Judicial instructions (traditional American Law Institute vs. Guilty But Mentally Ill [GBMI]) were manipulated within an insanity defense vignette portraying a highly psychotic defendant. Construals were highly predictive of verdicts in both instructional conditions. Instead of influencing case construals, the GBMI option seems to operate by increasing respondents' decisional thresholds for insanity and guilty verdicts, creating a collapsing effect such that few such verdicts are rendered. Between-instruction comparisons reveal that the construals of respondents who choose insane and guilty verdicts are considerably more homogeneous and extreme under the GBMI conditions. Results suggest that many respondents intend their GMBI verdicts to signify diminished blame and punishment, indicating that such verdicts entail cognitive compromises that reflect both the thresholdraising effects and also probable confusion about the jurisprudential meaning of a GBMI verdict.This article is an expanded version of a paper entitled Insanity case construals are not simply verdict justification effects, which was presented at the 99th annual convention of the American Psychological Association at San Francisco, August, 1991. ABSTRACT

This article explains why Vietnam and China, one-party states that allow only one official trade union, are traversing different paths in their trade unions’ institutional structures, the state’s and trade union’s attitudes towards strikes, their willingness to allow independent trade unions and willingness to engage with the international labour union movement. These will be examined in terms of the path dependency of their recent histories, in which changes have been incremental on a path laid down by pre-existing entrenched institutions, until each national system no longer operated properly and new contingencies obliged the leadership to revamp the system. As a consequence of China’s and Vietnam’s divergent path dependencies, when external contingencies finally forced institutional change, countries have veered onto divergent trajectories – the Trans-Pacific Partnership energising Vietnam to debate the acceptance of autonomous trade unions, while Xi Jinping in China has intensified Party control over industrial relations.  相似文献

The three components of hardiness, life events, coping strategies, and psychological distress, were assessed in a sample of 245 Chinese secondary school students in Hong Kong. While commitment, control, and challenge were not clearly differentiable as distinct constructs, three dimensions interpretable as resigned acceptance, cynical concession, and pragmatic orientation emerged. In the stress-distress relationship, hardiness did not interact with stress to moderate its influence on distress, however, both hardiness and stress had independent main effects on distress. Although high hardy students, compared with low hardy students, did not appraise positive events as having greater impact, they perceived that negative events had significantly lesser impact. In addition, low hardy students reported using passive and avoidant coping strategies significantly more frequently than high hardy students.  相似文献

Stressful life events, cognitive appraisals of the impact and desirability of these events, and psychological symptoms were assessed in a sample of 745 Chinese adolescents from six secondary schools in Hong Kong. Reporting that an average of eight events were experienced, these adolescents appraised that over half of these events were undesirable and had twice the impact of desirable events on their lives. These events were generally related to interpersonal problems in schools, in family, and with friends. While the appraisal of the subjective impact of these events was highly associated with the simple counting of events when event–symptom relationship was considered, the pessimistic appraisal of events had an independent and noninteractive effect on general and specific psychological symptoms. However, there was some evidence that positive events might moderate the effects of negative events on psychological distress. Implications of cognitive appraisals in coping with life stressors among Chinese adolescents are discussed.  相似文献

This paper examines the role of the target-based responsibility system for building upright Party style and clean government in combating corruption in local China. It argues that the effectiveness of the target-based responsibility system in corruption control is compromised by a number of implementation hurdles in practice. Based on a close examination of one county, Shaanxi Province in the northwest China, this study shows that low measurability of the targets, the conflict between anti-corruption work and other evaluation targets, and the impact of patronage politics account for the implementation failure of the target-based responsibility system. The fundamental problem lies in that under China’s unified cadre personnel management system, political will can interfere with the handling of corruption on a case-by-case basis, no matter what kind of anti-corruption mechanism is employed. Under this context, the adoption of the target-based responsibility system in fighting corruption results in nothing more than “pouring old wine into new bottles.”

The purpose of the study was to shed light on the potentially differing dynamics of violence against separated and divorced women by their ex-husbands and violence against married women by their current husbands. Using a nationally representative sample of 7,369 heterosexual women from Cycle 13 of Statistics Canada's General Social Survey, available risk markers were examined in the context of a nested ecological framework. Separated women reported nine times the prevalence of violence and divorced women reported about four times the prevalence of violence compared with married women. The strongest predictors of violence against married women, namely, patriarchal domination, sexual jealousy, and possessiveness, were not significant predictors of violence against separated and divorced women. This suggested that post-separation violence is a complex phenomenon the dynamics of which can be affected by much more than domination and ownership.  相似文献

Low self-control is theorized to be a key correlate of delinquency. Using a nonadjudicated sample (N = 1057) from Hong Kong and Macau, the influence of self-control on self-reported violent and nonviolent delinquencies was investigated using Grasmick’s self-control scale. The influences of demographics and self-control on delinquency were also examined. Findings indicate that these adolescents are more likely to engage in overall delinquency, particularly violence, if they are older and if they are less educated. Age is the only demographic predictor of nonviolent delinquency. Risk-seeking behaviors and self-centeredness have significant influences on both violent and nonviolent delinquencies, while low frustration tolerance and preference for cognitive activities are only associated with an increased level of violent misconduct. These findings highlight the overall significant influence of self-control on adolescent delinquency in Chinese adolescents. Suggestions are offered to enhance adolescents’ self-control as a way to reduce their tendency to involvement in delinquent activities.  相似文献

Despite the outward appearance of depoliticization, the civil service in China today is actually being repoliticized. This paper compares the 1993 Provisional Regulations on State Civil Servants with the Civil Service Law approved by the Standing Committee of the National People's Congress of the People's Republic of China (PRC) in April 2005 . The 2005 reform formalized what had been a historical pattern—the Communist Party holds tight control over leadership change and management at various levels. The Civil Service Law has turned the Communist Party of China into a political institution that has become the source of both civil service empowerment and control. Although civil service reform in China differs markedly from approaches adopted elsewhere, China is clearly expanding its political control to ensure greater leverage over the bureaucracy. In this regard, China is in line with the global trend. That said, civil service reform in China has focused on structural elements and formal reorganizations, whereas most industrialized democracies have engaged in a dialectic between individualist and corporate responses to managerial questions. An understanding of the Chinese ability to adopt reforms—while strengthening its traditional hold—provides key perspectives not only on the world's largest nation and a rapidly emerging force in global political and economic relationships but also on the Chinese experience with important public sector reforms that have occurred in many other countries over recent decades.  相似文献
