This article critically assesses how some public law principles, including the doctrine of legitimate expectations, are applied in the Commonwealth Caribbean. It proceeds to discuss the impact of international law on public law and to note that, through the implementation of unincorporated treaties into domestic law, the principle of dualism is increasingly losing its significance and protective effect. The consequence of this is that Governments will continue to want more opt outs and will be more cautious about signing treaties which they are not ready to implement.  相似文献

Recent large-scale cases involving multi-national corporations such as the BAE Systems and Siemens bribery scandals illustrate the difficulties faced by the UK and German sovereign states in controlling complex trans-national and multi-jurisdictional crimes. This article analyses the mixture of enforcement, self-regulatory and hybrid mechanisms that are emerging as part of UK and German responses to controlling transnational corporate bribery. This regulatory landscape incorporates a diverse array of direct and indirect state and non-state ‘regulatory’ actors of varying levels of formality. Mechanisms of a self-regulatory nature vary in terms of their mandatory/voluntary requirements and manufactured/organic formation. However, there is an assumption that the emergence of a variety of enforcement, self-regulatory and innovative hybrid mechanisms is sufficient but in reality this is not the case. Instead, the key argument of the article is that while these mechanisms are aiding the response, they are likely to fail leading to the default position of accommodation by state agencies, even where the will to enforce the law is high.  相似文献

Divisions within the contemporary restorative justice movement in the US often manifest in one state‐supported model: balanced and restorative justice (BARJ). Paul McCold, in this symposium frames the problem with BARJ as one of a corruption of restorative justice principles by its foundation in community justice. This article suggests that BARJ and McCold’s critique share a neglect of the transformative potential of restorative justice for realizing social and economic justice. Moreover, recent experience indicates that BARJ policy planning can take place in a way supportive of Social Equity Restorative Justice (SERJ). The time appears opportune for some peacemaking within the movement.  相似文献

Abstract

The study of schemas in sexual offenders is a relatively new approach in attempts to understand the deviant beliefs and attitudes of sexual offenders. Emerging findings suggest that offence supportive attitudes may be the product of an offender's underlying schemas. This study aims to establish the relationship between offence supportive attitudes and schemas in a sample of mentally disordered sexual offenders (MDSOs). Thirty-one male sexual offenders held within low through high security forensic mental health units were assessed using the Young Schema Questionnaire - Short Version 3 and the Questionnaire on Attitudes Consistent with Sex Offending. Correlational analyses suggested a pattern of relationships in which Insufficient Self-control, Entitlement and Enmeshment arose as the schemas associated with most offence supportive attitudes. This supports a relationship between schemas and offence supportive attitudes in MDSOs and is consistent with the literature to date. Implications for further research and treatment are considered.  相似文献

This article uses Ross Perot's campaign for president in 1992 as a case study in how two key political institutions—the conventional political press and the party system—mediate the effects of political communication. Reporters allocated positive and negative coverage to Perot according to the same rules that they normally follow, and voters were as responsive to this coverage as they were to media coverage of two earlier “outsider” candidates for president, Jimmy Carter and Gary Hart. Part I of this article, which appeared in the previous issue of Political Communication, dealt with the earliest, relatively unmediated phase of Perot's campaign and the takeoff phase of the mediated campaign. Part II deals with the remainder of the campaign, including the general election.  相似文献

This paper examines variation in the timing of compliance with European directives. It formulates and tests the hypothesis that member states' policy-based incentives to deviate from the content of directives influence delay in compliance. This hypothesis is tested along with other factors that are posited to influence compliance, including the amount of discretion directives give member states, the level of misfit between national and European-level laws, and characteristics of member states. The hypotheses are examined in a quantitative research design using arguably the best available information on compliance: national responses to six labour market directives investigated by Falkner et al. [Crossref] [Google Scholar]) for Complying with Europe. The present study develops Falkner et al.'s analysis in two respects. First, it identifies new theoretically important variables and offers measures of these, notably member states' policy-based incentives to deviate and the amount of discretion granted by directives. Second, it tests these hypotheses using multivariate analysis, while Falkner et al. applied bivariate tests only. In contrast to Falkner et al.'s conclusions, the findings indicate that misfit between national and European laws significantly reduces the likelihood of timely compliance. While political opposition at the time of a directive's adoption is not linked directly to compliance, member states tend to oppose directives that do not fit existing national laws. Compliance is more timely for directives that grant more discretion.  相似文献

This paper suggests that the nature of activism is changing to take account of the shifts in political and economic conditions. It further goes on to consider that as a result of these emerging trends we have witnessed a generational shift in how governments, businesses, interest groups and citizens will interact. It is possible to place the issues and questions that this new environment raises under a number of broad headings—Democracy and Dissent, Government and Parliament, Media, and Lobbying –each of which the paper deals with in turn.
