inverse probability weighting and generalized mixed-effects models to estimate the effects of formal processing on friendship selection processes of homophily and withdrawal and considers whether these effects vary by race and ethnicity. Consistent with expectations of homophily, formally processed youth acquire more new deviant peers and fewer nondeviant peers during the 3 years after their initial processing decision compared with informally processed youth. The findings suggest no differences exist across processing types in withdrawal from friends. These effects were consistent across racial and ethnic groups. Ultimately, this study explores the dynamic interpersonal mechanisms associated with labeling theory and offers additional insight into the negative effects of formal processing.  相似文献

The addition of information regarding obesity status to the forensic anthropological biological profile could significantly contribute to the identification of human skeletal remains since over 40% of the U.S. adult population is currently obese. This study examines the differences in talar shape and trabecular bone structure between obese and non-obese individuals. A sample of 20 obese and 20 non-obese divided evenly by sex was selected from the Texas State University Donated Skeletal Collection. Tali were imaged using x-ray computed tomography (voxel size: 28–38.7 μm). Image stacks were processed to produce binary images as well as trabecular thickness and spacing maps. Landmark-based geometric morphometric analyses were conducted to quantify shape variation. Shape coordinates were used to locate 100 geometrically homologous volumes of interest within each talus. Bone volume fraction, trabecular thickness, and trabecular spacing were extracted at each volume of interest. Within each sex, a one-way ANCOVA was used to determine if significant differences exist between obese and non-obese individuals in trabecular bone after controlling for age. The size of the talus as well as subtle aspects of shape were found to distinguish the sexes. The results further indicate that bone volume fraction significantly differs between obese and non-obese males. In females, bone volume fraction is correlated with age but does not differ between obese and non-obese. The study demonstrates that bone microstructure is a promising approach to estimating body mass or body mass index category but age effects diminish the potential for the talus to be used alone.  相似文献

The opioid epidemic, impacted from the proliferation of fentanyl, has added impetus to the need to detect fentanyl, sources of fentanyl, and places where fentanyl and drugs adulterated with fentanyl are available. Many darknet marketplaces (DNMs) have rules that ban fentanyl. However, it is unclear how these affect the fentanyl market. Using the AlphaBay DNM as a case study, we conducted mixed methods qualitative research. We scraped and analyzed data from the AlphaBay I2P website using, among other methods, content and social network analysis, to uncover hidden fentanyl networks. Our research highlights the next evolution of darknet marketplaces – the migration of DNMs from Tor to I2P and the methods that can be used identify fentanyl networks, irrespective of where sites are: I2P, Tor, or multihomed on I2P and Tor. Despite its ban in the Global AlphaBay Rules, our research revealed the sale of fentanyl on the AlphaBay DNM. Unlike previous studies, our findings predominantly revealed the covert sale of fentanyl on AlphaBay and predatory vendors selling illicit drugs, which unbeknownst to buyers, contained fentanyl. To a lesser extent, our findings identified the overt sale of fentanyl patches on AlphaBay. Although we examined only one DNM, the prevalence of the covert sale of fentanyl and the presence of predatory vendors underscores the importance of research that decodes the language of vendors who surreptitiously sell fentanyl or drugs adulterated with fentanyl or other illicit substances. The results of our research can inform strategies aimed at disrupting and dismantling DNM fentanyl networks.  相似文献

LGBTQ youth are largely overrepresented in the child welfare system. The experiences of LGBTQ youth have largely been overlooked. LGBTQ youth often encounter a number of challenges and disparities as they navigate the child welfare system. Many report experiences of discrimination, marginalization, and an overall lack of acceptance. The permanency and placement options have historically been limited for many LGBTQ youth, often leading to an over reliance on congregate settings and aging out of foster are. The current article provides a synthesis of the existing research on the experiences and outcomes of LGBTQ youth in care, as well as an exploration of the policy and practice initiatives aimed at creating a more inclusive system of care.  相似文献

How may professionals be made to contribute to legislative processes so that their expertise redounds to the public interest, despite the legislative product being likely to have a negative impact on their clients' wealth? Drawing on a case study of the legislative process that gave birth to Israel's recent (2002–2008) trusts taxation regime, based on five years of participant observation among the trust professional community, I find that to obtain the benefit of private‐sector professionals' expertise under such circumstances, government should have legislation drafted in a dispassionate, exclusive environment of experts rather than in the political arena; it should build professionals' trust in government by adopting an explicitly collegial approach; it should focus reform efforts on elements of the existing law so clearly inequitable as to make a refusal to contribute difficult to justify; and take care that the new regime creates a compliance practice lucrative enough to compensate for any loss to professionals consequent on its enactment. Once professionals' interests are suitably safeguarded, their loyalty to clients appears surprisingly brittle and government can successfully combine with them in the public interest.  相似文献

The enormous success of local independent lists and independent mayors in Poland suggests it is important to examine their distinctive features, analyse the place they occupy in local politics, and explore the model of local government they encourage. This paper deals with these topics by investigating some extreme cases of non-partisanship at the local level. Research was conducted in three arbitrarily chosen Polish cities governed by independent mayors and dominated by independent lists in the local legislatures. Mixed quantitative and qualitative methods were used: a survey among city councillors; and individual key-informant interviews (IDI). Non-partisans appear to be a separate category of local politicians, different in terms of their views on politics. They explain their non-partisanship using anti-partisan, historical or tactical justifications. It seems that non-partisanship can be a means of institutionalising a particular manner of understanding and engaging in politics. Local lists organised by independent mayors are informal, concentrating on the leader and performing only some of the traditional functions of parties. This paper demonstrates that, due to the vague nature of the links between local politicians and their administration, independent councillors may serve only as a ‘democratic addition’ to a local administration headed by a skilful manager.  相似文献

The paper compares political ideas and acts in the Soviet Union under Gorbachev and in Communist Vietnam. It argues that the Gorbachev group, committed to progressive change, concluded that power granted to them by their position in the Soviet system needed to be eliminated, creating a ‘boot strap’ problem. To secure progressive change they had first to destroy their own power base. By contrast, the ruling Vietnamese Communist Party (VCP) attempted, in the two decades after the emergence of a market economy in 1989–1991, to rule an increasingly open society through Soviet political institutions. By the late ‘noughties’ Vietnam faced a crisis of domestic sovereignty, with politics largely a matter of spoils, with policy largely irrelevant and unimplementable, and usually blocked by powerful interests. The paper argues that Hinsley's notion of the sovereignty issue makes this situation far easier to analyse. It argues that the Gorbachev group's analysis would have led to them predicting that the VCP's attempt to use Soviet institutions to rule over a globalising and increasingly open society with a market economy would lead to a crisis of political authority, and that they would have been correct. This leads to the counter-intuitive position that the Communist Party of the Soviet Union was a success ? in that it managed to solve a serious political problem, i.e. how to create the preconditions for a political system suited to a market economy in a relatively open society – and the VCP a failure.  相似文献

Abstract

This article explores Die Antwoord's blackface politics to question whether the concept of citizenship has any value in a context where marginal artists’ attempts to represent themselves on their own terms are overshadowed by the global reach of corporate entertainment media monopolies, and by the legacy of racism and sexism in the music industry. It analyses the work of Die Antwoord, Lupé Fiasco and Angel Haze to contend that global capital undermines the nation-state's ability to secure its citizens’ economic or cultural interests. Using Michael Hardt and Antonio Negri's concept of Empire, the author argues that corporate globalisation undermines the sovereignty of the nation-state, effectively compromising democratic ideals. The global appeal of Die Antwoord tells us a great deal about the extent to which diverse cultural expressions are marginalised, as well as the extent to which colonial conceptions of race, gender and class endear in public discourse – specifically in light of the continuing appeal of blackface in the mainstream entertainment industry.  相似文献
