Behavioural observation programmes are becoming increasingly popular at transportation hubs, sporting events, and other large crowd gatherings. Premise of these programmes is that malicious intention can be accurately deduced from observable behaviour. In a recent article published in this journal, Wijn et al. (2017, Legal and Criminological Psychology, 22, 378–399.) conclude that environmental cues improve the correct detection of participants with malicious intent. This conclusion can and will be interpreted as support for behavioural observation programmes. In this comment, we argue that Wijn and colleagues draw a fundamentally wrong conclusion from their data. What their data show is that malicious intentions could not be detected in any of the conditions. Their findings can therefore not be conceptualized as evidence for behavioural observation programmes. Rather, they add to the growing critique voiced towards such programmes.  相似文献

Abstract:  Imaging is an integral diagnostic tool in mass fatality investigations undertaken traditionally by plain X-rays, fluoroscopy, and dental radiography. However, little attention has been given to appropriate image reporting, secure data transfer and storage particularly in relation to the need to meet stringent judicial requirements. Notwithstanding these limitations, it is the risk associated with the safe handling and investigation of contaminated fatalities which is providing new challenges for mass fatality radiological imaging. Mobile multi-slice computed tomography is an alternative to these traditional modalities as it provides a greater diagnostic yield and an opportunity to address the requirements of the criminal justice system. We present a new national disaster victim/forensic identification imaging system—Fimag—which is applicable for both contaminated and non-contaminated mass fatality imaging and addresses the issues of judicial reporting. We suggest this system opens a new era in radiological diagnostics for mass fatalities.  相似文献

This paper analyses the determination of the complexity of legal rules in a context of harmonization between different countries. We first assume that there are no harmonization gains. We show that if the optimal complexity levels of legal rules are equal across countries, their common level will stick when legal rules are harmonized. When these levels are different, one nation-state may lose to the determination of a uniform level of complexity. However, when there are harmonization gains we show that if these harmonization gains are large enough, complex legal rules are optimal. Moreover, we show that each nation-state could gain from the determination of a uniform level of complexity, even if this level is not its preferred one.

The literature considers that the ignorance of activity levels by the courts is a major source of inefficiency to minimize the social costs of accidents. In this paper, we show that the inefficiency of the negligence rule based on a standard of care (and correlatively ignoring the activity level) is not established if certain dimensions of care are not verifiable. In other words, if care and activity levels are the only relevant variables of the injurer's set of actions to reduce the risk of accident, it is true that inefficiency arises when the court ignores one element of this set. But, considering that some dimensions of care are in practice not verifiable, it can be efficient for the judge not to take into account the activity level of the defendant. We propose a simple model with three variables: observable and unobservable precautionary measures and activity level.

STR profiling of animal species has a wide range of applications, including forensic identification, wildlife preservation, veterinary public health protection and food safety. We tested the efficacy of a multiplex PCR-based assay including 11 porcine-specific tetrameric STRs in a population sample of wild boars (n = 142) originating from Piedmont (North West Italy). Multiple deviations from Hardy–Weinberg expectations were observed, mostly due to a reduction in observed heterozygosity indicative of a high degree of inbreeding. A value of θ of 0.046 and an inbreeding coefficient of 0.089 were estimated. Combined power of discrimination and probability of exclusion values for the STR panel were 0.9999999999996 and 0.99989. In order to test the suitability of the method for meat traceability purposes, a domestic pig reference sample (n = 412), consisting of commercial lines commonly used in the meat production process, was also typed. A Bayesian cluster analysis carried out using the observed genotypes, showed a percentage of correct subspecies assignment of individual samples of 0.974 for wild boars and 0.991 for pigs, thus demonstrating the usefulness of the multiplex STR-typing system for discrimination purposes.  相似文献

An ultrasound-assisted extraction method is proposed for the determination of trace elements in hair samples by inductively coupled plasma-mass spectrometry (ICP-MS) for forensic investigation. Prior to analysis, 25 mg of hair samples were accurately weighed into (15 mL) conical tubes. Then, 2 mL of 20% HNO3 is added to the samples, sonicated at 2 min (50 W, 100% amplitude), and then further diluted to 10 mL with Milli-Q water. Resulted diluted slurries are centrifuged and the analytes are directly determined in the supernatant. Calibrations against aqueous solutions were carried out with rhodium as internal standard. The method was successfully applied for the extraction of Al, As, Ba, Be, Cd, Co, Cr, Cu, Mn, Pb, Tl, U, V and Zn with a method detection limit (3 s, n = 20) of 0.1, 0.4, 0.2, 0.09, 0.08, 0.04, 0.1, 2.9, 1.0, 0.9, 0.04, 0.05, 0.1 and 4.2 ng/g, respectively. Method accuracy is traceable to Certified Reference Materials (CRMs) 85 and 86 human hair from the International Atomic Energy Agency (IAEA). Additional validation data are provided based on the analysis of hair samples from the trace elements intercomparison program operated by the Institut National de Sante’ Publique du Quebec, Canada. The proposed method is very simple and can be applied for forensic purposes with the elimination of sample digestion step prior to analysis. Then, a considerable improvement in the sample throughput is archived with the use of the proposed method.  相似文献

The Australian Trade and Investment Commission (Austrade) is a government organization whose responsibility is to promote Australian exports and investment facilitation in global markets. It has a unique position of being a government agency and at the same time working alongside and with business in assisting exporters enter overseas markets. This relationship is often strained both for reasons of changing government preferences in terms of assisting exporters as well as pressures on the government budgets. Yet Austrade has been able to remain a steadfast intersection between government and business despite the competing strategies of its two main stakeholders – government and business. Terrorism has large social costs that are difficult to quantify for the well-known problems of eliciting people’s preferences for public goods. We use the LSA to assess these costs in utility and monetary terms. Based on combined cross-section time-series data, we estimate the costs of terrorism for France and the British Isles. We find large negative effects of terrorism on life satisfaction that translate into considerable compensating surpluses for a hypothetical reduction in terrorism, in particular for the serious conflict in Northern Ireland. The effects of terrorism are robust and differ across groups in accordance with prior expectations.  相似文献

‘New Public Management’ (NPM) ideas gained widespread acceptance all over the world in the 1980s and 1990s. In developing countries, notable examples of its influence include the Brazilian ‘Master Plan for Reforming Public Administration’, launched in 1995 by president Cardoso, and the Mexican ‘Federal Public Administration Modernisation Programme’ created in the same year by president Zedillo. Both reflected NPM doctrine and advanced changes for the organisation of the Executive. This article explores the evolution of these two countries' managerial reforms and the extent to which they eventually continued converging (or not) around similar principles, such as those often referred to as ‘Post-New Public Management’ (Post-NPM). By applying quantitative textual analysis of official documents and an analysis of self-reported institutional changes, the article concludes that despite their governing parties' strong political differences Mexico and Brazil did converge during the 2000s, improving controls from the centre, and prioritising the adoption of transparency and participation tools. The comparison of the trajectories of the administrative reforms of these countries between 1995 and 2016 contributes to international debates on policy convergence and Post-NPM reforms.  相似文献
