Aiming to improve the health of First Nations in 1979, the federal government implemented the Indian Health Policy to strengthen community development and the relationship with First Nations peoples, and nurture a trilateral relationship in the healthcare landscape. The Indian Health Policy remains the foundation for First Nations health policy and program development today, even without ever having an implementation plan. We critically appraise the Indian Health Policy to identify gaps and evaluate its impact and progress on subsequent policy evaluations, developments, and recent events in light of the new distinctions-based Indigenous health legislation underway. Based on our findings, we provide recommendations to inform the federal government's efforts to co-develop distinctions-based Indigenous health legislation.  相似文献

Purpose

Assessments of ongoing fiscal restructuring of juvenile justice system processes and the impact such restructuring has on juvenile incarceration rates are limited. When impacts of fiscal restructuring efforts have been assessed, researchers have focused on systemic, macro level changes in incarceration rates but avoided more focused, micro level impacts. This study fills this knowledge gap by examining the recent implementation of the Redeploy Illinois program in two pilot sites. In the Redeploy Illinois program, financial incentives were provided to select counties to develop community based alternatives to incarceration. The goal was to alleviate over reliance on state funded residential facilities for evaluation and confinement purposes.

Methods

Agency data were analyzed using qualitative methods to examine the effects of this change.

Results

Results of this study demonstrated that counties participating in the pilot test of the Redeploy Illinois program were able to reduce their levels of juvenile commitment to the state. Peoria County exceeded their reduction benchmark for all but two years, and St. Clair County well exceed their reduction benchmark for all full calendar years subsequent to implementation.

Conclusions

Findings are consistent with the limited literature exploring fiscal restructuring efforts designed to reduce county levels juvenile commitments.  相似文献

Autopoiesis is normally considered to be the systems theory in law. In this paper complexity theory is presented as an alternative systems approach. In order to position complexity theory as a plausible alternative to autopoiesis I discuss the differing understanding of boundary within each theory, and use this as a vehicle to critique autopoiesis. My critique is situated within systems theory thinking but is external to both autopoiesis and complexity theory (although I must oscillate between the two objects of critique). Because both approaches possess an understanding of boundary it provides an effective tool to contrast their differences, while permitting each to be described in its own language. It is argued that complexity theory offers an approach to boundaries as contingent, emergent interfaces, which the autopoietic construction of boundary can learn from in several ways. More generally it is suggested that the complexity approach to boundaries offers lawyers engaging with systems theory a new critical perspective to assess legal constructions.  相似文献

The article looks at the development of parliamentary institutions and procedures in Russia and the extent to which Russian politicians have been interested in learning from ‘mature’ democracies.

There are few examples of parliamentary practices being transplanted without significant adaptation. The debate in Russia on the role of parliament indicates that the idea of imitating foreign models has to compete with the powerful notion of rediscovering a national democratic tradition and both are used rhetorically to support particular interests. Parliamentary rules and practices are organically linked with party organisation, with the balance of parties at any given time, with electoral law, and with the relationship of the executive to the legislative branch. Changes in political habits take time.

International contacts are valuable because they lend confidence and authority to those who are working to build on democratic habits, but it is more important that parliamentarians and officials should find solutions which are internally consistent, which work with the grain of their own slowly evolving political culture and which reflect the most positive of their own traditions, than that they should assemble best practice from around the world.  相似文献

Third party labour contractors are increasingly prevalent in global production networks (GPNs), and can provide a channel for new forms of unfree labour. Review of case study evidence from South African and UK horticulture suggests this often emerges off-site through labour intermediaries. Analytical approaches to labour in GPNs and value chains are examined. The article argues that labour contracting is driven by the commercial dynamics of global outsourcing. A ‘cascade system’ allows unscrupulous intermediaries to coerce vulnerable workers. We examine strategies of civil society alliances, and regulatory reform, and argue for extending liability of all commercial actors across global boundaries.  相似文献

Purpose. There were three objectives of this study: (1) To assess the possibility of using pupil diameter as an index of deception in the context of a comparison question polygraph test. (2) To determine if pupil diameter would make a significant contribution to an optimal multivariate classification equation in combination with the traditional predictor variables used in field polygraph practice. (3) We explored the possibility of replacing one or more of the traditional predictor variables with pupil diameter. Methods. We used a laboratory mock crime experiment with 24 participants, half of whom stole $20 (US) from a secretary's purse. Participants were tested with a comparison question test modelled after standard field practice. Physiological measures were taken with laboratory quality instrumentation. Features were extracted from the physiological measures. Those features were subjected to a number of different statistical analyses. Results. Innocent participants showed larger increases in pupil diameter in response to probable‐lie questions than to relevant questions. Guilty participants did not show differential responding to the question types. The additional of pupil diameter to a multivariate classification model approached, but did not reach significance. Subsequent analyses suggest that pupil diameter might be used to replace the traditional relative blood pressure measure. Conclusions. Pupil diameter was found to be a significant predictor variable for deception. Pupil diameter may be a possible replacement for the traditional relative blood pressure measure. Additional research to explore that possibility would seem to be warranted.  相似文献
