This article centers on the study of the Spanish private prosecution system. It is an attempt to highlight both its theoretical potential and its practical dysfunctions. This type of lay participation in criminal matters is often seen as a way to strengthen democracy or to legitimate justice, opinions that the author rejects. Although private prosecution may work as a safety valve against the public prosecutor's inactivity, the introduction of private interests in the penal process may distort its true significance and function. Private prosecution can become a Trojan horse within the system.  相似文献

Two important and understudied dimensions of the interaction between politics and the digital revolution are the impact of digital technology on the ability of nongovernmental organizations (NGOs) to win more media coverage and to successfully influence the political processes. This original quantitative comparison of 50 Israeli NGOs examined two main issues: the impact of technology on the ability of organizations to achieve mass media and political success and whether some groups are better positioned than others to exploit technology to their advantage. A theoretical concept labeled digital fit was introduced and put to a statistical test using data from a survey of 50 NGO leaders and a survey of 15 key politicians who were asked to rank the political impact of organizations they are familiar with from relevant parliamentary committees they are members of. Digital fit is defined as a cluster of digitally related variables that puts political actors in a better position to harness digital technology to self-produce and self-distribute multimedia messages for the purpose of advocating their cause to mass media outlets and politicians. A prospective dimension of digital fit is its potential to stimulate power shifts between the old guard of successful political-communication actors and a new breed of successful challengers. Results showed that digital fit had a strong positive direct effect on mass media success and a mediated influence on political success. There are positive signs that conventional models are shifting in a way that empowers new political actors.  相似文献

Firearms identification imaging systems help solve crimes by comparing newly acquired images of cartridge casings or bullets to a database of images obtained from past crime scenes. We formulate an optimization problem that bases its matching decisions not only on the similarity between pairs of images, but also on the time and spatial location of each new acquisition and each database entry. The objective is to maximize the detection probability subject to a constraint on the false positive rate. We use data on all cartridge casings matches detected in Israel during 2006–2008 to estimate most of the model parameters. We estimate matching accuracy from two different studies and predict that the optimal use of extraneous information would increase the detection probability from 0.931 to 0.987 and from 0.707 to 0.844, respectively. These improvements are achieved by favoring pairs of images that are closer together in space and time.  相似文献

There Williams talks about seeing two starlings, just before alighting, turning in the air together backwards--but what got to him, he says, was that in doing so, they faced "into the wind's teeth." Commenting on the poem, Denise Levertov points out that, while it is a celebration of life, it also tells us that life sometimes requires adroit manoeuvering, its fullness emerging when we work not against but in cooperation with that which makes it most difficult. Portrayals of suicide in the media are controversial because they may impact on suicide rates and methods. The aim of this study was to analyze the effect of the broadcast of a television documentary wherein an adolescent girl is interviewed about her suicide plan and subsequently dies by suicide. National suicide rates during the 8 weeks prior to the program and the 4 weeks following it were compared to the same periods in the previous year. There was no significant difference in the rates of completed and attempted suicides before and after the program. There was a shift toward the method used in the film after the broadcast, but it was found to be nonspecific to that year. A significant decrease was noted in the mean age of suicide attempters in the last promotional week prior to the broadcast compared to the previous year (p = .032). These preliminary findings suggest that the repeated televised promotion of a documentary on suicide may raise the risk of suicide in vulnerable populations. Further investigations in bigger populations are needed.  相似文献

This article is an analysis of Israeli military snipers who served during the Al-Aqsa intifada. It takes issue with the scholarly consensus that, for such acts to take place, perpetrators have to somehow dehumanise their enemies. Based on interviews with 30 individuals, it shows that snipers do not always need to dehumanise their targets and that they experience killing in conflicting ways, both as pleasurable and as disturbing. The snipers simultaneously deploy distancing mechanisms aimed at dehumanising enemies and constantly recognise their basic humanity. The article ends on a cautionary note: violence should not be seen as only belonging to the realm of the pathological. Rather we must be aware of rules of legitimate violence, the culturally specific ideology of violence at work in specific cases. This kind of ideology may ‘humanse’ enemies but still classify them as opponents against which violence may be legitimately used.  相似文献
