中日韩植物新品种保护制度比较研究

本文分析了中日韩三国植物新品种保护制度的差异,并且比较了植物新品 种保护制度对中日韩三国农业的影响。通过比较分析,本文指出目前我国在制度实 施方面存在的不足,并提出我国农业育种领域的发展方向是将育种行业市场方向, 育种投资多元化,政府要为我国的育种市场健康有序的发展提供制度保障。     

加强我国民营企业信用建设问题探析

信用缺失已经成为当代中国一个突出的社会问题,目前,我国民营企业的信用状况都不容乐观,许多民营企业在社会经济生活申仍然存在严重的失信、诈骗、践踏诚信原则的行为。本文就民营企业信用的含义、民营企业信用缺失的现状和存在的问题以及如何加强民营企业信用建设等问题,做了一些探析,以求对加强民营企业信用的实践工作有所裨益。     

知假买假惩罚性赔偿法律问题研究

2013年修改后的新《消费者权益保护法》从强化保护消费者权益的角度出发,对惩罚性赔偿条款做了修订。修订后的条款比原来的规定更加科学、合理,但是也有一些问题值得进一步探讨,其中争论较大的就是知假买假行为适用惩罚性赔偿问题。从中国目前产品质量的现实情况出发,并基于利益平衡角度考虑,知假买假行为适用惩罚性赔偿,有极为重要的理论意义和现实意义。更为重要的是,对普通消费领域的知假买假的惩罚性赔偿规则,需要进行更为广泛的扩展,包括食品、药品领域和服务领域。目前当务之急是梳理现有的法律规定和司法解释、行政规章之中规定的相互矛盾之处,让司法标准进一步统一,实现法律的公正、公平。     

Transformational Leadership and Organizational Outcomes Evidence From Vietnamese Workers

The purpose of this study was to investigate empirically the impact of transformational leadership on organizational outcomes （OCB---organizational citizenship behavior, OC---organizational commitment, and job satisfaction）, and the mediating role of trust in the leader in the relationship between transformational leadership and organizational outcomes in Vietnamese employees. The results showed that, first, transformational leadership had a significant relationship with organizational citizenship behavior, organizational commitment, and job satisfaction. Second, there was a positive relationship between transformational leadership and trust in the leader. Third, trust in the leader was positively and significantly related to OCB, affective organizational commitment, and job satisfaction. Fourth, a moderating role of trust in the leader was identified in the relationship between transformational leadership and organizational outcomes. Finally, some practical recommendations for developing leadership competencies in Vietnamese managers are suggested.

<正> "法本位"讨论曾引起中国法学界的关注。但是,讨论未能充分展开,人们对讨论的问题指向与具体观点也缺乏充分了解。因此,有必要对讨论中出现的两种主要的、看来相对立的派别所持的观点作一辨析。一、"法本位"的问题指向国内许多学者,将"法本位"讨论说成是"权利义务关系"讨论,以为这一讨论是要解决"权利义务谁先谁后"、"权利义务谁是目的、谁是手段"、"权利义务是否具有一致性"之类的问题。其实,"权利本位论"和"义务重心论"所讨论的并不足同一问题。

自主性武器系统为关键性功能具有自主性,能在无人参与的情况下对目标进行选择和打击的武器平台。随着自主性武器系统的自主性能不断提升,它对现有国际法中的武器控制体系、国际人道法的基本原则等构成了潜在的威胁与挑战,致命决策的去人类化也引发道德层面的问题。因此,需要通过促进国际社会对自主性武器系统的共同关注、把握军事必要与人道要求的动态平衡、完善武器审查机制等路径进一步对自主性武器系统加以规则。     

Investigation of class characteristics in English handwriting of the three main racial groups: Chinese, Malay and Indian in Singapore

This paper investigated the class characteristics in English handwriting of the Chinese, Malays and Indians in Singapore, many of whom learned their native language as a second language. One hundred and fifty-four handwriting exemplars were collected and features such as letter designs, pen-lifts, letter spacing and embellishments were studied. A number of characteristic features peculiar to the individual racial group were identified, which confirmed the impact of their native language writing systems on English handwriting.
