We bring together a collection of papers that were presented at the inaugural event of the Asia‐Europe Energy Policy Research Network (AEEPRN), held at Singapore in May 2012. The idea for creating AEEPRN was in response to the growing importance of energy in Asia and Europe’s relations and to our shared belief that energy will become a more significant aspect of these relations over the forthcoming years and decades. Facial composite research has mainly focused on their investigative value. No. comparable attention was drawn to their probative value – the extent to which a composite image may serve as incriminating or exonerating evidence against a defendant. The existing data resulting from mock-juror research allow only cautious conclusions and applies solely to the common law system. Therefore an experiment was conducted involving laypeople (N = 74) and prosecutor apprentices (N = 72). All participants received case materials of a robbery committed by a young male, including the victim's and defendant's testimonies and other evidence. In both samples, the facial composite evidence was manipulated so that participants viewed a composite image that was either a good or a poor match to the defendant. A facial composite that bore a strong resemblance to the defendant influenced the assessment of the eyewitness' credibility in the apprentices sample, but failed to affect other dependent variables. Surprisingly, laypeople ignored the facial composite no matter how well it resembled the defendant. Significant differences in the assessment of eyewitness' credibility, the strength of the defense case, the credibility of the defendant's alibi, and his culpability were found between the prosecutor apprentices and laypeople. This article argues that the Chinese idea of agency problem is misconstrued. The analysis provides an alternative approach to empirically reassess the nature of the problems, along the principal-agent models. The article demonstrates the relevance of using law to make the case for the profitability of examining the issues of bureaucratic governance from principal-agent perspectives. The analysis concludes by arguing that bureaucratic governance in China cannot be achieved by intensifying hierarchical domination. The concern about agents’ moral quality cannot sufficiently induce responsible bureaucratic behaviour. The key to reinventing the bureaucratic state in China lies mainly on the recognition of the agents’ need for protecting their own interests. Seen in this fashion, macro-level alternative methods of accountability should be introduced to reflect the interests of both principal and agents. 相似文献

In examining how Chinese policy makers and law drafters defined problems and formulated solutions, this article seeks to address two questions. First, the authors consider the extent to which China's civil service system has embraced principles and features of Western civil service systems. Second, the authors illustrate the political nature of the attempt to establish a civil service system, which severely limits a rational policy design in China. China's State Council has charged that in 2009 BHP Billiton inflamed Australians' fear of “Chinese colour” in order to undermine Chinalco's (Aluminium Corporation of China) effort to increase its share of the Rio Tinto company. Though unproven, this is a serious charge and the more so because it suggests there is a risk that in the future firms challenged by Chinese competitors may emulate the alleged practice. Given this possibility, anti-racists require a sophisticated understanding of how firms might incorporate Sinophobia into their business strategies and how Chinese foreign direct investment is viewed by national and local communities. Social security regimes must be underpinned by enforcement mechanisms designed to compel employers to fulfil their contribution requirements. In this paper we extend debate on China's social security system by discussing whether the inclusion of re-integrative shaming in the repertoire of mechanisms the state utilises to enforce employer compliance is likely to prove effective. Drawing on audited data provided by the Shanghai Bureau of Labour and Social Security and on interviews with employers and Bureau staff we argue that though shaming has the potential to become an important social security enforcement mechanism in China, optimism that this will occur in the near future is not justified. 相似文献
