After a brief review of determinate sentencing systems, this study examines the impact of Minnesota's determinate sentencing law on various presentence and sentencing outcomes. Using comparable pre- and postguideline measures, the results of this study suggest that Minnesota's reform effort was largely successful in reducing disparity within the scope of the new guidelines. However, although the direct impact of socioeconomic attributes of the offender diminished, these characteristics continued to influence sentencing decisions indirectly through various presentence decisions and case attributes not governed by the guidelines Different models of charge bargaining and sentence negotiations are also observed when pre- and postguideline models are compared. Yet, the determinants of these time-specific models are not consistent with the assumptions of a circumvention argument. Numerous studies have examined the incidence of killer amendments in Congress, but most of these studies have been either case specific, focusing on the legislative maneuverings around a single issue or bill, or temporally limited, focusing on strategic activity in only one or two Congresses. In this article, we present the beginning of a comprehensive research agenda for the systematic study of killer amendments. Using roll‐call data from the 83d through the 108th U.S. House (1953–2004), we identified those bills that (a) were successfully amended and (b) subsequently went down to defeat, a necessary condition for the existence of a killer amendment. We then examined these cases in greater detail, using both spatial analyses and case studies. Our analysis uncovered five cases, four of which are new, that appear to have the characteristics of true killer amendments, thus setting the stage for future analyses across time and legislative chambers and bodies. 相似文献

We investigate links between ecological changes and changes in violence in Baltimore neighborhoods in the 1970's The two most salient ecological changes during the decade were (1) the emergence of a large number of gentrifying neighborhoods and (2) the further absorption of several older, minority neighborhoods into an “underclass” status Relative deprivation and social disorganization each predict increasing violence in gentrifying and emerging underclass neighborhoods. But, relative deprivation theory highlights the role of changes in economic status, whereas social disorganization highlights the role of changes in stability or family status. We further suggest that connections between ecological change and changes in disorder are contingent not only on historical context, but also on overall neighborhood structure at the beginning of the period. We hypothesize: (a) neighborhoods becoming more solidly “underclass” will experience increasing violence as status and stability decline and (b) emerging gentrifying neighborhoods will experience increasing violence as status and stability increase. With data from respondents in Nizhni Novgorod, Russia, we address the generality of self-control theory. We also assess two hypotheses. The first focuses on the attractiveness of criminal acts, that is, motivation toward crime. The second concerns the contention that the mediating link between self-control and criminal conduct is the failure of those with less self-control to anticipate the long-term costs of misbehavior. Although the magnitude of associations between self-control and indicators of criminal behavior is about the same in this study as it is in others, which suggests that the theory is not culturally bound, those associations are largely overshadowed by criminal attraction. Consistent with that, failure to anticipate costly long-term consequences does not appear to be the mediating link between self-control and criminal behavior: the evidence shows no tendency for sanction fear to be greater among those with greater self-control. In fact, sanction fear is modestly and significantly related to the crime measures independent of self-control, though sanction fear also appears to be influenced by criminal attraction. The results suggest that in the production of criminal behavior, motivation may be more important than controls inhibiting criminal impulses. 相似文献

The nature and scope of the jail role within the criminal justice system is explored. Questions are raised as to the types of functions which jails should perform, the appropriateness of jail services, and alternatives for the administration of jails. The authors suggest that solutions to the various issues require active involvement of an informed public providing policy direction to the criminal justice system. Policing tactics that are proactive, focused on small places or groups of people in small places, and tailor specific solutions to problems using careful analysis of local conditions seem to be effective at reducing violent crime. But which tactics are most effective when applied at hot spots remains unknown. This article documents the design and implementation of a randomized controlled field experiment to test three policing tactics applied to small, high‐crime places: 1) foot patrol, 2) problem‐oriented policing, and 3) offender‐focused policing. A total of 81 experimental places were identified from the highest violent crime areas in Philadelphia (27 areas were judged amenable to each policing tactic). Within each group of 27 areas, 20 places were randomly assigned to receive treatment and 7 places acted as controls. Offender‐focused sites experienced a 42 percent reduction in all violent crime and a 50 percent reduction in violent felonies compared with their control places. Problem‐oriented policing and foot patrol did not significantly reduce violent crime or violent felonies. Potential explanations of these findings are discussed in the contexts of dosage, implementation, and hot spot stability over time. 相似文献
