检察机关适应“以审判为中心”诉讼改革探析

现行"以侦查为中心"的诉讼模式在传统文化和当代政治性方面具有深刻的历史根源及诸多弊端。"以审判为中心的诉讼制度"改革已在全国范围内逐渐推进,检察机关应探讨适应"以审判为中心"改革的具体应对措施,审前唱好主角,庭中当好配角,以推动检察职能行使更加科学化。     

论旅游合同惩罚性违约金的设定

当下立法在旅游者权利救济上存在不足。惩罚性违约金担保债务履行、降低交易成本、维护市场秩序的功能决定了旅游合同惩罚性违约金设定的必要性。惩罚性违约金的设定应限于特定情形，以旅游经营者主观上的故意和重大过失为必要条件，并与损害赔偿相脱离。在适用上应体现形式的纯粹性、内容的确定性、变更的限定性和与其他规则的协调性。     

东亚国际体系转型:历史演化与结构变迁

本文依据学界已有的研究成果阐释了国际体系及其转型的涵义。所谓转型涉及到两个问题,即转型的主体和转型的起点与方向问题。国际体系包括本体构成要素和结构构成要素,而结构构成要素包括权力结构、制度结构和观念结构。本文依此框架考察了国际体系转型的历史脉络及其构成要素所表现出来的具体特征,并在此基础上探讨了东亚地区国际体系的转型问题。     

Development and Humanitarian Agencies Behind the Lines: Establishing Security in the Operational Space

It has been widely recognized that development and humanitarian agencies play a key role in post-conflict peace building. The anarchical and chaotic conditions of failing states are considered the sources of conflict. International military response is not enough to uproot the sources or to prevent conflict from reviving. In the long term, coordinated development and humanitarian program are required to help failing states reform their political institutions, improve security and judicial systems, promote social and economic development, and eradicate underlying socio-economic, cultural and humanitarian problems leading to the conflict. ① It is not equally recognized,however, that development and humanitarian agencies also contribute in the campaign by international military forces to establish a workable level of security in the operational space. In this essay, I examine three important roles that development and humanitarian agencies play in this regard, namely: mine action, Disarmament, Demobilization,Rehabilitation and Reintegration (DDRR) , and intelligence.

非刑罚处罚司法适用情况调查与法理研究

非刑罚处罚措施在实践中极少被适用。由于我国《刑法》第37条规定的非刑罚处罚方法并不丰富，“犯罪情节轻微不需要判处刑罚”、“可以根据案件的不同情况”等条件设置缺乏量化内容，导致非刑罚处罚的标准非常模糊。检察机关是非刑罚处罚刑事适用的当然主体。非刑罚处罚适用条件包括犯罪情节轻微性、刑罚处罚豁免性、非刑罚处罚必要性等三方面内容。非刑罚处罚适用范围应按照合法性原则界定，只有刑法规定应当或者可以免除刑罚的情形，才能予以适用。     

中国古代分裂格局中的“统一性规范”——以宋、明两朝历史为例

本研究试图借鉴国际关系研究中对规范结构的关注,从社会学角度和体系层次来理解国家的战略行为。行为体间的规范结构在不同时期各有不同,因此,对战略文化的研究不能代替对"统一性规范"的研究。统一性规范兼具管制性与建构性效用,并使分裂格局中各分立政权进行"正统"身份的建构,使之保持争取国家统一的进攻性行为。基于以上视角,本文选取宋、明两朝的历史来验证统一性规范两种效用的存在。本研究对于解释当代中国的战略逻辑有一定意义,有助于澄清西方学界和政界对当代中国战略行为的误解,有利于我们论证当代中国与周边政权建立和平关系的可能性与必然性。     

Party Building in Urban Business Districts: organizational adaptation of the Chinese Communist Party

In order to consolidate its membership basis and maintain its political leadership in the non-state sector of the economy, the Chinese Communist Party (CCP) has been rebuilding its primary party organizations (PPOs) in China's urban business districts. Since residents' committees are either weak or do not exist in many urban business districts, local party authorities create umbrella party organizations to foster and territorially restructure PPOs. Four general models of establishing umbrella party organizations can be found, and the CCP has been building its ‘service-oriented PPOs’ to accommodate the needs of the business world. While such party building strategies demonstrate the resilience and adaptability of the CCP, they might also pose potential risks to the Party.
