In his recent book Attempts, Gideon Yaffe suggests that attempts should be criminalized because of a principle he dubs the “Transfer Principle.” This principle holds that if a particular form of conduct is legitimately criminalized, then the attempt to engage in that form of conduct is also legitimately criminalized. Although Yaffe provides a powerful defense of the Transfer Principle, in this paper I argue that Yaffe’s argument for it ultimately does not succeed. In particular, I formulate two objections to Yaffe’s argument for the Transfer Principle. First, I argue that a basic assumption about criminalization, on which Yaffe’s argument crucially depends, is incomplete, and Yaffe’s own attempt to supplement it undermines his argument for the Transfer Principle. Second, I argue that Yaffe’s argument does not properly account for the fact that those who merely attempt a crime and those who complete it might sometimes be responding to reasons in different ways. Accordingly, I conclude that Yaffe has not succeeded in establishing the truth of the Transfer Principle. 相似文献
The present article presents the results of a qualitative study whose purpose was to compare the structure and operation of the programs for intellectual property management and technology transfer, and the mechanisms through which to foster entrepreneurship, in five high-profile research institutions across the Americas. The institutions of focus included Stanford University and the University of California, Davis in the United States; the Universidad Católica and the Universidad de Concepción in Chile; and the National Scientific and Technical Research Council in Argentina. The purpose of the study was to elucidate commonalities and differences among these institutions with respect to their technology transfer practices, and to distill methodologies that could be used to establish or refine technology transfer offices in American regions. Research revealed common goals and core activities, shared and implemented in similar ways among all five institutions. However, the analysis also identified divergent areas within the structure and operation of the various technology transfer programs, representing significant differences between the five institutions. 相似文献

Abstract: There has been a continued loss of wetlands in Ontario as pressurcs from conflicting land uses escalate. This paper examines the manner in which the Ontario Municipal Board has treated the issue of wetlands protcction in hearings on land-use disputes in the provinw. Bastul on a review of nine wetlands caws dating from 1980 to 1993, the decision-making process of the Ontario Municipal Board was examined with regard to wetlands prokxtion. Analysis of the cases revealed a number of issues: the lack of relevant information at hearings; the role of policy and legislation in thc decision-making process; the use of negotiation and mediation in the hearing process; and the significance of private property rights versus the public interest in wetlands protection. This paper dismsses these issues in the context of the role of the Ontario Municipal Board in the planning and management of wetlands in Ontario. This study examinedinterpersonal andintrapersonal risk for substance use in a sample of Caucasian and Hispanic early adolescents. A total of 1170 sixth and seventh graders, equally divided by gender, participated. Interpersonal risk was assessed by susceptibility to peer pressure, parental monitoring, peer substance use, parent-child involvement, and school adjustment. Intrapersonal risk was measured via self-efficacy, impulsivity, aggression, depression, and academic achievement. As expected, mean level of use did not differ between ethnic groups. Regression analyses indicated susceptibility to peer pressure and peer alcohol use were the best predictors of individual substance use. These findings were consistent across gender and ethnicity. In all groups, interpersonal variables accounted for more variance in predicting risk (49% for Hispanic males) than intrapersonal variables (0% for Hispanic females). The perceptions of a sample of 1061 adolescents of their own competence in a number of life-skill areas were assessed. Three sets of scales were used—those concerned with competence viewed as efficacy in various life areas and situations, those concerned with competence as the satisfaction of goals based on Maslow's hierarchy of needs, and assessments of the structural complexity of performance on a short essay task. In addition to comparisons among self-perceptions for different areas, a number of major comtextual and personal variables was studied for differences in self-perceptions—course type, school type, state, career aspirations and expectations, major life concerns, age, and gender. There were strong gender differences that suggested that females generally underrated their own competence. The major educational or work contexts reflected important differences in patterns of self perceptions of skill. Differences between those with different major life concerns and career hopes and expectations aligned with course type differences. Finally, there were strong indications that the self-perceptions of competence that were reported formed a strong general factor, favoring the notion of generic over domain specific self-perceptions.Reveived Ph.D. in Socio- and psycholinguistics from La Trobe Unitersity.
