In this article we evaluate whether the Supreme Court's much-discussed decision in Chevron v Natural Resources Defense Council (1984) signaled a lasting difference in how the justices decide administrative law cases, by comparing and testing the predictions of three distinct theories of Supreme Court behavior. The legal model predicts an increase in deference to administrative agencies. This prediction is shared by the jurisprudential regime model, which also predicts that the justices evaluate key case factors differently before and after Chevron . The attitudinal model predicts no change in the justices' behavior as a result of Chevron . Although we find that attitudes matter, the fact that we also find support for the legal and jurisprudential regime models undermines the assertion of the attitudinal model that law cannot explain Supreme Court votes on the merits. 相似文献

The disarmament experienced during the last decade is over and the world seems poised for a new arms race. While the US government shows an open disinterest in negotiated arms control and bases its policy on a strong military posture, European governments also seem to have put arms control on the back burner. Governments and experts argue about the perceived gap in military capability between the US and Europe while in reality the actual important gap exists between NATO and the rest of the world. Most comprehensive discussions of the police acknowledge the inability of legal and bureaucratic regulations to determine officer behavior. Attention is turned instead toward the informal norms developed within the police subculture. These discussions, however, tend to overstress the chasm between the formal and informal. They also provide inadequate tools for understanding differentiation, conflict, and change within police departments. I address these shortcomings here by mobilizing a particular conceptualization of the term "normative order"—as a set of rules and practices oriented around a central value. Six such orders are crucial to policing: law, bureaucratic control, adventure/machismo, safety, competence, and morality. I illustrate the importance of each by drawing upon ethnographic observations of the Los Angeles Police Department, and explain how my conceputalization offers a comprehensive yet flexible means to understand the social world of policing. 相似文献

This article provides a demographic exposition of the changes in the U.S prison population during the period of mass incarceration that began in the late twentieth century. By drawing on data from the Survey of Inmates in State Correctional Facilities (1974–2004) for inmates 17–72 years of age (N = 336), we show that the age distribution shifted upward dramatically: Only 16 percent of the state prison population was 40 years old or older in 1974; by 2004, this percentage had doubled to 33 percent with the median age of prisoners rising from 27 to 34 years old. By using an estimable function approach, we find that the change in the age distribution of the prison population is primarily a cohort effect that is driven by the “enhanced” penal careers of the cohorts who hit young adulthood—the prime age of both crime and incarceration—when substance use was at its peak. Period‐specific factors (e.g., proclivity for punishment and incidence of offense) do matter, but they seem to play out more across the life cycles of persons most affected in young adulthood (cohort effects) than across all age groups at one point in time (period effects). 相似文献
