This article examines the impact on jurors of exposure to media coverage of legal issues. Jurors' decisions may be influenced by a broad range of legally relevant information gleaned from media sources, including newspaper reports, radio and television news, advertising, movies, and televised crime shows and courtroom scenes. The article gives examples of these influences from real-world cases and from simulated research studies. It focuses on the impact of trial-relevant publicity on jurors in cases unrelated to the one being publicized; the ways that media representations of the justice system may influence jurors' expectations and decisions; the influence of insurance company advertisements on jurors' damage awards; and the impact of viewing pornography on jurors' decision making. In response to concerns that jury awards in tort cases are excessive and unpredictable, nearly every state legislature has enacted some version of tort reform that is intended to curb extravagant damage awards. One of the most important and controversial reforms involves capping (or limiting) the maximum punitive damage award. We conducted a jury analogue study to assess the impact of this reform. In particular, we examined the possibility that capping punitive awards would cause jurors to inflate their compensatory awards to satisfy their desires to punish the defendant, particularly in situations where the defendant's conduct was highly reprehensible. Relative to a condition in which punitive damages were unlimited, caps on punitive damages did not result in inflation of compensatory awards. However, jurors who had no option to award punitive damages assessed compensatory damages at a significantly higher level than did jurors who had the opportunity to do so. This paper is guided by Conservation of Resources theory and aims to investigate the impact of personal and organisational support on the quality of clinical care given to aged care residents in for‐profit (FP) and not‐for‐profit (NFP) facilities. Broadly, the paper addresses challenges faced by governments in designing contract specifications that ensure quality outcomes from aged care providers. The argument is that the present accreditation standards that are used to assess the status of aged care providers are too narrow to capture the complexity in delivering social services. Data were collected from 442 aged care workers from aged care facilities in NSW, QLD and WA. The results show that carer support (personal and organisational support) explained half of the variance in quality of clinical care in NFP facilities, and a third of the variance in FP facilities. In particular, the findings suggest support for carers is important for carer retention, and ultimately the clinical care of residents. The findings provide supporting evidence to widen the required contract specifications for aged care provider accreditation to include organisational and personal support for carers. 相似文献

This article examines to what extent the Arab Spring constitutes a critical juncture – a major turning point – for the EU’s sanctions policy towards Egypt, Libya, Syria and Tunisia. Based on a multidimensional critical juncture operationalization, we find that the Arab Spring only constitutes such a turning point for the EU’s sanctions policy towards Syria. Both the level and nature of measures differ substantially from previous years. By contrast, the EU’s sanctions practice towards Libya, Egypt and Tunisia shows more resilience. More generally, changes in the nature of the measures are prominent, whereas changes in the level of the policy instruments and in underlying norms and goals are limited. 相似文献

A Third Verdict Option: Exploring the Impact of the Not Proven Verdict on Mock Juror Decision Making
In most adversarial systems, jurors in criminal cases consider the binary verdict alternatives of "Guilty" and "Not guilty." However, in some circumstances and jurisdictions, a third verdict option is available: Not Proven. The Not Proven verdict essentially reflects the view that the defendant is indeed culpable, but that the prosecution has not proven its case beyond a reasonable doubt. Like a Not Guilty verdict, the Not Proven verdict results in an acquittal. The main aim of the two studies reported here was to determine how, and under what circumstances, jurors opt to use the Not Proven verdict across different case types and when the strength of the evidence varies. In both studies, jurors were more likely to choose a Not Proven verdict over a Not Guilty verdict when the alternative was available. When evidence against the defendant was only moderately strong and a Not Proven verdict option was available (Study 2), there was also a significant reduction in the conviction rate. Results also showed that understanding of the Not Proven verdict was poor, highlighting inadequacies in the nature of judicial instructions relating to this verdict. 相似文献

Public services have been externalised, in part, to the non‐profit sector in France and in the United Kingdom. This article begins by reviewing relations between the public and non‐profit sector in France before 2008, and its evolution since. This has been characterised by the slow reduction of public funding, the adaptation of non‐profit associations and organisations, and their clearer positioning within a wider ‘social and solidarity economy’, which was consolidated by a framework Law in 2014. The article then examines the current sharing of responsibilities between the public and non‐profit sectors in education, health and social services, pointing to the diverse historical and political conditions which have led to this shared organisation. 相似文献

With the aim of identifying predictors for being granted a residencepermit, adult members of 149 refugee families from the MiddleEast answered a structured interview shortly after arrival onsocial and demographic background and family exposure to organizedviolence. At follow-up, 90 families (60.4 per cent) had beengranted a residence permit. This was positively associated withIraqi nationality, with the duration of the father's educationand the family's religion being another than Islam, and negativelywith being a single mother family. No association was foundwith exposure to war, having lived in a refugee camp or to humanrights violations. Burma's little-known frontier war is the context of six interviews with tribal people affected by the conflict. Burmese military abuse of ethnic minority civilians in the war zone includes forced labor, systematic looting, torture and destruction of tribal villages.
