Recent research has begun to examine whether participants in dating violence studies perceive any benefit from the research and/or experience emotional distress as a result of having participated. Such information is important for Institutional Review Boards (IRBs) and researchers in determining ethical and appropriate protections for participants. In the current study, we examined participants’ reactions to answering questions on dating violence victimization and perpetration utilizing a sample of female college students (N?=?282). We also examined whether distress tolerance was associated with research reactions and moderated the relation between reports of victimization/perpetration and negative emotional reactions to the research. Findings demonstrated that negative emotional reactions to the research did not differ between individuals with or without previous dating violence. Further, distress tolerance had a main effect, but not a moderating effect, on negative emotional reactions to research participation. Implications of these findings for future research and IRBs are discussed. 相似文献

There is no greater error in law and bioethics than the continuing opposition to applying the concept of property to posthumous conception cases and the human body generally. The aim of this article is to challenge this error and the assumptions underpinning it. The language of property, conceived of as a "web of interests", can be used to capture and identify the social, moral and ethical concerns that arise in cases concerning the human body, a position that finds support from a correct reading of the early High Court of Australia's decision in Doodeward v Spence (1908) 6 CLR 406. However, a key issue on which the language of property is silent is how to quantify the various competing interests in the posthumous conception case: the concept is useful only insofar as it provides the device for capturing the entirety of the posthumous conception problem. 相似文献

Throughout North America, there has been an increasing interest in the development of alternative forums for dispute resolution that may more effectively address the needs of victims, offenders, and the community. Concurrent with this has been an attempt to alter the adversarial framework of the criminal justice system. This has included the development and implementation of case processing strategies premised on restorative justice and attempting to secure the participation of communities as partners in the resolution of disputes. One particularly innovative initiative is circle sentencing, which has been implemented in several communities in the Yukon, Canada. The procedure by which cases are processed in circle sentencing is outlined and the involvement of the offender, the victim, the community, and the territorial court are discussed. 相似文献

Throughout American history, a peculiar and recurrent disjunction has often arisen between the substance of transformative reforms and the decidedly less‐radical governing arrangements that arise in the aftermath of reform. To account for this disjunction, this article puts forth a theory of postreform “recalibration.” Political processes of recalibration are the means by which vague, indeterminate principles of reform are given operational meaning and translated into new governing arrangements. This article illuminates recalibration processes by examining two case‐studies: African American rights in the post‐Reconstruction era of the 1870s and 1880s, and labor rights in the post–New Deal era of the late 1930s. Finally, the article also highlights the crucial role of the Supreme Court in recalibration processes and sets forth a theory of judicial behavior as driven by an institutional interest in stability. 相似文献

Pesticide regulation is a data-intensive activity that is strongly controlled at the federal level. The pesticide law FIFRA controls pesticide sale, use, and disposal. Normal use of pesticides is excluded under RCRA and CERCLA. There are approximately 1,000 pesticide active ingredients with highly diverse functions ranging from insecticides to disinfectants and pheromones (insect sex attractants). There is a relatively large database on many pesticides, which helps reduce uncertainty in risk assessments. Witnesses subject to Daubert should be familiar with the data as well as the computer models designed for pesticides. “Inert” ingredients that are formulated with the pesticide active ingredients can become issues in torts cases. Federal courts have ruled both in favor and against FIFRA preemption, i.e., the ability of a plaintiff to seek relief in a torts case may be blocked by FIFRA. Golf course permitting provides a special land use whereby fundamental pesticide risk and regulatory issues are debated at the level of local planning and zoning commissions. 相似文献

This article criticises the ontological assumptions outlined in Colin Hay's recent book Political Analysis (2002). It takes issue with Hay's interpretation of critical realism, in particular his reading of the work of Margaret Archer. Furthermore, it is suggested that Hay's understanding of the structure-agency relationship contains weaknesses which have implications for both his theoretical and empirically-based work.
