Examining Nepalese Forestry Governance from Gender Perspectives

This article examines Nepalese forestry governance from gender perspectives. We argue that gendered institutional norms and values are associated with forest-governing institutions, such as forest bureaucracies, shaping the nature, and extent of women’s involvement in decision-making processes in the Nepalese forest bureaucracy. Studies on Nepalese forestry reveal that substantial progress has been made in forming policies and initiating activities for including women in forestry governance of Nepal; however despite this, gendered dynamics create difficulties for women to enter and progress in the forestry profession, thereby creating gendered employment territories through institutional, legislative, normative, and infrastructural measures.     

Exploring the criminal histories of stranger sexual killers

Although sexual homicide is receiving increasing research attention, few studies have examined the criminal histories of sexual killers in any detail. This study examined the criminal histories of 81 British stranger sexual killers to determine whether they were generalist, specialists or both and whether their criminal histories reflected violent, sexual, marginality and over control pathways. Results found most stranger sexual killers were generalist offenders and sexual homicide was part of a varied criminal repertoire and non-sexual crimes predominate. This ‘antisocial orientation’ means future offending may not be limited to sexual violence. Criminal histories reflected the violent, sexual, marginality and over control pathways, but offenders in the violent pathway were more criminally orientated. The clinical and investigative implications of these findings were considered as they suggest knowledge of the criminal histories of stranger sexual killers is an important consideration for criminal justice professionals.     

The Shadows of the Law: Contemporary Approaches to Regulation and the Problem of Regulatory Conflict

Regulatory analyses often assume that compliance is desirable, with literature focusing on strategies to encourage "excellence" in adherence to regulatory goals. Yet, it is not unusual for disparate regulatory goals to exist that are based on competing values of what constitutes the "good society." It is this conflict that forms the substance of this paper. In cases of competing regulatory goals, techniques that encourage exemplary compliance in one area can create incentives to breach regulatory provisions of a competing regime. In such cases, generic regulatory techniques are unable to provide a useful means for resolving regulatory conflict but do allow a political delegation of conflict resolution to the "scientific" strategies of the regulator. In turn, the regulator places responsibility on companies for resolving competing regulatory demands. Successive delegation leads to juridification as well as regulators vying to retain primacy for their regime. This problem is examined through analysis of responsibilities for subcontractor safety under Australian health and safety law and sections of the Australian Trade Practices Act 1974 aimed at protecting competition.
