This introductory article overviews the articles in this special issue on emerging technologies in the legal system. The articles concern videotaped confessions, videoconferencing in criminal proceedings, animations and simulations, and immersive virtual environment technology. Abstract. This essay addresses the concepts of compromise and coercion. When compromise takes place between two or more parties, reciprocity must be present; that is, the concessions are mutual. A relevant distinction is between principled and tactical compromise. A principled compromise refers to a mutual recognition by each side of the other's rights, which leads them to make concessions to enable them to meet on a middle ground. It is genuinely made in good faith and both sides reconcile themselves to the results. On the other hand, the notion of tactical compromise reflects a temporary arrangement reached as a result of constraints related to time. Here, in fact, agents do not give up any of their aims. They do not act in good faith and do not intend to meet their counterpart on a middle ground. Instead, they simply realize that the end could not be achieved at a given point of time, and they aim to reach it stage by stage. The essential component of compromise, namely, mutuality, is lacking. Next, the paper draws a further distinction between internalized coercion and designated coercion. Internalized coercion relates to the system of manipulation to which members of a certain sub‐culture are subjected, which prevents them from realizing that they are being coerced to follow a certain conception that denies them basic rights. Designated coercion is individualistic in nature, aimed at a certain individual who rebels against the discriminatory norm. Unlike the internalized coercion it is not concerned with machinery aiming to convince the entire cultural group of an irrefutable truth; instead it is designed to exert pressure on uncertain, “confused” individuals so as to bring them back to their community. Ever since I assumed my present office my main purpose has been to work for the pacification of Europe, for the removal of those suspicions and those animosities which have so long poisoned the air. The path which leads to appeasement is long and bristles with obstacles. The question of Czechoslovakia is the latest and perhaps the most dangerous. We merge Exploratory Spatial Data Analysis (ESDA) and a semi‐parametric, group‐based trajectory procedure (TRAJ) to classify communities in Chicago by violence trajectories across space. Total, street gun and other weapon homicide trajectories are identified across 831 census tracts between 1980 and 1995. We find evidence consistent with a weapon substitution effect in violent neighborhoods that are proximate to one another, a defensive diffusion effect of exclusively street gun‐specific homicide increases in neighborhoods bordering the most violent areas, and a spatial decay effect of temporal homicide trends in which the most violent areas are buffered from the least violent by places experiencing mid‐range levels of lethal violence over time. In merging these two methods of data analysis, we provide a more efficient way to describe both spatial and temporal trends and make significant advances in furthering applications of space‐time methodologies.  相似文献

This article sharpens our understanding of the intersection of the discourses of gender and power in the woman principal's role by an in-depth study of Alice Havergal Skillicorn, Principal of Homerton College, Cambridge, 1935-60. Like previous principals, Skillicorn constructed a subjectivity which was dual gendered. In her public life as principal, she adopted a masculine discourse of power which subordinated feminine discourse into the private sphere. But this marginalisation of feminine discourse in her public role made her unable, except in her most intimate emotional relationship, to enact an appropriate femininity in her private life. After a theoretical and contextual introduction, it is shown how Skillicorn marginalised and negated her femininity through her body, by failing to adopt feminine standards of attractiveness in her appearance and clothes. She successfully wielded autocratic power in the public sphere with a masculine discourse of political skill, financial acumen and, most importantly, an instrumentality in her dealings with staff and students, which was entirely devoid of a feminine desire to be liked. The difficulties she faced in the private sphere - difficulties which were assuaged but not overcome by homoerotic friendship - are also discussed.  相似文献

Research on links between ethnic diversity and performance frequently illustrates that organizational diversity leads to process-oriented problems and negative work-related outcomes. This can cause problems for public managers who are tasked to increase workforce diversity for normative purposes but are nonetheless required to focus on performance goals. In this study, we test the proposition that managers can improve work-related outcomes in diverse organizations by focusing on stability and allowing diverse groups to 'get to know' one another, a process that should improve communication and coordination difficulties inherent in ethnic diversity. Our results show that the negative relationship between ethnic diversity and organizational performance does indeed lessen with time and stability.  相似文献

Since the beginning of the 1990s the public healthcare system in England has been subject to reforms. This has resulted in a structurally hybrid system of public service with elements of the market. Utilizing a theory of new institutionalism, this article explores National Health Service (NHS) managers' views on competition and cooperation as mechanisms for commissioning health services. We interrogate the extent of institutional change in the NHS by examining managers' understanding of the formal rules, normative positions and frameworks for action under the regime of the Health and Social Care Act 2012. Interviews with managers showed an overall preference for cooperative approaches, but also evidence of marketization in the normative outlook and actions. This suggests that hybridity in the NHS has already spread from structure and rules to other institutional pillars. The study showed that managers were adept at navigating the complex policy environment despite its inherent contradictions.  相似文献
