Valence,Policy Ideas,and the Rise of Sustainability

This article introduces to policy studies the concept of valence, which we define as the emotional quality of an idea that makes it more or less attractive. We argue that valence explains why some ideas are more successful than others, sometimes gaining paradigmatic status. A policy idea is attractive when its valence matches the mood of a target population. Skilled policy entrepreneurs use ideas with high valence to frame policy issues and generate support for their policy proposals. The usefulness of the concept of valence is illustrated with the case of sustainability, an idea that has expanded from the realm of environmental policy to dominate discussions in such diverse policy areas as pension reform, public finance, labor markets, and energy security. As the valence of sustainability has increased, policy entrepreneurs have used the idea to reframe problems in these various policy areas and promote reforms.     

A Vision of Social‐Legal Change: Rescuing Ehrlich from “Living Law”

The hundredth anniversary of the original publication of Eugen Ehrlich's Fundamental Principles of the Sociology of Law is nearly upon us. The book earned high praise from Oliver Wendell Holmes, Roscoe Pound, and Karl Llewellyn as one of the outstanding works of its time. Ehrlich has been identified as an early legal realist, a pioneering figure in legal sociology, and a leading theorist of legal pluralism. In this retrospective review, I explain the strengths and weaknesses of this classic book. Ehrlich articulated an unsurpassed account of dynamic social‐legal change, an account that remains fresh and timely today.

The Common Law and the Forms of Reasoning

The purpose of this article is to examine how various forms of reasoning both can and should be used to decide cases in the common law tradition. I start by separating positive questions about what the law is from normative questions about what the law ought to be. Next, I present a Peircean account of three main forms of reasoning – deduction, induction and abduction – and examine how they can be used by judges to decide cases in the common law. Finally, I argue that the three forms of reasoning can be used to answer both kinds of questions, but in different ways. All three forms of reasoning can be used to answer questions of positive law, while questions of normative law present a special case that may require the use of aesthetic judgments of taste in the formation of a legal hypothesis.     

The persuasive power of a Committee Chairman: Arthur Burns and the FOMC

This paper investigates persuasion as a means of influence for the Federal Reserve Chairman in meetings of the Federal Open Market Committee (FOMC). Using textual records of FOMC meetings, federal funds rate targets have been recorded for Committee members who served in the Arthur Burns era (1970–1978). Results show that Burns-member differences in stated funds rate targets were lower when Burns made recommendations early in the meeting, consistent with the hypothesis that the Chairman is persuasive. Additional results show that members’ tendencies to respond to Burns's recommendations were related to their personal and political loyalties.     

Identity development and formal operations as sources of adolescent egocentrism

The self-concerns and social expectations that are part of the identity development process may lead adolescents to think that others survey them for signs of individuality. The novelty of identity development may also lead to feelings of uniqueness and invulnerability. The imaginary audience and personal fable may therefore stem from identity development and not from the emergence of formal operations. In this study high school and first-year university students (N=255) completed measures of adolescent egocentrism, identity development, and formal operations. Egocentrism was moderately associated with higher scores on identity crisis and identity achievement, and with lower scores on identity diffusion. There was no significant relationship between egocentrism and the emergence of formal operations.Received his M.Sc. and Ph.D. from the University of Victoria. SEMATECH and collaborative research: Lessons in the design of high-technology consortia

This article reviews the experience of SEMATECH as a model for high-technology research consortia. SEMATECH's original aims of developing next-generation manufacturing technology proved hard to achieve, and the program has refocused on generic technology and the equipment industry infrastructure. Though more modest, these new objectives have produced significant tangible results. The study considers the reasons for the change and implications for consortium design. This is contrasted with the history of other major collaborative research programs in Japan, Europe, and the United States.
