This article examines the possibilities for data gathered by individuals and communities to demonstrate climate impacts on people's lives in domestic and international climate litigation, as well as the likely procedural constraints that such evidence may encounter. Building on recent decisions of domestic, regional and international courts and bodies, and looking in particular at cases related to climate displacement, we consider the potential for civic evidence to provide valuable testimony in climate litigation, for example, grounding abstract and diffuse harms in personal and locally relevant frames. The article concludes by advancing a research agenda to test, and support or disprove, the argument developed that civic evidence from climate-affected people could be more robustly deployed in climate litigation and could have a complementary and reinforcing, rather than competing, role alongside institutional evidence.  相似文献

Against the backdrop of what seems like a perpetual cycle of crisis for policing in modern day England and Wales, this introduction synthesises some of the core challenges facing the police. A catalogue of crimes committed by serving officers, missed opportunities for reform, and a scathing review of the internal culture of the Metropolitan Police culminating in a recommendation for a ‘complete overhaul’, might initially leave some readers with the view that there is little hope for fixing an outdated and buckling police service. Yet this collection of articles, authored by academic experts, senior police—both current and former—and commentators, not only summarises some of the problems facing policing as the new Government beds in. The contributions also brim with a diverse set of ideas for changing policing for the better and rebuilding trust and confidence. We conclude with the idea that a fundamental review and reconceptualization of the police role, of the type that might be provided by a Royal Commission, is needed if we are to meet the challenges that lie ahead.  相似文献

Postwar El Salvador and Guatemala have undertaken to reform and democratize the state and to support the rule of law. Each country entered the 1990s hobbled by a legacy of authoritarian rule, while a corrupt and politicized judiciary offered virtually no check on the abuse of power. Because the judiciary has performed poorly as an institution of horizontal accountability, this article examines the performance of a new "accountability agency," the Human Rights Ombudsman. The article discusses the context in which the office was established and developed in each country, perceptions of its performance, and political responses as the office began to perform its function of holding public officials accountable in their exercise of power. Unfortunately, this new office may fall prey to the same weaknesses that have plagued older institutions in both countries.  相似文献

This study investigated relationships between hostility, Zuckerman's sensation seeking, and Eysenck and Eysenck's personality scales within a prison population, to explore whether they could be conceptualized in terms of two socialized and unsocialized sensation seeking factors. Participants included 79 incarcerated adult male offenders (age range = 18-62). Findings support the distinction between socialized and unsocialized sensation seeking and suggest that these factors represent more overarching personality factors. Psychoticism was a clear marker of the more broad impulsive, unsocialized sensation seeking factor, rather than representing a supertrait in its own right. This factor was also represented by lie, disinhibition, and boredom susceptibility scales. Findings relating to hostility also supported such a reformulation, as unsocialized scales did cluster together to predict the unsocialized hostility factor, whereas unsocialized scales did not. The results demonstrate the need for a theoretical reformulation of the two given theories of personality.  相似文献

Police officers are considered at increased risk for suicide. The objective of this study was to explore potential influences on suicide ideation among 105 randomly selected men and women urban police officers. Depression, gender, and marital status appeared to be most strongly associated with police suicidal ideation. Depressive symptoms were higher among women than men officers (12.5 percent vs. 6.2 percent). For each standard deviation increase in depressive symptoms, the prevalence ratio (PR) of suicide ideation increased 73 percent in women (PR?=?1.73, 95% CI?=?1.32–2.27) and 67 percent in men (PR?=?1.67, 95% CI?=?1.21–2.30). The association between depression and ideation was stronger among unmarried women officers (PR?=?4.43; 95% CI?=?2.19 – 8.91) than married women officers (PR?=?1.39, 95% CI?=?1.09 – 1.79). While depression has previously been associated with suicide, such results are unusual in a healthy working population such as the police.  相似文献

The World Bank has for over a decade tried to formalize the informal economy in Kosovo. However, local journalists and businessmen among others provide an alternative understanding of informality that problematizes the World Bank’s view and actions. Against this backdrop, the article analyses the constitution and the constitutive effects of the World Bank’s anti-informality operations in Kosovo between 1999 and 2014. Drawing on Pierre Bourdieu’s power analytics, the article claims that the Bank’s agenda, and the economic ideas enacted through it, does structure and shape informal economic practices on the ground. Yet this structuring involves two forms of misrecognition. As a result, informality is paradoxically constituted (in novel ways) and reconstituted through the World Bank’s imposed anti-informality agenda. The article concludes with a discussion of how this underlines the need for policy solutions that depart from liberal peacebuilding’s subject–object distinction to form instead around an acknowledgement of informality as emergent and transforming throughout international interventions.  相似文献
