Abstract

This contribution presents a theory of democratisation through peace-building. Peace-building is seen as an interactive process between external peace-builders and domestic elites; whether a post-war state develops into a democracy or not depends to a large extent on the outcome of the bargaining process between domestic elites and peace-builders. It is argued that domestic elites typically face many constraints which make adopting democratic reforms a risky and costly proposition. Also, peace-builders usually have much less leverage over domestic elites than one would expect given their resources and man-power. High adoption costs and low leverage explain the outcome of the interaction between peace-builders and domestic elites often results in a peace which is not democratic. The paper uses an analysis of 19 major peace-building missions for exemplifying the theory.  相似文献

In contrast to many other areas, international and European influences on national higher education policies remained limited for a long time. This picture changed fundamentally in the late 1990s with the establishment of the so-called Bologna Process which has the objective of setting up a common European higher education area. So far, however, we have limited knowledge about the extent to which this development actually led to the convergence of national higher education policies. Are national policies moving towards a common model, or are domestic reforms rather characterized by the specific conditions given at the domestic level? In this article these questions are adressed with regard to Central and Eastern European countries which are characterized by different pre-communist and communist patterns of higher education policy.  相似文献

Abstract: There are few studies of female stalkers in literature addressing different study populations. There appears to be a high incidence of mental disease among female stalkers, having an important role in inducing the harassment. We present a woman affected by a bipolar disorder who had a long affair with her victim, broken off in 2007. Stalking began in January 2009 and continued for 6 months, during which time she was not taking drugs and was in a decompensated clinical phase. In July 2009, she was denounced for harassment; the authorities demanded a psychiatric examination. The woman then resumed taking the medication regularly. In December 2009, although she was in complete remission, she began stalking once more. This case shows that even when there seems to be an evident relation between psychopathology and crime, it is always necessary to evaluate to what extent the mental disorder is responsible for the criminal behavior.  相似文献

Freedom of information (FOI) laws aim to improve the public’s opportunities to access official information from public authorities and hence to increase the level of transparency. Thus, it is important to know whether and to what degree the effects intended by establishing FOI laws are achieved and how their implementation could be improved. In order to answer these questions, FOI laws have to be evaluated. Unfortunately, attempts to evaluate FOI laws are still in their infancy. To promote sound evaluation, this article aims to provide guidance on how comprehensive FOI law evaluations might be designed and conducted.  相似文献

This article considers how, in light of the changing legal profession and higher education, academia could address professionalism training. The authors put forward an argument that, if professionalism is to be understood as a set of skills, values and attitudes required for any lawyer, it is now a good time to consider how these could be taught and assessed in law and non-law degrees. The formation of professional values and attitudes is a long process that continues throughout a person’s life. The earlier students are exposed to professional values, attitudes and skills, the better the quality of service these future lawyers will provide to the public. Taking into account the Legal Education and Training Review (LETR) recommendations, the article suggests some practical ways as to how professionalism could be developed in higher education.  相似文献

ABSTRACT

The article deals with the consequences of the increasing presence of Chinese citizens in Germany since the end of the nineteenth century. Their presence also repeatedly led to marriages with German women, which challenged by the media, the public and state authorities in many ways. This articles focuses initially on the symbolic and institutional-administrative treatment of such marriages between the German Empire and National Socialism. It identifies a wealth of exclusion mechanisms in a highly regulative migration regime.
