Why Do Foundations Follow the Law? Evidence from Adoption of the Uniform Prudent Management of Institutional Funds Act

Employing a large panel of over one million firm‐years, I find evidence consistent with widespread compliance with law among U.S. private foundations despite the absence of many formal deterrence mechanisms. The research design exploits rolling state adoption of the Uniform Prudent Management of Institutional Funds Act, which lifted some existing limits on firm spending for a fraction of firms within each state. This allows the use of triple‐difference estimates that control for changes in local norms and economic conditions. UPMIFA increases firm spending, on average, implying that firms were complying with the pre‐UPMIFA regime. Interacting the triple‐difference factors with other predictors of compliance reveals no correlation between compliance and enforcement intensity, but some evidence that compliance is correlated with firm culture and reliance on accountants. These findings have potentially important implications for the governance of charitable organizations, and may speak more generally to drivers of compliance among other organizational forms.     

Mobilizing from the Margins: Domestic Citizen Politics and Yasukuni Shrine

Prime Minister Koizumi’s six consecutive annual visits to Yasukuni shrine played a key role in initiating a new phase of domestic citizen political mobilization not seen since the early 1970s. This paper is based on field research during the Koizumi years (2001–2006) centering on domestic groups that conduct activities in “protection” of or “opposition” to Yasukuni shrine. As a study of street-based politics, this paper seeks to uncover the processes, strategies, and outcomes of citizen responses to elite political action at Yasukuni Shrine as well as explore meaning of their actions within the context of Japan’s democratic polity.

A 21st Century Low‐Carbon Transition in U.S. Electric Power: Extent,Contributing Factors,and Implications

The U.S. electric power sector has experienced a substantial shift of the generation mix since the turn of the century, moving from heavy reliance on coal‐powered generation to one drawing more from natural gas and, more recently, renewables. This transition has been forged by a mix of macroeconomic factors (recession and recovery); technological breakthroughs (horizontal drilling coupled with hydraulic fracturing; improvements in natural gas plant efficiency); clean energy policies at federal, state, and local levels of government; and private sector demands for carbon‐free energy sources. These factors have combined to reduce carbon emissions from electric power generation substantially this century. In this article we examine the extent of this transition, its causes, as well as the distinct American institutional factors steering it, including energy and environmental federalism, electoral politics, and the political economy of clean energy policy enactment and resistance.     

The Australian Citizenship Test: Process and Rhetoric

In late 2007, Australia's relatively liberal citizenship eligibility requirements were modified, ostensibly to improve the value of citizenship by restricting access to it. A key change involved the introduction of a citizenship test. This article tracks its development and implementation. We challenge claims of overwhelming support for the test, explore the discourses around the “Australian values” being tested, and outline the process by which the legislation was enacted (during which a number of principles of parliamentary democracy were compromised). Using evidence from politicians' speeches, we argue the citizenship test served to re‐direct the Australian imagination away from a nascent “multicultural” identity, back to one redolent of the times of the “White Australia Policy”, confidently celebrating connections with an Anglo‐Saxon heritage, the European Enlightenment, and Judeo‐Christian roots. As such it was a key aspect of the 1996–2007 Howard Government's retreat from multiculturalism.     

The Daily Mail and the Stephen Lawrence Murder

The Daily Mail's coverage of the 1993 race murder of Stephen Lawrence has been held up as an example of newspaper journalism at its best. It is a cause of pride to the paper, which has asserted that its 1997 front page accusing five men of the murder, and the comment and reporting that followed, brought about significant social and policy changes and helped achieve justice. The coverage has also been cited by the paper to rebut critics who accuse it of intolerance. Examined in detail here and set in their context, the paper's claims about its role in the case prove to be either exaggerated or not supported by evidence. The Mail's engagement in the Lawrence case involved a famous instance of editorial brilliance, but insofar as its campaign brought about or contributed to changes, they were not usually changes sought by the paper and they were sometimes contrary to its aims.
