The opioid epidemic, impacted from the proliferation of fentanyl, has added impetus to the need to detect fentanyl, sources of fentanyl, and places where fentanyl and drugs adulterated with fentanyl are available. Many darknet marketplaces (DNMs) have rules that ban fentanyl. However, it is unclear how these affect the fentanyl market. Using the AlphaBay DNM as a case study, we conducted mixed methods qualitative research. We scraped and analyzed data from the AlphaBay I2P website using, among other methods, content and social network analysis, to uncover hidden fentanyl networks. Our research highlights the next evolution of darknet marketplaces – the migration of DNMs from Tor to I2P and the methods that can be used identify fentanyl networks, irrespective of where sites are: I2P, Tor, or multihomed on I2P and Tor. Despite its ban in the Global AlphaBay Rules, our research revealed the sale of fentanyl on the AlphaBay DNM. Unlike previous studies, our findings predominantly revealed the covert sale of fentanyl on AlphaBay and predatory vendors selling illicit drugs, which unbeknownst to buyers, contained fentanyl. To a lesser extent, our findings identified the overt sale of fentanyl patches on AlphaBay. Although we examined only one DNM, the prevalence of the covert sale of fentanyl and the presence of predatory vendors underscores the importance of research that decodes the language of vendors who surreptitiously sell fentanyl or drugs adulterated with fentanyl or other illicit substances. This study examines the links between leaders' social skills, organisational health (decline) and positive work relationships. In particular it tests whether leaders' social skills are more strongly associated to work relationships when the organisation's fiscal health is more precarious. Using data from both surveys and annual financial statements of 103 public sector organisations, the results indicate that a leader's social skills and organisational fiscal health are positively related to work relationships. However, the interactive effect of leaders' social skills and organisational fiscal health on positive work relationships was not significant. 相似文献

Although there is substantial research on the consequences of smoking and the economic loss resulting from tobacco use, there is a scarcity of work on the enforcement of smoking ordinances at the local level. As municipalities around the country pass ordinances restricting smoking in public places, research should be conducted to understand enforcement outcomes. This article examines the management concepts being employed by managers in the enforcement of smoking ordinances. This article shows that management concepts are salient in policy enforcement and are employed to manage smoking enforcement ordinances. This paper examines the extent to which the managerial skills possessed by top management teams affect the performance of municipal organisations in Israel. We evaluated both perceived (education, employment, and culture, recreation and sport services) and objective (collecting efficiency ratio and surplus (deficit) ratio) performance measures. In general, the results show that the managerial skills possessed by the top management team explain variance in organisational performance. Interestingly, structural context plays an important role, especially for performance measures that are potentially less changeable in the short term (collecting efficiency ratio). Managerial skills are a good predictor of performance measures (surplus (deficit) ratio) that can be changed in the short term rather easily, and explain variance in municipal services, especially when the top management team views them as important and highly valued by residents. 相似文献

The December 1988 bombing of Pan Am Flight 103 raises an important legal problem for decision‐makers contemplating retaliation against such acts of terrorism. Conceivably, retaliation could conflict with and help erode international norms of self‐defense. Counter‐terrorist experts and government officials espousing the use of force have minimized, if not ignored, this potential conflict and its negative impact on world order. On the other hand, the 1986 US raid on Libya and the 1985 Israeli raid on PLO headquarters in Tunisia reveal that under limited circumstances force would be deemed appropriate. The informal adjudication of these incidents by relevant international actors suggests a tolerance for the resort to force in the US case and ambivalence in the Israeli case. The US and Israeli cases guide a subsequent discussion of the conditions under which the use of force against terrorist bases in response to terrorist attacks could be legitimated. The resort to force against such activity, it is argued, would have to meet the test of necessity, including: (1) a previous and ongoing series of terrorist attacks, and demonstrated responsibility for those attacks by the actor, state or non‐state, against whom force is used; (2) immediately expected or imminent terrorist attacks endangering human life; and (3) the absence of non‐forcible remedies effective in terminating the terrorist threat. In addition the amount of force would have to be proportional, limited to targets responsible for specific terrorist activity and limited by the objective of terminating that threat. 相似文献

Fifty years ago, the U.S. President's Commission on Law Enforcement and Administration of Justice saw drugs as a modest but growing problem for the criminal justice system. The reemergence of heroin occupied the Commission's attention. Many recommendations are admirable, such as a focus on public health interventions and a concern about the appropriateness of criminal prohibitions on marijuana use. Throughout the past 50 years, the problem has both massively expanded and changed in many ways; the principal drug of abuse has shifted multiple times, as has the populations most affected by them. Policy, largely stuck on tough enforcement for 30 years, is now moving in a direction more consistent with the Commission's views. Researchers have made only modest advances in understanding what enforcement can do to reduce drug use and related problems, but society has made some progress in developing interventions that have both a sound theoretical base and the promise of avoiding the unintended negative consequences of the highly punitive system of the 1980s and 1990s. A Commission in 2018 would face a much different and larger problem that has transformed many aspects of criminal justice. Investing in more data collection and evaluation research would be among its major recommendations, as would an admission of considerable uncertainty about what to do with the latest twist in the U.S. drug problem, the addition of the much more dangerous fentanyls. 相似文献

Why, in comparison with other liberal capitalist democracies, is the social welfare state so poorly anchored in American law and public discourse? Surely American political and social history have contributed much to the weakness of our “social state.” But law, too, has played a significant material, as well as ideological, role and has provided the terrain for much of our social development. This essay explores the particular contribution of the property-liberty nexus to the stunted development of positive liberty and social citizenship in the United States. It traces this connection from the natural rights and bourgeois Founders through several key conjunctures in American history, including Reconstruction, the New Deal, and the civil rights periods and compares some of the results with developments in Germany and the aspirations of American progressives. The essay contends that left and right alike have operated within a highly resilient and constricting framework that has made progress in the area of social citizenship both awkward and fragile. Although some possibilities for forward movement have always existed and still remain, the prospects for positive-liberty social-state law are not abundant: The master's house is not about to be taken down with his own tools. 相似文献
