“A part to play”: the value of role-play simulation in undergraduate legal education

This article explores the argument for increased student participation in experiential learning approaches within the UK undergraduate law curriculum. It is supported by the findings of a very small-scale research study undertaken by the writer into law students’ perceptions of the efficacy of role-play simulation as a means of studying mediation, in an optional credit-based module within the final year of a UK undergraduate qualifying law degree. In order to provide situational context, the first part of this article will briefly address the experiential learning possibilities for undergraduate law students, a discussion of the study involving qualitative research methodology, which was used to demonstrate that role-play simulation as a method of experiential learning has a place within the UK undergraduate law curriculum. The final part of this article will consider the findings of the study which demonstrated that, inter alia, role-play simulation can be motivational, helps to build student confidence, enables deeper learning, assists graduate skills acquisition and arguably enhances employability. Based on the findings of this study and other empirical evidence, the article suggests that greater emphasis could be placed on experiential approaches such as role-play simulation for credit-based law courses, including those “core” foundational courses which form part of the undergraduate qualifying law degree in the UK, but achievement of this aspiration is not without its challenges.     

Court Considerations in the Termination of Parental Rights: A Comprehensive Analysis of Israeli Court Decisions

Court decisions to terminate parental rights (TPR) have a major impact on parents and children, but the decision‐making process is unclear. Analysis of 261 Israeli TPR court cases indicated the dominance of considerations relating to normative parental functioning, the parents' ability to change, the impact of separating a child from his family, the parents' social normativity and educational ability. The legal considerations relate to the importance of the biological family, the necessity of adoption and the importance of a fair legal process. Insufficient consideration is accorded to cultural differences in parenting practices and the voice of the child.     

Valuation of natural resources: efficiency and equity

Adequate pricing of environmental goods is essential for the sustainable management of natural resources. It is not easy, however, to place a value on natural resources, because the excludability problem makes it difficult to protect natural resources from unpaid use and to exercise property rights over them. This article discusses the achievements and limitations of current natural-resource policies from the perspectives of efficiency and equity. It argues that a trust fund operating via market-based transactions is a promising approach to help to achieve simultaneously the goals of efficiency, sustainability, and poverty reduction, provided that property rights to the environmental resources are distributed fairly within current generations, as well as between present and future generations.     

Policy Punctuations in Colorado Water Law: The Breakdown of a Monopoly

The actors, influences, and processes that combine forces to change policy subsystems are modeled in punctuated equilibrium theory wherein monopolistic policy subsystems are broken down through changes in policy images and venue shopping spurred by a critical mobilization of actors. Studying a case of policy change in Colorado water rights, this research examines multiple levels of policy change—local, state, and cross‐case. This research finds that at the state level, punctuated equilibrium theory accurately explains the process by which policies changed to allow for recreational in‐channel uses of water. At the local level, however, these processes are not clearly evident. Using media coverage as a proxy measure for agenda status also shows that policy image change and high public agenda status did not lead to these policy changes within Colorado communities. This article discusses whether we should therefore discount punctuated equilibrium as a model of policy change in this case.     

Transformative Women,Problem‐Solving Men? Not Quite: Gender and Mediators' Perceptions of Mediation

A large field study examined female and male mediators' perceptions of their jobs, looking in particular at their attitudes toward mediation styles lying on the continuum between instrumental and transformative. Based on scholarship on gender and negotiation literature that has portrayed women as more interpersonal and somewhat less task oriented than men, we expected female mediators to be more transformative and less instrumental in their practice than their male peers. Our study was both qualitative and quantitative: we formulated the content of twenty in‐depth interviews into an extensive questionnaire, answered by a representative sample of 189 Israeli mediators. Compared with their male counterparts, we found female mediators to be more transformative, but no less instrumental, in their view of mediation's goals and orientation. They were also somewhat more facilitative in preferred style, while male mediators were somewhat more directive. We also found additional intriguing gender differences, including that women mediators reported higher job satisfaction than did male mediators, but they also displayed a greater readiness to perceive failure in mediation.     

The OBR and the March 2023 Budget: The Travails of UK Economic Growth and the Politics of Technocratic Fiscal Governance

This article places the Office for Budget Responsibility's commentary on the March 2023 UK Budget in political context. It explores how increased independent expert input has transformed the UK economic policy regime, focussing on the complex relationship between rules-based economic governance, independent oversight and fiscal discipline. The technocratic veneer that enshrines the UK fiscal watchdog obscures the inevitable politics of rules-based fiscal governance. The recent budget revealed OBR scepticism about how far budget measures can address the UK economy's long-term structural weaknesses. This underlined the key role for judgment inherent within technocratic fiscal oversight.     

Change leadership and change embeddedness in public organizations: Connecting macrolevel reform to microlevel implementation

Governments initiate major public sector reforms for various reasons. Although change leadership appears crucial, its role in implementing reforms in public organizations receives scant attention. Insights from public administration and change management literature help to bridge the gap between these macrolevel and microlevel perspectives. Our multilevel study of two youth care organizations addressing public sector reform explores how leadership behavior—and in interaction between top and middle managers—contributes to the concept of what we call change embeddedness among front-line employees. The use of leadership behaviors during the reform that are leader centric (shaping) appear to be associated with greater ambiguity and worse change embeddedness. However, leadership focused on engaging employees and boundary spanning with external organizations seems to support the embeddedness of the reform, especially when these behaviors are connected to a clear sense of purpose around the change.     

Digital Election Observation: Regulatory Challenges around Legal Online Content

Between public debates about ‘hacking’ elections, so-called ‘fake news’ and online disinformation campaigns, it has become hard to imagine what free and fair elections in a digital environment could look like. This challenge is particularly pronounced for election observers who monitor free and fair elections. How should election observers fulfil this task when reliable data in online media campaigns are often not even available to media regulators? The following article provides a brief overview of existing challenges around online content regulation and how these apply to elections and election observation. It then considers where resources for digital electoral observation exist and how most effectively to build on these before, in conclusion, discussing next steps and potential opportunities to develop digital election observation further.     

Democracy and the demographic transition

This article addresses the role of demographic factors in contributing to the emergence of democracy. It maintains that, other things being equal, progress in the demographic transition promotes democratization. The argument is developed with reference to the effects of interrelated changes in mortality, natural increase (i.e. population growth), fertility, and population age structure. Suggestions are also made with respect to how demographic and democratic trends should be gauged. An analysis of data for the period 1970–2005 for 77 countries that were initially non-democratic provides substantial support for the argument. Some implications are discussed, as are future trends in democratization from a demographer’s perspective.     

Maturing Sino–Africa relations

It is argued that China’s relationship with Africa has transformed into one defined by a dynamism and African agency, thereby lessening the hold the former previously had on Africa in the early days of this evolving alliance. First, the authors will conduct a literature review of historical Sino–African relations, from the early Han dynasty to its contemporary manifestations. The second section will continue with this analysis by focusing exclusively on the status quo of the Sino–African economic relationship, including analysis of trade flows, investments, development, economic cooperation, and Chinese support for regional integration. Finally, this paper will conclude with an elaboration of some key, emerging relationship areas, such as opportunities for China and Africa to collaborate on the achievement of the latter’s Agenda 2063 and African Mining Vision.
