This article analyses two judgments by the ECHR on granting authorization to adopt to non-heterosexual people. E.B. v. France overturned Fretté v. France, establishing that refusing to grant adoption licences to gay, lesbian, and bisexual applicants is against the provisions of Article 14 (in conjunction with Article 8) of the European Convention. In Fretté, an adoption licence was not granted to a single gay man due to, notably, 'lack of scientific consensus' on the advisability of child rearing by non-heterosexuals. In E.B., it was established that prejudice against sexual minorities had 'contaminated' the reasoning of the French administrative courts. The cases are considered from a sociological viewpoint, stressing that it is of vital importance to look at the non-legal expertise, knowledge, and theories referred to. Because of the politicized nature of the issue, scientific consensus or lack of it cannot be considered the final yardstick, and judges and decision-makers are faced with an inevitable political choice. 相似文献

Purpose. The goal of the current study was to examine psychopathy and indirect measures of deception detection. Methods. Undergraduate students (N=444) viewed video clips of adult male offenders telling true and false stories about crimes. For each story, participants rated indirect measures of deception (thinking hard, nervousness, emotional arousal, and attempting to control behaviour) and credibility. Participants also chose the story they believed to be true and rated the confidence in their decision. Offenders were rated on the psychopathy checklist – revised. Results. Consistent with past research, deception detection accuracy was at chance level and unrelated to confidence. Ratings on indirect measures by undergraduates did not distinguish true and false statements in offenders. Psychopathic offenders were less successful at deception than non‐psychopathic offenders. Psychopathic traits were associated with lower perceived credibility during deception and ratings of thinking harder while lying. Conclusions. The results suggest that indirect measures of deception detection may be less useful in offender samples. Further, the findings are consistent with the general inability of psychopathic offenders to demonstrate superior deception skills in empirical studies. Indirect measures of deception uniquely related to psychopathic traits offer new insight into the relationship between psychopathy and deception. 相似文献

Prior research has identified gender as a significant predictor of crime fear. Specifically, women are typically more fearful of crime than men, despite being relatively less likely to be victimized. The current study examines different ways men and women may think about crime and victimization within their neighborhoods, using contemporary social-psychological models of victimization worry. Data were collected from a sample of community residents (N = 713) living on the Gold Coast of Queensland, Australia. Results suggest that men’s and women’s fear of crime and perceptions of victimization threat are dependent on crime type and can be represented by a number of relationships among different social-psychological dimensions of victimization worry. This article explores the dynamics of Richard Move's drag performance of the late Martha Graham. Drag dance is remarkably self-aware as historiography, and it employs a rhetoric of bodies becoming other bodies: channeling, paying homage, re-embodying, reliving, being possessed. This article argues that drag dance has a historical project for dance history; specifically, that drag bodies can become a new medium through which aesthetic/kinetic histories are transmitted. In the case of Richard Move, the exaggeration and excess of the ageing Martha Graham become modalities that align with the ‘wrongness’ of his body. This is drag dance as a strategy of re-embodiment after the original body has been lost, and Richard Move presents his performance as a ‘haunting,’ much like the feeling Martha Graham describes as the result of a dancer's “first death,” when she watches someone else dance a role she had originated. Ballets like Graham's Lamentation and Cave of the Heart give Move the opportunity to portray Graham's struggle to continue to dance after this “first death,” using drag as a strategy to show up the eerie perfection of voice against the hollowness of the ageing dancer's body. Combining vaudeville and séance, moving from the restless gay “underworld” of the Meatpacking District to the right to presume himself the heir to the mother of modern dance, Richard Move first embodies and then moves beyond Susan Sontag's camp “etc etc” of Graham's self-performance. 相似文献

Taking as its starting-point emerging discussion about genderand nationalism, this article considers the masculinities constructedby and for adolescent males born into a Palestinian refugeecamp in Jordan. I consider the relationship of these masculinitiesto the construction of the camp as a moral and socio-politicalspace. Through the employment of ethnographic material, thearticle demonstrates the ways in which young males—throughthe performance of a particular, dominant vision of masculinitytermed mukhayyamji—serve to reproduce the camp as authenticlocation of an exilic national community. The article also examinesthe implications for individual young men of this interplaybetween masculine performance and the reproduction of the campas a moral and socio-political space. It explores the consequencesboth for those who fail or choose not to uphold the idealized,mukhayyamji adolescent masculinity and for those who evincethe skills and qualities that this entails. It is argued that,while the former risk marginalization from the camp as a moraland socio-political community, the latter face marginalizationfrom the economic life of wider Jordanian society and, withthat, endanger the transition to social adulthood.
