This article examines arms-length 'regulation' of UK government – the public-sector analogy to regulation of business firms — and assesses the precepts for public-sector regulation embodied in the Blair Labour government's official vision of public-man-agement reform, its Modernising Government White Paper of 1999. As a background to assessing the recipes for public-sector regulation in Modernising Government, the article shows that such regulation grew markedly both in the two decades up to 1997 and in the plans and activities of the Blair government from 1997 to 1999. Against that background, the design principles for public-sector regulation contained in Modernising Government are assessed. The White Paper was notable for embracing a doctrine of 'enforced self-regulation' for the public sector that involved aspirations to both more and less public-sector regulation in the future. It put its faith in a mixture of oversight and mutuality for 'regulating regulation'. But in spite of the radical-sounding tone of Modernising Government, the measures proposed appeared limited and half-hearted, and two well-known institutional design principles for regulation seemed to be missing altogether from the Blair government's view of administrative 'modernity'.  相似文献

We construct models of the endogenous formation of politicalgroups designed to capture some of the key features ofpolitical and social conflict. We draw on the `citizencandidate' approach and consider both instrumental andexpressive approaches to understanding group formation andconflict between groups. We argue that the inclusion ofexpressive elements into the analysis of political groupsprovides both new insights and a better fit with certainaspects of the realities of political conflict.  相似文献

Regulatory impact assessment (RIA) offers the means to improve regulatory decision‐making and practice. RIA involves a systematic appraisal of the costs and benefits associated with a proposed new regulation and evaluation of the performance of existing regulations. So far, the adoption of RIA has been confined mainly to OECD countries. The purpose of this article is to assess the contribution that RIA can make to ‘better regulation’ in developing countries. Results from a survey of a small number of middle‐income countries suggest that a number of developing countries apply some form of regulatory assessment, but that the methods adopted are partial in their application and are certainly not systematically applied across government. The article discusses the capacity building requirements for the adoption of RIA in developing countries, in terms of regulatory assessment skills, including data collection methods and public consultation practices. The article also proposes a framework for RIA that can be applied in low and middle‐income countries to improve regulatory decision‐making and outcomes. Railway posters from the 1920s and 1930s are now regarded as one of the high points of twentieth-century graphic art. While their iconographies have been the subject of considerable scholarly analysis, the contexts in which they operated and functioned have received much less attention. This paper, which focuses on posters produced by Victorian Railways for a range of purposes not necessarily travel related, redresses this. It is argued that railways posters, which operated in conjunction with other forms of railway propaganda, provided a convenient and attractive way for the state to operate on its population, at a distance. Hence, they were used as rhetorical devices to exhort Victorians to travel by rail, to eat more fruit and thereby assist the state’s primary producers. As competition from motorisation became more intense during the Depression, resulting in pronounced and unsustainable rail deficits, the need to diversify the sources of railway revenue, as the analysed posters reveal, became more exigent.  相似文献

Judicial scholars have often speculated about the impact of elections on the administration of justice in the state courts. Yet relatively little research has concerned itself with public perceptions of state court selection methods. Of particular interest is the concept of legitimacy. Do elections negatively affect public perceptions of judicial legitimacy? Bonneau and Hall (2009) and Gibson (2012) answer this question with an emphatic “No.” Judicial elections, these studies show, are not uniquely troublesome for perceptions of institutional legitimacy. This article aims to extend the findings of Bonneau and Hall and Gibson via a laboratory experiment on the effects of elections on public perceptions of judicial legitimacy. In the end, we find that because elections preempt the use of the other main selection method—appointment—they actually enhance perceptions of judicial legitimacy rather than diminish them.  相似文献

The importance of mental illness as a risk factor for violence has been debated with significant implications for mental health policy and clinical practice. In offender samples, psychopathology tends to be unrelated to recidivism, although some researchers have noted that this relationship may be dependent upon certain moderating factors. In the present, prospective investigation, psychopathology is examined as predictors of recidivism in 121 provincially sentenced (i.e. less than 2 years) mentally disordered offenders. Results indicated that psychopathological predictors were generally poor predictors of recidivism in univariate and multivariate analyses. Consistent with our hypotheses, age of onset of criminal activity was a significant moderating factor on the relationship between mental illness and recidivism, although results were not in the expected direction for certain classes of mental illness. Results are discussed in the context of a social learning model of crime and in terms of the treatment of mentally disordered offenders.  相似文献
