In November 2011, the Localism Act was passed and, on one view, reflects the widest‐ranging reforms to housing law for over a half century. Ambitious in its stated aims, the legislation was trailed as representing a broad shift in power from central Whitehall to local communities and individuals. The article critically examines the central changes introduced by the 2011 Act as they pertain specifically to housing law in England, namely the new flexible tenancy regime, the changes to homelessness duties under Part VII of the Housing Act 1996 and the reforms concerning the allocation of social housing. The article interrogates the extent to which the reforms realise the stated localist agenda and highlights areas of difficulty in interpretation and application. It concludes that rather than bestowing greater power on local communities, the reforms to housing law will instead effect a perceptible reduction of power in the hands of local people. 相似文献

This is the final article in a series of three that examines the legal role of medical professionals in decisions to withhold or withdraw life-sustaining treatment from adults who lack capacity. This article considers the position in Victoria. A review of the law in this State reveals that medical professionals play significant legal roles in these decisions. However, the law is problematic in a number of respects and this is likely to impede medical professionals' legal knowledge in this area. The article examines the level of training that medical professionals receive on issues such as refusal of treatment certificates and substitute decision-making, and the available empirical evidence as to the state of medical professionals' knowledge of the law at the end of life. It concludes that there are gaps in legal knowledge and that law reform is needed in Victoria. The article also draws together themes from the series as a whole, including conclusions about the need for more and better medical education and about law reform generally. 相似文献

Abstract This article discusses the need to re-imagine multiculturalism and feminism in order to better accommodate women in minority cultures who are religious. It begins and ends with comments about multiculturalism and ‘difference feminism’ in Australia. In the body of the paper I use anthropological field-work in Indonesia, first to show that culture and religion are not separate and immutable, and secondly to show how Muslim women in the women's movement in Indonesia are using Islam to build a multicultural discourse. Comparative scholarship tacitly assumes immigration politics to be relatively rigid. A state's immigration policy legacy is said to institutionalise policy preferences, thereby making it difficult to implement lasting reforms that are inconsistent with that legacy. This presents difficulties for states with restrictionist legacies wanting to implement liberal reforms in response to the emergence of labour shortages or demographic problems. The supposed rigidity of immigration politics is scrutinised in this article through a systematic process analysis of developments in the United Kingdom over the past decade, where the Blair government confounded the UK's characterisation as a ‘reluctant immigration state’ to implement various liberal work visa reforms. The uncoordinated nature of policymaking and implementation, and the limited involvement of state and societal institutions in the reform process, reflect the UK's historical experience with restrictionist policies, and help to explain the subsequent reintroduction of strict visa controls. The case demonstrates that policy legacies indeed play a significant role in defining the character of the policymaking institutions that shape a state's immigration politics. 相似文献
