The necessity to control environmental externalities is almost invariably given as justification for command-and-control regulation and other forms of state intervention in related markets. When even mentioned, common law remedies that protected environmental rights for centuries are quickly dismissed as either being unworkable or ineffective. A review of the common law experience indicates that the rule of law can be effective in protecting environmental rights. Indeed, it is quite possible that common law was too effective, which led to special interest demand for statute law. The rule of politics may be more attractive to rent seekers than the rule of law and markets.  相似文献

Most Canadian provinces have introduced legislation to require politicians of all ideological stripes to meet annual balanced budget (BB) targets. Critics of this type of legislation argue that it is unnecessary, confining, and subject to manipulation. We examine provincial balanced budget legislation before and after the Great Recession and argue that the response of provinces needs to be evaluated taking into account the multiple objectives of fiscal policy and the behavioural changes that the rules introduce, including creative non‐compliance. Rules should be evaluated on their ability to contribute to good fiscal governance rather than on their stringency.  相似文献

While there is a growing academic literature about mail-in ballots, there has been no serious academic research to date on overseas voters, even though the counting of overseas military ballots figured into the 2000 presidential election controversy. The participation of nearly 4 million overseas voters, both civilian and military, is governed by the Uniformed and Overseas Citizens Absentee Voting Act. The authors examine the reported perceptions of military and nonmilitary voters covered by this legislation using two surveys funded by the U.S. Election Assistance Commission, focusing on their perceptions of electronic means of transmitting voting materials. The authors find that civilian overseas citizens have a harder time registering and voting than military overseas citizens; that the key factor is the timely transmission of voting materials; and that, despite privacy concerns, electronic transmission of voting materials is viewed favorably.  相似文献

I examine why states violate norms they embrace as members of international society. The rationalist answer, that norms are violated whenever they conflict with interests, is underspecified and empirically challenged. Constructivists cannot address violations well from their structural, sociological perspective. I argue from political psychology that violations stem from the motivated biases of actors who face a moral dilemma between personal desires and social constraints. These biases compel leaders to interpret norms and situations in a manner that justifies violation as socially acceptable. The ability to do so depends on the norm and the situation. The more parameters a norm possesses, and the more ambiguous those parameters are, the easier it is for actors to interpret them favorably to justify violation. Oftentimes norms are what states make of them. If the situation is plausible for states to claim exemption, they violate; otherwise they are constrained. The U.S. invasion of Panama illustrates these dynamics.  相似文献
