This paper argues that Rwanda’s decision to abolish the death penalty should be viewed in a wider context rather than as a mere result of top–down pressure from the International Criminal Tribunal for Rwanda (ICTR). Part I traces the creation of the ICTR and the breakdown of negotiations as a result of the exclusion of the death penalty from the ICTR’s jurisdiction. It then outlines Rwanda’s efforts to prosecute the hundreds of thousands of individuals accused of committing genocide-related crimes and notes the limited and steadily decreasing role the death penalty actually played within Rwanda. Part II discusses Rwanda’s legislation abolishing the death penalty and argues that both international pressure and local historical and political forces influenced the decision. Part III situates Rwanda’s story within a growing paradox of excluding the death penalty from international criminal tribunals for the most serious crimes while national jurisdictions maintain it. It concludes that as in Rwanda, any perceived or potential impact of international criminal law in national jurisdictions must be measured in light of local circumstances.

Law enforcement personnel (LEP) use a variety of tactics to perform their job duties. Although LEP often receive specialized training to work with ethnocultural minorities and are sometimes trained to work with lesbian, gay, bisexual, transgender, and queer (LGBTQ) citizens, a clear articulation of LGBTQ-affirming police tactics has not yet been established. Using qualitative content analysis and a multiple case study approach, this project identified a variety of tactics generated by LEP in written surveys and group discussion of scenarios involving LGBTQ citizens. Results showed that across all scenarios, LEP were able to generate LGBTQ-affirming tactics, including both typical police procedures, as well as approaches specific to LGBTQ citizens. Non LGBTQ-affirming tactics typically reflected reluctance to adapt general procedures to meet the needs of LGBTQ citizens. The results of this study support the use of group-based scenario training to help LEP identify and adopt LGBTQ-affirming approaches. This study is significant because it represents a first step toward identifying best practices for LGBTQ-affirming police tactics.  相似文献

The relationship between incarceration and recidivism was investigated in a sample of 627 adult male sexual offenders. Incarceration for the index offense was unrelated to sexual or violent recidivism. This was the case whether incarceration was examined as a dichotomous variable (incarceration vs. community sentence) or as a continuous variable (length of incarceration). Risk for sexual recidivism was assessed with a modified version of the Rapid Risk Assessment for Sexual Offense Recidivism. There was no evidence that the relationship between incarceration and recidivism was confounded or moderated by risk or that length of incarceration and recidivism were non-linearly associated. Sentencing sexual offenders to terms of incarceration appears to have little, if any, impact on sexual and violent recidivism following release.  相似文献

Abstract: Ricochet of a bullet in the spinal canal is well known by neurosurgeons but relatively not a common event in usual medico‐legal autopsy practice. This article presents a homicide case of a penetrating gunshot injury of the lumbar spine through the T12‐L1 intervertebral foramen with active movement of the projectile within the spinal canal to the L5‐S1 level. This case illustrates a bullet intradural and intramedullary active movement because of a ricochet of the body of T12 with active redirection of the path. In the current literature, different types of migration in caudal or cranial direction, intradural, or intramedullary are reported. If spontaneous migration of T10 to S1 seems to be more frequent, some authors reported a C1 to S2 migration. Such migration could be asymptomatic or induce neurological impairment. The medico‐legal consequences of these migrations within the spinal canal are described.  相似文献

A secondary analysis of data collected from 1,130 young people ages 15 to 24 in a population-based household survey to assess the reproductive health needs of young people in three communities in Jamaica was conducted to determine the relationships among three measures of sexual violence, background variables, three measures of sexual risk taking (early sexual debut, multiple partners, and no condom at last sex), and two reproductive health outcomes (genital discharge within the past 12 months and pregnancy). In the multivariate analyses, forced first sex increased the likelihood of genital discharge among males (odds ratio, OR = 5.33) and females (OR = 2.02) and pregnancy among females (OR = 2.05), controlling for background characteristics and sexual risk taking. Associations between sexual violence and reported genital discharge and pregnancy that were not mediated by our measures of sexual risk taking were found. More research into the causal mechanisms for this association is needed.  相似文献

We present a visual method for assessing the predictive power of models with binary outcomes. This technique allows the analyst to evaluate model fit based upon the models’ ability to consistently match high‐probability predictions to actual occurrences of the event of interest, and low‐probability predictions to nonoccurrences of the event of interest. Unlike existing methods for assessing predictive power for logit and probit models such as Percent Correctly Predicted statistics, Brier scores, and the ROC plot, our “separation plot” has the advantage of producing a visual display that is informative and easy to explain to a general audience, while also remaining insensitive to the often arbitrary probability thresholds that are used to distinguish between predicted events and nonevents. We demonstrate the effectiveness of this technique in building predictive models in a number of different areas of political research.  相似文献

Job satisfaction is an important component of bureaucratic success. In this article, we build on the emerging literature on the five-factor model of personality and argue that basic personality characteristics can help us understand why certain employees are more satisfied with their jobs than others. Multivariate analysis of personality and job satisfaction data from over 1,000 public servants supports this argument. We conclude with a discussion about how personality can add to our theoretical understanding of public personnel management, and help public managers identify applicants who are likely to be satisfied with work in the public sector.  相似文献
